EXPRESSION OF INTEREST

For and on behalf of NESCO Utility , Expression of Interest is invited from different bidders , who
comply with the terms & conditions and specification laid down in RFP documents for the work
“Implementation of Technology Based (On Line)New Service Connection” under Balasore,
Bhadrak, Jajpur Road, Baripada & Keonjhar Electrical Circles of NESCO Utility.

The interested Firms having good track record may submit their bid documents on or before dt.26.08.17
within 3.00 PM. and bids will be opened on 26.08.17 at 3.30 PM.

The intending bidders can download the document from our website www.nescoodisha.com. In
the event of any specified date for submission or opening of bids being declared as holiday for
NESCO Utility or any ‘force majeure’ , the bids will be sold / received / opened up at the appointed
time on the next working day.

NESCO Utility also reserves the right to accept or reject any or all EOI without assigning any reason
thereof, if the situation so warrants.

REQUEST FOR PROPOSAL (RFP)
1.0 GENERAL:

NESCO Utility is desirous for providing better service to the upcoming consumers & timely
giving new service connection & taking them into billing folder in h i s licensed under Balasore,
Bhadrak, Jajpur Road, Baripada and Keonjhar Electrical Circle in the state of Odisha under Deposit
work Scheme.

2.0 SCOPE OF WORK:

a) This covers deployment of latest technologies and software by undertaking all new service
connection activities of single phase consumers from receiving application from consumer to
installation of meter including database updating.

b) Deployment a team for receiving new connection application from consumer along with required
documents, their site survey with GPS co-ordinates, issuance of Demand Note, receiving the
payments, meter installation for releasing the connection and finally updating database .

c) Ensure to streamline the on line service connection activities , timely and transparent information
inflow and outflow through web based NSC (New Service Connection) software systems with
actionable MIS and dashboards which will be single source of Truth.
3.0 INVITATION FOR EOI :
NESCO Utility invites sealed bid from reputed Firms with required or requisite license, either in
individual capacity or as part of a joint venture agreement / consortium for carrying out new
service connection to single phase consumers . The bidder must fulfill all the qualification
requirements as specified in clause 2.0 stated below. The sealed envelopes shall be duly super
scribed as “EXPRESSION OF INTEREST” NOTICE No: NESCO Utility / 10/ 17-18/

4.0 Qualifying Criteria :
Bidders to be considered as eligible to bid should meet the following qualifications;

4.1 The prospective Bidder(s) should be a registered Sole Proprietor Firm/ Partnership Firm/ Company,
possessing valid MV/HT Electrical License from the ELBO, Government of Odisha.

4.2 The Bidder should possess the followings:


i. Valid EPF Registration Certificate.
ii. Valid ESI Registration Certificate.
iii. GSTIN.

4.3 The Bidder should have similar experience in Distribution Utility/reputed Organization within last 3
years.

4.4 The prospective Bidder(s) have to submit audited balance sheet as proof of their Annual Turnover from
service business in the preceding three years of FY 2016-17.

4.5 The indenting bidder(s) shall furnish the documentary evidence pertaining to the above qualifying
criteria or else their bid shall be rejected outright without any further correspondence.

4.6 Each Bidder shall submit Bid by himself in case of Proprietary and incase of partnership any of the
partner shall submit the Bid and in case of private company, the authorized signatory will submit the
Bid. A Bidder in joint venture / consortium shall not be allowed to participate in the bid.

5.0 BID EVALUATION :


5.1 After evaluation the bid documents, the eligible bidders shall be invited for demonstration at Head
Office, NESCO Utility, Balasore to share their experience / proposal on implementation of
technology Based ( on line) new service connection .

5.2 Then the contract price bid quotations shall be invited from the qualified bidders in details.

6.0 AWARD OF JOB CONTRACT:


6.1 In normal circumstances NESCO Utility will generally award the NSC contract to the successful
Bidder whose Bid has been determined to be the lowest evaluated responsive Bid Circle wise ,
provided further that the Bidder has been determined to be qualified .

