And Their Solution In The Light Of
Islamic Teaching
The muslim world is in a state of crises. Many Muslim countries suffer
from political crises, economic backwardness, weak infrastructure, bad
education, lack of competitiveness in science and technology, polluted and
badly managed cities and environmental hazards. They are paralyzed by
social inequality, injustice towards women, extremism, violence and
terrorism. Islam’s core teaching of peace, justice and compassion are lost
in the brutal races for worldly power. Political leaders, religious scholars
and intellectuals have mostly failed to stop the internal bleeding in the
Muslim’s world. One of the major crises and serious issue for the Muslim’s
world and Muslim’s women is ban on Hijab in many countries.

Change in Hijab Rules in France:


Wearing scarf or hijab is a major issue the Muslim world is facing in
the bunch of all political and economic crises. The coalition and opposition
have rejected calls for a ban on the burqa or hijab, but some countries have
introduced the controversial law, such as Switzerland, Belgium, Turkey,
Spain, Italy and France. It means women wearing burqa (full body covering
with mesh over the eyes) or niqab (full body covering with a slit for the
eyes) could face heavy fines in such countries where it is banned.

Earliest Change in Rules:


The movement to limit women wearing headscarves and Muslim
veils, such as the burqa and niqab, has been growing in Europe for more
than a decade. Now the European court of justice, the European’s highest
court, has ruled that employers can ban staff from wearing headscarves, its
first decision on the issue of employees wearing visible religious symbols at
work.

The Islamic scarf controversy in France, referred to there as the Islamic


veil affair or the scarf affair which arose in 1989, pertaining to the wearing
of the hijab in French public schools. It involved issues of the place of
Muslim women, differences between Islamic doctrine and Islamic tradition,
the conflict between communitarians and the French policy of minority
assimilation, discussion of threat to French society and of Islam phobia.

Reason of this Rule:


The controversy over the Islamic scarf was sparked on 18 September
1989, when three female students were suspended for refusing to remove
their scarves in class at school, in November 1989, the conceal ruled that
the scarf’s quasi religious expression was compatible with the public
schools.

In January 1990, three girls were suspended from middle school in


Picardy. The parents of one of three girls previously suspended against its
principle. Following these events, teachers at a middle school held a
general strike against headscarves in schools.

In September 1994, a new French memo was issued, delineating the


difference between discreet religious symbols able to brought into class
rooms, and ostentatious religious symbols (including the Hijab), which were
to be forbidden in public establishments. In October of that year, students
organized a demonstration of protest in favor of the rights to wear the veil in
class room. In November 24, 1994, “24” veiled students were suspended
from the same high school.

Between 1994 and 2003, around 100 female students were


suspended or expelled from middle and high schools for wearing the scarf
in class. In nearly half of these cases, their exclusions were annulled by the
French Courts.

France- The first country to ban Hijab:


On 11 April 2011, France became the first European country to ban the
full face Islamic veil in public places.
Under the ban, no woman, French or foreign, is able to leave their
home with their face hidden behind a veil without running the risk of fine.
The main purpose of hijab ban was the difficulty facing by Europeans in
identifying people. Also they say that the full covering face prevents
communication into the French or Europe.

In addition, they argued that niqabs, hijabs and burqas violate the norms
of religious life in France. While in the American or US, citizens are
guaranteed the freedom of religion and privacy and the French guaranteed
a freedom from religion. Because of this policy of French, religious symbols
are often banned from the public space in general.
In France, the the burqa ban also imposes a fine of approximately
30,000 euro and even one year prison for any person who forces woman to
take headscarves and Burqa.

As the five million living in France, France has the largest Muslim
population in Europe. In spite of this truth, the religion freedom is not giving
in the France and the burqa ban and headscarves is ban in France.

Violation of Human Rights:


French law banning the headscarves for the Muslim women in public
indirectly targets the minority of the Muslim women who wear the
headscarves, they said that no one can explain the adequately reasons for
banning headscarves were ban.

It is so clear that the French’s hijab ban rule is the violation in the Human
rights. It is right of every person to let him/her the full religious freedom.
