MEMORANDUM OF AGREEMENT

Convergence on Livelihood Assistance for ARBs Project (CLAAP)


KNOW ALL PERSONS BY THESE PRESENTS:
This Memorandum of Agreement is entered into by and between:
The DEPARTMENT OF AGRARIAN REFORM, a government agency organized and existing
under the laws of the Philippines, implementer of the Convergence on Livelihood Assistance
for ARBs Project (CLAAP), with office address at DAR Building, Elliptical Road, Diliman,
Quezon City represented herein by Atty. Sheila B. Enciso , in his capacity as Regional
Director, herein referred to as the “DAR”;
-and-
Integrated Community Farmers Agrarian Reform Cooperative (ICFARC), a duly registered
organization with the Cooperative Development Authority (CDA) with business address at
Brgy. Alugan, San Policarpo, E. Samar, represented in this Agreement by Noly M. Caraga in
his capacity as Chairperson, hereinafter referred to as the “ARBO”.

WITNESSETH:
WHEREAS, Section 5 of Article XIII of the 1987 Constitution provides that the State shall
recognize that the right of farmers, farm workers, and landowners, as well as cooperatives
and other independent farmers’ organizations to participate in the planning, organization
and management of the agrarian reform program and shall provide support to agriculture
through appropriate technology and research and adequate financial, production,
marketing and other support services;
WHEREAS, Section 36 Chapter IX of RA 6657 as amended by Republic Act No. 9700, provides
that the DAR shall pursue integrated land acquisition and distribution with support services
to ensure that the farmer-beneficiaries are provided extension services by way of planting,
cropping, production and postharvest technology transfer, as well as marketing and
management assistance and support;
WHEREAS, the DAR is implementing the Convergence on Livelihood Assistance for ARBs
Project (CLAAP) to facilitate an increase in the income of Agrarian Reform Beneficiaries
(ARBs)through technical capacity development and the provision of seed capital assistance;
WHEREAS, selected ARBOs has agreed to participate in the implementation of the Project to
serve as conduit in the provision of CLAAP interventions to ARBO members that were
identified as eligible beneficiaries of the Project;
NOW THEREFORE, in consideration of the foregoing premises, DAR and the ARBO have
mutually agreed to engage in the implementation of CLAAP particularly in the provision of
skills training and provision of seed capital assistance for livelihood/microenterprise projects
to eligible1 CLAAP beneficiaries in accordance with the following terms and conditions,
THUS:
Sec.1. Obligations of the DAR
The DAR shall:
1. Provide technical capacity development in the maximum amount of
PhP10,000.00 per eligible CLAAP beneficiary,and seed capital assistance2 in the
maximum amount of PhP15,000.00 per eligible CLAAP beneficiary, that are
members of ARBOs duly recognized by the DAR.

2. Assist the ARBOs in the identification of training needs and


livelihood/microenterprise projects that may facilitate an increase in theincome
of eligible CLAAP beneficiaries.

3. Assist the ARBOs in the preparation of livelihood/microenterprise proposals to


enable eligible CLAAP beneficiaries to access technical capacity development and
seed capital interventions being provided under CLAAP.

4. Procure the components of the approved livelihood/microenterprise project and


facilitate its delivery to the selected site of the said project.

5. Monitor and evaluate periodically the operation/performance and management


of the livelihood/microenterprise projects by concerned ARBOs.
Sec. 2. Obligations of the ARBO CLAAP Cluster
The ARBO shall:
1. Serve as conduit between the DAR and eligible CLAAP beneficiaries in the
implementation of CLAAP interventions particularly technical capacity development
and provision of seed capital assistance for starting or sustaining
livelihood/microenterprise projects.

2. Pass and approve ARBO Board Resolution that will authorize the ARBO Chairperson
to enter into and represent the ARBO in this Agreement.

3. Pass and approve ARBO Board Resolution specifying, among others, (i) that the
project concept/idea came from the CLAAP beneficiaries themselves and that the
project will respond to interests and needs of said beneficiaries, and (ii) identify an
eligible CLAAP beneficiary as CLAAP focal person.

4. With the assistance from the Provincial Project Development Officer for CLAAP,
develop the livelihood/microenterprise project proposal and submit to the DAR
Provincial Office (DARPO) for onward submission to the DAR Regional Office
(DARRO) for evaluation and approval.

5. If possible and by virtue of an ARBO resolution, provide any of the following items as
counterpart for the livelihood/microenterprise project:
a. Land where the proposed livelihood/microenterprise shall be located;
b. Start-up capital for, including among others, agri-machinery, enterprise-
processing operations, etc.;
c. Labor costs related to the establishment of the
livelihood/microenterprise project;
d. Rent to be incurred in the use of, among others, facilities, machineries,
etc.