6 .2 If the lowest evaluated price (L1) Circle wise of more than one responsive bidder(s) is same, then in
such event the contract will be finalized through a transparent lottery system.

6.3 NESCO Utility has the discretion to award NSC contract to other bidders (L2, L3, L4 & onwards)
at L1 price only in a particular Division/Circle .

7. 0 CONTRACT PRICE:

For the Service mentioned above the bidder shall quote their price inclusive of all taxes and duties
except GST. GST will be paid extra at applicable. The above charges shall be preferably on for;

a) Releasing specific numbers of new service connection including meter installation (Start to finish)
Circle wise .

b) Towards fixed cost for Manpower, equipment within office, computer hardware cost, Tablets,
software customization, internet charges, maintenance and administrative expenses.

c) If in any month the number of new connections released will be less than specific quantity, the
shortfall will be carried forward to the subsequent months.

d) For releasing New Service Connection more than specific numbers, the bidder have to quote the
price except service connection for each new service connection will be paid as monthly variable
charges.

e) Other charges if any.

8.0. PRICES:

The above contract price is FIRM and exclusive of GST which shall be paid extra as applicable.
However, the total contract price is variable and evaluated as per the actual no of New Service
Connections given in a month.

9.0. TAXES & DUTIES:

The contract price is exclusive of GST which will be paid extra as applicable. Any changes in the
GST during the contractual period shall be borne by the NESCO Utility. All statutory deduction as
applicable at the time of the payment shall be deducted and to be deposited with the relevant tax
authorities.

10.0. SERVICES PROVIDED BY CONTRACT AGENCY:

The contract agency shall provide services for New Connection Management with the following
requirements.
1. Use online software for managing and tracking issuance of new connection in best possible
time.
2. Online submission of new connection application, for the consumers. Consumers may also call
customer care for requirement of new connection.
3. Introduction and implementation of “New connection at door step” concept for Consumers .
4. To carry out various activities like survey of site, sanction of estimate, issuance of demand note for
collection of amount towards new connection, release of new connection. Online tracking of the same
and information of all activities with responsible person is communicated to consumer at every stage.
5. Online, real time MIS report generation regarding new connections.

6. Use of system generated ticket number for all NSC applications.
7. Online database updating of new consumers for billing.
8. Online tracking of issuance of first bill to new connection consumers.
9. Online dash board for new consumers billed in the month.
10. Any other development in technology for NSC to be mentioned by the bidder.

11.0. RESPONSIBILITY OF NESCO UTILITY:


1. Providing necessary access to customer care centre.
2. Providing office space, furniture and power supply at mutually agreed locations.
3. Providing all pending applications, cases regarding NSC.
4. Support for technical and commercial staff.
5. IT team support for data updating in database.
6. Providing reasonable quantity of stock of various materials for NSC meter installation like meters,
service cables, G.I. Wire, Bend Pipe, AI Bobbins etc. under scope.
7. Information dissemination to consumers.
8. Issue of specific Nos. of meter with service kit after signing of the agreement and deposit of
Security Amount. Subsequent meter & Service Kit will be issued after utilisation of at least 70% of
meter & Service Kit.
9. A standard Operating Procedure (SOP) for providing NSC is to be prepared in mutual consent with
the Agency and submitted to the Agency for implementation.

