AFFIDAVIT OF DESISTANCE
I, HANG CHENG SHENG, of legal age, Chinese, and with address at Unit 3116.
Makati Executive Tower 2, Makati City, after having been duly sworn in accordance with
law, hereby depose and state that:

1.0. I am the private complainant in Criminal Case No. XV-05-INV-18D-1658 for

violation of Robbery and Trespass to Dwelling which I filed against MARIA
TERESA CATACUTAN and AGAPITO FELICIANO.

2.0. After a careful, comprehensive and tedious deliberation and consideration of the
facts surrounding the instant case, I have discovered that the same arose of pure
misunderstanding and misappreciation of the said facts.

3.0. In view of the foregoing, I, as private complainant, am no longer interested to

pursue the aforesaid charges against the accused MARIA TERESA CATACUTAN
and AGAPITO FELICIANO.

4.0. As a consequence of which, I, as private complainant, request that the subject case
against MARIA TERESA CATACUTAN and AGAPITO FELICIANO be dismissed
and/or withdrawn.

5.0. I am aware if the consequences of this desistance and I am executing the same
voluntarily, freely and devoid of any duress.
