I feel highly elated to work at Bailadila Iron Ore Mine, Kirandul. The practical realization of the
project report has obligated the assistance of many persons. Firstly I express my deepest
gratitude towards Mr. Subhashis Chatterjee, DGM (PER) and Mr. Daktar Mandi, SR.
MANAGER(MIN) to provide me with the opportunity to work on this project report. His able
guidance and supervision were of extreme help in understanding and carrying out the nuances of
this project report.

I would also like to thank other departments of NMDC, kirandul for providing extensive
database resources and for the internet facilities provided.

Some printing errors might have crept in which are deeply regretted. I would be grateful to
receive comments and suggestions to further improve this project.

Arrived in the township of NMDC and met Mr. Subhashis Chatterjee, DGM(PER).
He briefed us about the administration and functions performed every department
working in NMDC. He also enquired, alloted and told about the work which I need
to perform in the coming 28 days. He also told that majority of the cases are related
with labour laws and the corporation has various labour related issues which is
solved by advocates appointed by NMDC. It was a nice meeting with Dy. General
Manager and other departmental managers with whom I will be working in the
coming days.

4th DECEMBER 2018

Since order was not issued by the civil department, I was sent to work with Mr M.
Siddi Babu who looks into IR department. There he briefed me about the various
labour laws especially Workmen Compensation Act, 1923, Contract labour
( Regulation and Abolition ) Act, 1970 and Payment of Wages Act. He also gave a
case file of Late Shri Satnam Baghel and asked to come and read it next day.

6th DECEMBER 2018

Read the CASE FILE OF SHRI SATNAM BAGHEL whose wife filed the
petition for the grant of compensation as satnam baghel was a contract labour
employed by the contractor namely JJ construction and also from NMDC who was
acting as principal employer of satnam baghel. The case is on appeal and it's not
decided yet.

7th DECEMBER 2018

Prepared the counter replies from both the sides i.e. plaintiff and defendant as to
the case in favour of which party. This was directed by Siddi sir to make the report
on the case and the following has been attached.

8th DECEMBER 2018

Worked under sir, GANPATH G. AGM(PER). He gave the case file to read. The
case was of Sukoo Ram Kashyap v/s NMDC. In this case, Sukoo ram was an
employee of NMDC. In NMDC every employee’s attendance is marked by the
system. In this case, due to some discrepancies in the attendance registering system
his wages were cut. Though the report said that he leaved the office early and used
to come late. He asked for compensation and he was granted the same by the
corporation later on by the method of arbitration under the guidance of Ganpath
Sir.

Worked under sir, GANPATH G. AGM (PER). He made me read the Standing
Orders Act, 1946 and also the Settlement Act.
Got to know what is standing orders ?
Standing orders means rules of conduct for workmen employed in industrial
establishments. The object of the Act is to require employers in industrial
establishments to formally define conditions of employment under them.

MATTERS TO BE PROVIDED IN STANDING ORDER UNDER THIS ACT

1. Classification of workmen
2. Manner of intimating to workmen periods and hours of work, holidays, pay-
days and wage rates.
3. Shift working
4. Attendance and late coming
5. Conditions of procedure in applying for, and the authority which may grant,
leave and holidays.
6. Requirement to enter premises by certain gates, and liability to search.
7. Closing and re-opening of sections of the industrial establishment and
temporary stoppages of work and the rights and liabilities of the employer
and workmen arising thereform.
8. Termination of employment
9. Suspension or dismissal for misconduct
10.Means of redress for workmen against unfair treatment or wrongful
exactions by the employer or his agents or servants.
11.Any other matter prescribed.

Also on this particular day read the case of RAM KUMAR BANCHHORE VS
UNION OF INDIA and NMDC.
In this case by way of writ petition, the petitioner i.e. ram kumar banchhore is
challenged the legality and validity of selection list issued by NMDC on the
ground that the NMDC has not followed the reservation system and selected more
that 13 candidates from list of Scheduled Tribes category and less than 20
candidates from list of general category.

The petitioner contended that that the respondents NMDC conducted written
examination in which the petitioner appeared and passed said examination, he also
passed physical examination, and therefore the respondent called the petitioner in
the interview as per the merit position of petitioner in general category list, the
petitioner appeared in the interview process. Also the petitioner was working with
the NMDC and had sufficient experience for work of filed attendant but the
NMDC selected such candidate who does not have sufficient experience for the
said work.

But the justice N Naha Roy contended that the respondent has followed the
reservation system as the govt. Directives/Rule of reservation strictly. The position
of Law/Rule is very crystal clear that, there is no quota for General/UR
vacancies/posts. The reserved candidates can compete for the the UR
vacancies/posts, provided they met with the same standard as applicable to general
candidates who secured general standard/merit are adjusted against the UR posts/
vacancies and they cannot be adjusted against the reserved post/vacancies under
the extant law.

Hence it is clear by the above stated para, the contention of the petitioner that he
had secured 14th position in merit in the list of General category does not hold
water and is a misconceived statement, relying on which no case may be made out
in his favour and therefore, the present petition was dismissed by the Hon’ble
court.

Worked under ma’am SMT. ALKA SINGH, DY. MGR (PER), and she allotted to
read the case files kept at the IR dept.

I read different case files and one of the case was of SHRI DHANSON AND
SMT. BIMLA DURGA of G.S. KUMAR CONSTRUCTION.

In this case the commissioner for workmen compensation, jagdalpur intimated


about the claim for compensation made by both smt. Bimla durga and Dhanson
against NMDC Ltd.

Both the petitioners in this case contended that they were injured while working
under the supervision of respondent i.e. NMDC.

Also the respondent no. 1 in this case was contractor at NMDC, Kirandul and
working under the supervision of respondent no. 2, who in turn is the site engineer
for digging 10 feets deep drains for laying of sewage pipes as per work order.
The incident happened had occurred when both the petitioners was working near
prakash vidyalaya for laying sewage pipelines. While digging 10 feets deep drain,
the dugout soil fell on the petitioner and other co workers due to which the
petitioners suffered injuries and fractured.

Both the petitioner had taken treatment at project hospital for some time and as
they are sole bread earner of the family they wanted the wages to be paid to them
during such period of treatment.
However in this case Bimla durga was given full wages upto the date she was
admitted in the project hospital. However it was found out by the court that
Dhanson was admitted in the hospital only for one day and thereafter he was
discharged and hence he was wages only of one day.

Worked under G. VELVASANTHAN, MGR(PER), and he gave the file of


SHUTTLE BUS SERVICE CONTRACT OF NMDC with the Samiti. He further
asked to provide some other points which can improve the shuttle bus service.

Here are my some considerations which will improve the bus service to some
extent:-
1. Jurisdiction of the bus should be extended
As there is no transport facility available in kirandul, the bus should at least
travel within the township of NMDC taking and dropping the passengers as well
the employees to their respective homes.

2. Reservation of seats should be made for senior citizens as well as for


pregnant ladies.

3. Time display board should be executed at the bus stop so that it would be
more convenient for the passengers to know when the bus would be arriving
at the respective place.
4. Strict rules should be made with respect to the person who donot have a
pass should not be allowed to enter into the bus for the safety of other
passengers.
5. Conductor must be engaged in every bus for safety purpose
6. The last and most important point is that driving speed should not be
exceeded beyond the particular limit as specified taking into consideration
that it is a hilly area.

Vellu Sir also made me read the file of “PROVIDING TOWNSHIP SECURITY
SERVICE at NMDC Township, Kirandul Complex” whose average cost was an
estimated amount of Rs. 3.78 Cr for a period of two years for engaging 70 Security
Guards and 04 Security Supervisors.