12.0. RESPONSIBILITY OF THE AGENCY:

a) Carry out all activities in releasing of new connection from receiving application from
consumer till meter installation and database updation, by deploying teams as per requirement.
b) Manage complete new connection activity with web based online software support.
c) To provide various MIS and dashboards regarding the NSC activity.
d) Demand Note must be issued within 7 days after registration of the consumer / issue of Ticket
No.
e) New Service Connection must be released within 3 days to urban consumers and within 5 days
to rural consumers after payment receipt. In case of requirement of LT Extension 15 days more
time may be taken for releasing NSC. In no case it should be beyond the time limit specified in
OERC Distribution (Condition of Supply) Code, 2004 for releasing New Service Connection.
f) Security deposit and service connection charges should be collected as per tariff notification
from time to time.
g) In no case you should collect more than the rate stipulated in tariff order. If it is found that
you are collecting more than the tariff, it may be treated as breach of trust & action as deemed

fit may be initiated against you.
h) You shall submit a Weekly and Monthly Report to C.O.O. & Sr.GM (Elect.), NESCO Utility
and a list of NSC in hardcopy along with the Bill. A monthly Report on release of NSC shall
also to be submitted to the concerned SDO & Executive Engineer for record and verification.

13.0 ADVERTISEMENT:
As it is new concept, wide publicity shall be made before launching of the same in the concerned area
by way of announcement, print and electronic media. Expenditure towards advertisement will be
reimbursed to you as per actual within the monetary limit approved by NESCO Utility.
14.0. PERIOD OF CONTRACT:
The Contract Period initially is for a period of 12 (twelve) months from the date of execution of
agreement, which may be extended further with mutual consent & performance.

NESCO Utility will have the sole discretion to extend the terms of the agreement for a period of one
year at a time after taking into account inter alias the performance of the Agency in complying with its
obligations under this agreement, at least two calendar months prior to the date of expiry of the validity
of agreement. NESCO Utility shall notify the Agency that it wishes to extend the period of agreement.
After receipt of notice by the Agency both NESCO Utility and the Agency shall discuss and mutually
agree in writing the terms and conditions on which the period of agreement will be extended including
the rate and performance parameters.

NESCO Utility also reserves the right to terminate the contract at any time giving you three (3) months
prior notice of such termination. Similarly the agency shall have the right to terminate the contract by
giving three (3) months notice.

15.0. DEPOSIT OF COLLECTED AMOUNT FROM CONSUMERS:

Amount collected from consumers towards security deposit & service connection charges must be
deposited by the Contract Agency within 48 hours, excluding holiday along with detailed statement. If
the collected amount is not deposited within the scheduled time, interest @ 15% per annum will be
charged on the defaulting amount for the days delayed.

16.0. SECURITY DEPOSIT:

a) For providing Materials:

One time Security Deposit shall to be deposited in shape of Demand Draft / Bank Guarantee from any
Nationalized Bank or Scheduled Bank in favour of the Administrator, NESCO Utility Payable at
Balasore for a period of 15 Months in the prescribed format for issuance of meters with Service Kit.

b) For Cash handling (collection of Security Deposit & Service Connection Amount from
Consumers):
One time Security Deposit shall to be deposited in shape of Demand Draft / Bank Guarantee from any
Nationalized Bank or Scheduled Bank in favour of the Administrator ,NESCO Utility Payable at
Balasore for a period of 15 months in the prescribed format for cash handling relating to collection of
security deposit and service connection up to six days.

c) Performance Bank Guarantee:


Within 15 days of receipt of this Work Order, you shall be required to furnish Performance Bank
Guarantee for an amount equal to ten percent (10%) of the total contract price of the work order to be
executed on a non-judicial stamp paper worth Rs. 100/- subject to change as per Odisha Stamp Duty
Act from a nationalized Bank encashable in local Branch at Balasore in the prescribed format of
NESCO Utility with validity up to 90 days after completion of the entire Work Order . The Bank
Guarantee covering the execution of contract will be returned only, on successful execution of the
contract. No piecemeal Bank Guarantee or for shorter than the prescribed period shall be accepted.

