Employment Contract
Delphi Deutschland GmbH
(the ‚Company„)
And
With effect from January 1, 2017 and under condition that the works council and the management approve
the employee will take up the position of
The company reserves the right to assign the employee to different duties within the company that correspond
to the employee‟s professional training and experience without variation in remuneration.
§ 2 Remuneration
For his duties and responsibilities the employee will receive at month„s end a gross income of Euro 5.831,00€
for 40 working hours per week.
Extraordinary costs such as travel expenses, etc., will be reimbursed according to company rules.
The probation period is cancelled. Either party is entitled to a notice period of 6 weeks to the end of a quarter.
The seniority since January 31, 2005 will be accepted.
The company covers moving expenses with a lump sum of a monthly gross salary at the beginning of the
assignment.
The company will pay the rent for an interim flat or hotel for one month (maximum).
The company contracts a „Relocation Service‟ to support necessary communication with authorities. The cost
is covered by the company.
The employee has an annual vacation entitlement of 30 work days per calendar year. The individual vacation
requests of the employee will be considered within the requirements of the company.
§ 6 Mandatory training
The employee participates in company trainings, if they are mandatory for all employees and are held during
regular working hours.
The employee understands that communication of information and data, within Delphi, will be on a-need-to-
know basis. Further, he agrees to protect and not disclose to anyone, outside of Delphi, in any manner
whatsoever, either in whole or in part, except as required to conduct the business of Delphi, any and all
information and data of any nature, for any reason, relating to the products, processes, business, work,
design, methods, styling, inventions and facilities of Delphi or its customers, which he may in any way acquire
by reason of her employment. He agrees that this duty to not disclose information survives the termination of
her employment with Delphi or her transfer of employment to another division, subsidiary or joint venture of
Delphi.
§ 8 Effectiveness / Validity
The work contract is only effective if necessary legal documentation (e. g. work permit, visa) are available.
The contract is invalid if the work permit or visa status expires. In this case, the contract is terminated without
further notice. The employee is obliged to keep the company informed about any changes in respect to visa or
work permit status.
§ 9 Severability Clause
If any provision of the contract should be invalid or should the agreement contain any gaps this should not
affect the validity of the remaining part of this contract. In lieu of the invalid provision a provision should apply
which is equal or nearest in meaning and purpose to the invalid provision.
In case of gaps in the agreement, the provision shall be deemed to be which would have been agreed by the
contracting parties, in accordance with the purpose of the contract, if they would have considered this issue at
the conclusion of the contract.
§ 10 Other
For the employment general German Labor Law and general agreements between the company and the
Works Council („Betriebsvereinbarungen“) as well as the employee handbook (“Personalhandbuch”) and
company regulations (“Betriebsordnung”) of the Delphi Delco Electronics Europe GmbH. The Employment
Court in Wuppertal has jurisdiction for all disputes arising out of this Employment relationship.
Further terms and conditions have not been agreed upon and, to become effective, must be put in writing.
