AFFIDAVIT OF DESISTANCE

I, MARK MORRIS B. DUGYON, of legal age, single, Filipino

citizen and a resident of Poblacion East, Lagawe, Ifugao, after having
been duly sworn to in accordance with law, do hereby depose and state
that:

1. I am the private complainant against ROLLY ERENEZ in

Criminal Case No. 2707 for QUALIFIED THEFT still pending at
the Regional Trial Court Branch 14, Lagawe, Ifugao;

2. That I am no longer interested in prosecuting the above-

mentioned case due to the fact that we amicably settled the
case and that he promised not to do it again. In fact, I even
hired him back under my employment;

3. In as much as we have amicably settled the case,

I hereby cause this affidavit of desistance to support the
dismissal of this case knowing fully well the consequences
thereof.

4. I was not forced, coerced or in any way intimidated in desisting

and executing this affidavit.
