CARETAKER AGREEMENT

THIS AGREEMENT is made and entered at NaviMumbai,on this


15th May 2018.

Between

MR. Ramji Nageshwar Tirpathi


An adult ,Indian inhabitant, residing at,
Room No 12 , Intelpada Digha , Near Shiv Mandir, Navimumbai
400708.

Hereinafter called “THE APARTMENT OWENER” of the ONE PART


AND

Mrs. Rajshekhar Koliyar


an adult Indian, inhabitant residing at,
Room No D-168, Sector 3 Airoli, Navimumbai 400708.
.
Hereinafter called “THE CARETAKER” of the SECOND PART.
Whereas the apartment is seized and possessed of or otherwise will and
sufficiently to an Shop No 1366, Vishunagar Digha, Airoli
Navimumbai 400708.

Owner Caretaker
As “THE SAID PREMISES” which is in his /her exclusive possession and license to
use of the said premises as here under described which the apartment owner has
agreed to open the terms and conditions hereinafter contained.

1) The Caretaker shall use the said premises for residence purpose
only.

2) The Owner hereby grant unto the Caretaker use the said
premises for 11 (Eleven) months only commencing from
15/05/2018 to 14/04/2019 .
3) In consideration of the said premises to use the Caretaker has
paid to the Apartment Owner by way of Security deposit for
such as Rs 18,000.
(In words Eighteen thousand only ) for 11months in advance.

4) In consideration there of use of the said premises the Caretaker


shall pay to the Apartment Owner the monthly rent Rs 9,500 .
In words Nine thousand five hundred only.
Regularly monthly on 15th of the Every month.

5) The Caretaker hereby covenants with the Apartment Owner:-

a. To quite remove himself, his family, servants and their


belongings from the said remises at the end of 11 months or
upon the earlier termination of the permission and with the
fixtures, fittings therein proper conditions usual wear and
tear expected.

b. The Caretaker hereby covenants with the apartment owner


to duly and punctually pay the electrical charges, water
charges and society service charges monthly by every month
at the time of handing over the vacant possession by the
caretaker to the Apartment owner.

c. To permit the Apartment owner and his agents at all time to


enter for inspection of the said premises, it being agreed that
the Apartment owner shall be at times in control, dominion
and possession of the said premises
Shall not be in the exclusive possession or use of the
Caretaker.

d. To use the said premises only for residential purpose and not
to use the same for business purpose any illegal, immoral or
improper purpose or as a public house not cause permit of
suffering any part thereof anything which may become a
nuisance or annoyance of cause damage to the apartment
owner or the adjoin owner or occupier of neighboring
properties.

e. Not to make any charges, alterations or addition in or to the


said premises or the fixture, fitting and amenities therein. The
Caretaker is responsible for the damage of any in respect of
the said apartment and is liable to compensate to the
apartment owner.
f. Not to claim any rights or interest of any kind or nature
whatsoever in the premises or any part there of save and
except to use same as a caretaker.

6. It is hereby expressly agreed and declared that neither this


agreement not anything contain herein shall be deemed to care
any interest or estate as tenant or otherwise it being the express
intention of the parties that the relationship between the
apartment owner and the Caretaker shall always be landlord and
tenant.

7. Not withstanding anything to the contrary contained herein it


shall be lawful for the Apartment Owner in the event of any
breach by the Caretaker or any of the terms and conditions of
the said Agreement to remove the license is given and
permission hereby granted by giving to the Caretaker four
weeks prior notice in writing and notice is given, the license and
permission hereby granted shall stand revoked on the expiration
of the period of such notice , The right, hereby conferred on the
apartment owner to revolve the license and permission hereby
granted shall be without prejudice and in addition to the other
right of the Apartment owner.

8. In case the caretaker desires to handover the premises to the


apartment owner due to unavoidable circumstances before the
completion of terms it shall be lawful for the caretaker to give 4
weeks termination notice in writing to the apartment owner so
as enable the apartment owner to manage the said rent paid in
advance and back to the Caretaker.

IN WITNESS HEREBY the parties hereto executed this Agreement in the
manner hereafter appearing on the day and year hereinabove written.
