CONTEXTS

1. Microban, a judgment delivered on October 25 2011, is set to go down in history as a landmark

ruling of the General Court of the European Union (GCEU). This is true for at least 2 reasons: by
shedding some lights on the new category of challengeable acts, it provides the first interpretation of
the rules governing access to justice after the entry into force of the Lisbon Treaty; by striking down a
‘comitology decision’ for wrong legal basis, it sets a precedent for a more articulated judicial review
of regulatory acts.

RO EQUIVALENT act normativ

DEFINITION Actul normativ reprezintă un act juridic emis de către o autoritate publică învestită cu
competenţe normative, după o anumită procedură şi care cuprinde norme juridice general-obligatorii a
căror aplicare poate fi adusă la îndeplinire şi prin forţa coercitivă a statului. Actul normativ previne
nesiguranţa dreptului, incertitudinile rezultate din schimbările rapide ce au loc în societatea industrială
modernă.
