3. That on request of the Transferor/Allottee, the HSIIDC has agreed in
p r i n c i p a l f o r t r a n sf e r o f p l o t a n d su b s e q u e n t l y H S I I D C h a s i s s u e d
P r o v i s i o n a l t r a n s f e r p e r m i s s i o n l e t t e r n o . HSIIDC/IMT/ESTATE/2019/4783
dated 06.02.2019 i n t h i s b e h a l f , t h e s a i d t r a n s f e r i s s u b j e c t t o
c o m p l i a n c e o f c er t a i n t e r m s & c o n d i t i o n s a n d t h e e x e c u t a n t s h e r e b y
confirms that the all the terms and conditions of such provisional
t r a n s f e r p e r m i s s i o n l e t t e r d a t e d 0 6 . 0 2 . 2 0 1 9 h a v e b e e n c o mp l i e d .

4 . T h a t I / w e h e r e b y u n d e r t a k e t h a t i n c a s e a n y i n c r e a se i n F A R i s
r e q u i r e d a t a n y s t a g e , I / w e w i l l a p pr o a c h t h e c o n c e r ne d o f f i c e to
c o n s i d e r m y / o u r r eq u e s t f o r a n y s u c h i n c r e a s e o n m er i t s o f t h e c a s e
a n d a n d t h i s p er m i s s i o n b y w a y o f PT L ( P r o v i s i o n a l T r a ns f e r L e t t e r )
will not entitle me/us for any inc rease in FAR.

5. That I/we hereby undertake that the provisional transfer conveys only
technical permission in terms of allotment which is required to be
t a k e n b y t h e A l l o t t e e ( s ) / T r a n s f e r e e ( s ) f r o m t h e c o r p o r a t io n a n d s h a l l
n o t a b s o l v e t h e T r a n s f e r e e ( s ) / A l l ot t e e ( s ) / E x e c u t a n t ( s ) f r o m a n y
o t h e r c l e a r a n c e r eq u i r e d f r o m a n y o f t h e a u t h o r i t i e s u n d e r a n y o t h e r
Act(s), whatsoever, and the HSIIDC/Corporation shall in no way be
r e s p o n s i b l e f o r a n y v i o l a t i o n o f a n y A c t ( s ) a p p l i c a b l e f ro m t i m e t o
time.

6. That I/we hereby undertake to abide the terms and condition of


Estate Management Procedure - 2015, as amended from time to time
and also the said plot will be governed by the EMP - 2015, as amended
from time to time.

7. That I/we undertake that the plot premises shall be used only for
carrying out approved/permissible activity(ies) only as defined under
EMP-2015 and shall not be utilized for any non -permissible activity
i n c l u d i n g o f f i c e / se r v i c e c e n t e r / go d o w n / w a r e h o u s e / / b u y i n g
house/showroom/display and Sales/trading/ training centre etc.

8. That I/we undertake that no relay/communication tower shall be


installed at he roof top without prior written permission of
corporation.

9. That I/we hereby undertake that the building shall be used in


a c c o r d a nc e w i t h a p p r o v e d b u i l d i n g p l a n s a n d o c c u p a t i o n c e r t i f i c a t e
only

10. T h a t I / w e u n d e r ta k e t h a t i / w e h a v e v e r i f i e d t h a t t h e r e i s n o
construction violation and no zoning violation, at the Plot
P r e m i s e s / s i t e a n d I / w e f u r t h e r u n d e rt a k e t h a t w e s h a l l b e s o l e l y
responsible for the payment of penalities/compounding fee and/or
removal of the same and/or damages caused due to same.

11. That I/we undertake that the Basement constructed at the plot
p r e m i s e s i s n o t e xc e e d e d t h e m a x i mu m p e r m i s s i b l e z on e a n d I / w e
further hereby undertake that the Basement shall be used only for the
p e r m i s s i b l e u s a g e , a s g u i d e d b y H SI I D C i . e . f o r P a r k i n g, S t o r a g e &
Utilities only, if it satisfies the public health, fire safety and
s t r u c t u r e r e q u i r e me n t a n d n o t f o r a n y o t h e r p u r p o s e i n c l u d i n g
industrial/manufacturing/R&D Lab shall not be carried out in the
Basement.

12. That I/we undertake to comply with all the rules and regulations
o f H S I I D C a s a p p l i c ab l e o n s a i d p l o t f r om t i m e t o t i m e i nc lu d i n g t e r m s
& c o n d i t i o n s o f p ro v i s i o n a l t r a n s f e r , Industrial P o l ic y o f t h e
State Government and Estate Man agement Procedures-2015 of
HSIIDC, as amended from time to time.

13. That if I/we fail to observing the above conditions(s) then the
corporation shall be at liberty to take any action as per the terms and
conditions of the allotment and agreement including ta king over the
d e m i s e d p r e m i s e s a n d c a nc e l t h e a ll o t m e n t o f t h e p lo t / p r e m i s e s
without prejudice to all other rights of the corporation.
