EMPLOYMENT CONTRACT
FOR PROBATIONARY
April 30, 2018

Engr. Arlene May P. Adaya


64 Brgy. Caysasay, Taal, Batangas

Dear Ms. Adaya,

We are pleased to inform you that you have been accepted for employment under a probationary
employment as Estimator subject to the following terms and conditions:

1. EMPLOYMENT STATUS – Your probationary employment shall be retained for a period of one (6)
months.

2. COMMENCEMENT – This contract for probationary employment will commence on May 2, 2018 and
will expire on November 2, 2018

3. JOB DESCRIPTION –

Job Title: ADMINISTRATIVE STAFF

Duties: You shall perform the duties and responsibilities your position or job necessary entails, as
contained in your job description or as reasonably assigned to you from time to time by your superior(s).
Initial copy is hereby attached.

4. SALARIES AND WAGES

4.1 – For your services, you shall receive a monthly salary Twenty Thousand Pesos (Php 20,000.00),
payable bi-monthly, every other Friday of the month, and subject to legal and lawful deductions such as but
not limited to withholding tax, SSS, Philhealth, Pag-ibig contributions, among others.

4.2 – You shall be provided by the Company, full benefits/privileges as provided by the law:

a. 13th Month Pay


b. SSS / Philhealth / Pag-Ibig

5. HOURS OF WORK

5.1 You are required to render a minimum of Eight (8) hours of work for six (6) working days, with
1 official rest day per week, as provided by the Company. However, schedule may vary depending
on operational needs.

5.2 You agree to take an unpaid lunch break (meal interval) of one (1) hour.

5.3 You are expected to strictly observe the official hours of work of the Company.
The appropriate deduction shall be made from your basic rate corresponding to the
number of minutes or hours you are late. Working longer hours on any particular day
will not offset tardiness.

6. OVERTIME WORK – In case the demand of the business or the Company requires you to work more than
your regular work schedule, you may be required to render overtime work. However, you must obtain prior
written authorization from the Managing Director or the President for any overtime work. Should you fail
to comply with this requirement, the Company will not consider any overtime work performed as
legitimate and compensable. Overtime will only be worked if agreed upon between the employee and
employer from time to time.

7. PERMITS – You are required to secure an NBI Clearance, photocopy of SSS ID or E1 form, Tax
Identification number, employment certificate from previous employer, transcript of records, and medical
clearance (Chest PA, HBsAg Screening, CBC, Routine Fecalysis & Certificate of Fit to Work); copies of
which you shall submit to the Personnel Office prior to start of your work.
8. DISCIPLINE – For the entire duration of this Contract, you shall observe and comply with all Company
Rules and Regulations, written or otherwise, existing or as may hereafter be promulgated. It shall be your
duty to study and know the rules immediately upon their promulgation and dissemination. You shall
observe proper decorum, hygiene and good grooming in addition to maintaining professional relationships
with the employees, clients and guests of the establishments.

9. LATERAL TRANSFER – When the other affiliated company requires additional assistance, you may be
transferred to that company or any of its departments with the same pay and benefits which you were
previously receiving which may exclude benefits or other allowances.

10. NON-DISCLOSURE – You acknowledge and confirm that this contract must remain confidential, except
as may be legally required by competent authority or applicable statutes, you shall not make any
unauthorized disclosures of the terms and conditions in this contract.

11. COMPANY RECORDS AND PROPERTY – In order to safeguard the Company’s interest and the
confidentiality of its business and affairs, you agree that during the term of your employment and from and
after the actual cessation of your employment, you shall maintain strict confidentiality and shall not
disclose any business, financial or commercial information, methods, processes or inventions (whether
covered by intellectual property protection or not). You shall not stake out of the company’s premises any
equipment, supplies or property. You agree that any willful breach of this obligation shall constitute an
immediate ground for termination of your employment.

12. RESIGNATION – Should you resign voluntarily, you must give written notice of your intention to resign
at least thirty (30) days prior to the effective date thereof unless earlier accepted by management.

13. TERMINATION – Upon the expiration of the probationary period, your employment may be elevated to
regular status depending on your fitness for regularization. The Company reserves the right to terminate or
cancel this Contract after observing you for one (1) month. Termination may be due to any, but not
necessarily limited to the following:
(a) Inefficiency;
(b) Incompetence;
(c) Tardiness;
(d) Insubordination;
(e) Pilferage and theft;
(f) Breach of confidentiality and non-disclosure;
(g) Violation of company’s intellectual property rights;
(h) Just and authorized causes enumerated in Article 282,283, and 284 of the Labor Code;
(i) Other causes provided in the Company’s Rules and Regulations; and
(j) Other analogous causes.

14. GENERAL – Company policy, rules, and regulations shall be complied with at all times, disciplinary
actions shall be implemented accordingly to any performance standard deviation and for offenses that may
be committed against the Company Manual.

If the foregoing terms are acceptable, please indicate your conformity by affixing your signature on the
space provided and return the signed copy to us.
