RENT APPLICATION UNDER SECTION 15 OF


SINDH RENTED PREMISES ORDINANCE, 1979

The abovenamed applicants respectfully beg to submit


as under:-

1. That applicants are Owner/ Landlords of Market


constructed on Plot No.8/A and 8/A-1 Civic Centre
unit No.7 Latifabad, Hyderabad, Comprising Shops
on the Ground Floor having acquired by purchase
under sale deed.

2. That opponent has been in use and occupation of


Shop No.5 constructed on the Ground Floor of
above said property as tenant.

3. That applicant have served & Registered A/D


Legal Notice dated 12 05 2006 on the opponent
which was served on him but neither replied the
notice handed over vacant physical possession of
above said shop and paid the arrears of rent from
10-11-2005 up to date.

4. That applicants have decided to re-construct above


said property and in this regard have obtained
necessary approval permission and N.O.C from the
Director Building Control Development, H.D.A
vide Permission dated 13-10-2005.

5. That opponent has also committed default in


payment of rent of above said shop.

6. That the area of above said shop is 12x20 and is


bounded as under:-

North Shop No.4


South Shop No.6
East Shop Main Road
West Open Plot

7. That cause of action for filing above case accrued


on 24-10-2005 when applicants became Owner/
Landlords of above said property. When
Registered A/D Legal Notice dated 12-5-2006 was
served and when approval permission and N.O.C
was granted for Re- construction of the Property
and also opponent committed default in payment of
rent and accruing day to day.

8. That requisites court fee stamps of Rs 15/- are


affixed.
9. That above said shop situated and cause of action
has accrued with the Jurisdiction of this Hon’ble
Court.

It is therefore prayed that this Hon’ble Court


may be pleased to pass order in favor of applicants
as under:-

A. To direct opponent to handover vacant physical


possession of Shop No.5 Constructed on the
Ground Floor of Property/ Plot No.8/A Civic
Centre, Unit No.7 Latifabad, Hyderabad.

B. Cost of above rent Application may be awarded.

C. Any other relief this Hon’ble Court deems fit and


proper in the circumstances of above case.
