TRICYCLE (KULONG-KULONG) LOADED WITH
TWENTY EIGHT (28) PIECES OF COMMON
HARDWOOD LUMBERS AT BARANGAY
CATABAYUNGAN, CABAGAN, ISABELA ON MARCH

Respectfully forwarding to your Office are the original records of the subject
case, together with the draft Order, for approval. The dispositive portion provides:

“WHEREFORE, premises considered, judgment is hereby rendered:

1. Ordering the CONFISCATION of the two (2) units Motorized Tricyclewithout plate
number number together with its load consisting of twenty eight (28) pieces of common
hardwood lumbers with a total volume of 252 board feet on March 24, 2016 at Barangay
Catabayungan, Cabagan, Isabela;

2. Directing the CENR Officer of Cabagan to update the Regional Office thru the Legal
Division of the status of the criminal case filed in court;

3. Lastly, upon finality of the order of confiscation, the CENR Office concerned shall request
the custodian to physically turnover the seized conveyance and its load to the
Department of Environment and Natural Resources for its disposition in accordance
with law.

Please be informed that the above case was reviewed and evaluated by this
Office in accordance with DAO 97-32 and P.D. 705, as amended and other pertinent
forestry rules and regulations.

It is respectfully requested that the action taken by this Office be sustained.