17.0. TERMS OF PAYMENT& EFFECTIVE DATE OF WORK ORDER:


1. The Agency shall be paid one month Fixed Charges as mobilization advance on submission of
BG for the purpose having validity for 13 months .
2. Above advance payment shall be interest bearing and recovery of advance along with the
interest component on the above amount shall be as under.
i. The same will be adjusted on pro-rata basis (i.e. 10% per month) from onward monthly
invoice)
ii. The amount of interest to be recovered from a particular bill shall be calculated @ 10%
per annum on the value of advance corresponding to the monthly payment being
released. The period for which the interest is to be calculated shall be reckoned from the
date of release of the advance payment to the actual date of release of such monthly
payment or the expiry of the stipulated time frame for release of such monthly payment.
If any amount payable under any monthly bill is not sufficient to cover all deduction to
be made for interest on the advance payment and other sums deductible there from, the
balance outstanding shall be recovered from the next payments immediately falling due.
3. The agency shall submit the invoice for the services rendered by you on monthly basis along
with list of NSC subdivision wise consumer with exceptional reports if any in the agreed
format to the GM (Com.) by 30th of the month. Proof of PF & ESI deposit of last month is also
to be submitted along with the Bill.
4. The Manager (Com.) will certify the invoice and forward the same after due certification to the

DDO, NESCO Utility for Pass & Payment. Payment will be made within 15 days of
submission of claim subject to certification on the basis of release of NSC.
5. The terms of payment as described above shall be subject to submission of 10% Performance
Bank Guarantee (on the entire contract value) and after due approval of the BG.

18.0. OPERATIONAL DATA SECURITY:


18.1. Security:
a) The Contract Agency shall ensure absolute data security in handling Utility’s operational data
and Applications, which includes.
i. Authorization,
ii. Data integrity and users' confidentiality and privacy; complete protection from
misuse / fraud.
iii. Data Security.
b) In transit by providing the ability to execute secure, authenticated, two-way transactions as
well as ensuring that all other data is encrypted beyond the reasonable threat of a successful
force attack.
18.2. Support:
The Agency must offer technical support and query resolution through email. There should be
single point of contact for any query resolution from your’s end.
18.3. Data Backup:
The Agency shall make regular backups of all NSC related data. You shall make backups
available to authorized personnel at the operation centre and / or NESCO Utility authorities
upon request.

19.0. VALIDITY OF WORK ORDER / AGREEMENT:

a) Acceptance of letter of award within one week of issue.


b) Submission of unconditional Bank Guarantee of any nationalised bank with validity up to 90
days after completion of the entire Work Order.
c) The Contract Agency will execute the agreement with NESCO Utility within 30 days from
the issue of this work order.

20.0. ADHERENCE TO SAFETY PROCEDURES, STATUTORY RULES, AND


REGULATIONS:

20.01 The agency shall comply with the provision of all laws including' labour laws, rules, Electrical
licenses, regulations and notifications issued there under from time to time. All safety and
labour laws enforced by statutory agencies and by NESCO Utility shall be applicable in the
performance of Work and you shall abide by these laws.

20.02 The agency shall be responsible to comply with all the statutory obligations arising out of Law
of the Land. Your Firm should be duly registered with Provident Fund, ESI authority and

liability for such payment to these authorities shall be entirely borne by you. NESCO Utility
shall not bear any responsibility whatsoever under this account.

20.03 The agency shall take all measures necessary or proper to protect the personnel, work and
facilities and shall observe all reasonable safety rules and instructions. You shall adhere to all
security requirement / regulations of the NESCO Utility during the execution of the work.

20.04 The agency have to obtain necessary License and competency certificate from the Electrical
Inspectorates to handle the lines, equipments by the personnel employed by him. You are
responsible for any accidents caused to the personnel and damage to equipments during the
period of contract. You are responsible for the loss sustained by NESCO Utility due to damage
of equipments. You shall be responsible for payment of compensation in case of accidents
while carrying out the service connection activities. NESCO Utility is no way responsible for
any of the accidents.

