PLEA BARGAINING PROPOSAL

The Prosecution, through the Assistant City Prosecutor, and the

accused, Claudio Claudio, through counsel, most respectfully submit this
Plea Bargaining Proposal for the Honorable Court’s consideration and
approval, and state that:

1. They come before the Honorable Court with this Plea Bargaining
Agreement before the Prosecution rests its case.

2. Department Circular No. 27 of the Department of Justice dated June

26, 2018 provides that those charged under Section 7, Article II of RA
9165, as amended, can plea to an offense of either Section 12
(Possession of equipment, apparatus, and other drug paraphernalia for
dangerous drugs) or Section 15 (Use of dangerous drugs).

3. Accused Claudio Claudio hereby withdraws his plea of not guilty and
offers to enter a plea to the offense ofPossession of equipment,
apparatus, & other paraphernalia for dangerous drugs as defined and
punished under Section 12,punishable by imprisonment of 6 months
& 1 day to 4 years and a fine ranging from P10,000.00 to P50,000.00.

4. The Public Prosecutor finds that the offer of plea to said offense is in
consonance with law and jurisprudence and interposes no objection.

5. The Public Prosecutor therefore consents to the accused CLAUDIO

CLAUDIO’s change of plea to the offense of Possession of
equipment, apparatus & other paraphernalia for dangerous drugs,
defined and penalized under Section 12, Article II, of RA 9165.