20.05 The agency shall follow the provision of Industrial Dispute Act in case of any disputes arises
with his personnel.

20.06 The agency shall not sublet, transfer, assign or otherwise part of the contract or any part
thereof, either directly or indirectly covered under scope of work.

20.07 The agency shall be responsible for recruiting employees at his choice with valid Licence.
Under no circumstances, the employees of your shall be considered as NESCO Utility
employees and claim remuneration at par with NESCO Utility employees. You shall make it
clear to the employees engaged by you are your employees and NESCO Utility has nothing to
do with your employment or any other claim. You shall submit copy of the appointment orders
duly accepted by the personnel engaged by him before execution of work.
20.08 The personnel engaged by you shall be courteous, obedient and sincere to officials of NESCO
Utility & new consumers while discharging the duties entrusted to them and shall carry out
instructions of concerned Divisional Manager and Circle-in-charge. In case of any misbehaviour
by any of the employee engaged, you shall take full responsibility in replacing the concerned
with a suitable trained person.

20.09 The agency shall report as soon as possible any evidence, which may indicate or is likely to lead
to an abnormal or dangerous situation and shall take all necessary emergency control steps to
avoid such abnormal situations.

21.0. EVENTS OF DEFAULT:

Events of Default. Each of the following events or occurrences shall constitute an event of
default (“Event of Default”) under the contract:

(a) Service Provider fails to pay any statutory duty within the time frame due under the
contracts.

(b) Service Provider becomes insolvent or unable to pay its debts when due, or commits any
act of bankruptcy, such as filing any petition in any bankruptcy, winding-up or
reorganization proceeding, or acknowledges in writing its insolvency or inability to pay its
debts; or the Service Provider file any petition relating to bankruptcy of Service Provider;
(c) Service Provider otherwise fails or refuses to perform or observe any term or condition of
the Contract and such failure is not remediable or, if remediable, continues for a period of 30
days after receipt of written complaint from NESCO Utility.

22.0. CONSEQUENCES OF DEFAULT:


If an Event of Default occurs and would be continuing, NESCO Utility may forthwith
terminate the Contract by written notice.
In the Event of Default, NESCO Utility may, without prejudice to any other right granted
to it by law, or the Contract, take any or all of the following actions;
i) Cancel the contract and present for payment, to the relevant bank the Contract Performance
Bank Guarantee;
ii) Recover any losses and / or additional expenses, NESCO Utility may incur as a
result of Service Provider’s default.
23.0. LEGAL:
1. The service provider will indemnify NESCO Utility against any liability or damages by way of
compensation arising from any accident to person or property of persons in their
employment.
2. The service provider will indemnify NESCO Utility against any liability or damages by way of
compensation arising from any accident to any other person related to or unrelated to their or
NESCO Utility.
3 The service provider shall bear the entire responsibility, liability and risk relating to coverage
of work force under different statutory regulations including but not limited to Workmen
Compensation Act, ESI Act, Factory Act, Contract Labour Act 1970, etc. and any other
relevant regulations, as the case maybe.
4. The service provider shall be fully responsible for payment of benefits including but not limited
to Provident Fund, Bonus, Retrenchment Compensation, Leave Encashment, etc. as per
statutory provisions.
5. Necessary payment of liabilities shall be the responsibility of their irrespective of payment
received from NESCO Utility or otherwise.
6. Payment of all taxes and dues except Service Tax applicable during the tenure of the contract
payable to government or local authorities in respect of these works shall be the responsibility
of him. A copy of the statutory records shall be provided on a monthly basis to the NESCO
Utility.
7. GST at the applicable rate shall be paid extra on the monthly invoice raised by you. Also any
new levy applicable to the work executed by the agency shall be to NESCO Utility’s account
and shall be paid subject to production of documentary evidence.

24.0 NESCO Utility reserves the right to reject all or any EOI without assigning any reason at any time
and at any stage.

24.1 NESCO also reserves the right to modify the conditions to adopt the latest technology , if any.