6. Ensure participation of officers/members in activities/trainings to be conducted (i.e.


CLAAP orientation and identification of training needs and
livelihood/microenterprise projects; skills training, etc.).

7. Provide secured storage facilitiesand other similar structures as may be appropriate


for the type of livelihood/microenterprise project being implemented.

8. Provide assistance to eligible CLAAP beneficiaries in the operations, maintenance


and management of approved livelihood/microenterprise projects.

Sec. 3. Prohibition

The ARBO shall not lease-out, encumber, transfer, sell or otherwise dispose of any part of
the approved livelihood/microenterprise project without the written consent of DAR or its
successor agency.
Sec. 4. Reporting
The CLAAP Project Development Officer, in coordination with the ARBO, shall prepare and
submit quarterly reports to the DARPO for onward submission to the DARRO, DARCO and
DSWD on the implementation of CLAAP interventions. The report shall contain the
following:
a. Type of skills training conducted
b. List of CLAAP beneficiaries that underwent the training (gender-disaggregated)
c. Financial Statement3 of the livelihood/microenterprise project
d. Volume of Production (if applicable)

In addition, a monthly Financial Statement shall be submitted by the ARBO-Beneficiary to
the DAR for Monitoring purposes.
Sec. 7. Audit
The ARBO CLAAP Cluster shall give DAR, its employees, agents and third party monitors
complete and unrestricted access to its financial and business records to facilitate the audit
of CLAAP implementation.
Sec. 8. Reservation
In the event of the ARBO CLAAP Cluster’s FAILURE to comply with any of its undertaking or
obligations under this Agreement, or in case of misuse of the components of the
livelihood/microenterprise project or misappropriation of funds derived from its operation,
the DAR shall rescind the in-kind support and the ARBO CLAAP Cluster shall reimburse the
DAR the acquisition cost of the Farm Machineries and equipment without prejudice to the
right of DAR to pursue appropriate criminal and / or civil actions against the ARBO-
Beneficiary and its officers. Such officers shall be deemed solidarily liable under this
Agreement.
Sec. 9. Effectivity
This contract shall be effective immediately upon signing of the parties.
Sec. 10. Modification and amendment.
No amendment or modification of this Agreement shall be valid or binding upon the parties
unless made in writing and mutually agreed by the parties hereto, which shall thereafter
form part of this Agreement.

capacity as Chairperson, hereinafter referred to as the “ARBO”.

WITNESSETH:
WHEREAS, Section 5 of Article XIII of the 1987 Constitution provides that the State shall
recognize that the right of farmers, farm workers, and landowners, as well as cooperatives
and other independent farmers’ organizations to participate in the planning, organization

19. Procure the components of the approved livelihood/microenterprise project and


facilitate its delivery to the selected site of the said project.

20. Monitor and evaluate periodically the operation/performance and management


of the livelihood/microenterprise projects by concerned ARBOs.
Sec. 2. Obligations of the ARBO CLAAP Cluster
The ARBO shall:
25. Serve as conduit between the DAR and eligible CLAAP beneficiaries in the
implementation of CLAAP interventions particularly technical capacity development
and provision of seed capital assistance for starting or sustaining
livelihood/microenterprise projects.

26. Pass and approve ARBO Board Resolution that will authorize the ARBO Chairperson
to enter into and represent the ARBO in this Agreement.

27. Pass and approve ARBO Board Resolution specifying, among others, (i) that the
project concept/idea came from the CLAAP beneficiaries themselves and that the
project will respond to interests and needs of said beneficiaries, and (ii) identify an
eligible CLAAP beneficiary as CLAAP focal person.

28. With the assistance from the Provincial Project Development Officer for CLAAP,
develop the livelihood/microenterprise project proposal and submit to the DAR
Provincial Office (DARPO) for onward submission to the DAR Regional Office
(DARRO) for evaluation and approval.

29. If possible and by virtue of an ARBO resolution, provide any of the following items as
counterpart for the livelihood/microenterprise project:
m. Land where the proposed livelihood/microenterprise shall be located;
n. Start-up capital for, including among others, agri-machinery, enterprise-
processing operations, etc.;
o. Labor costs related to the establishment of the
livelihood/microenterprise project;
p. Rent to be incurred in the use of, among others, facilities, machineries,
etc.

30. Ensure participation of officers/members in activities/trainings to be conducted (i.e.


CLAAP orientation and identification of training needs and
livelihood/microenterprise projects; skills training, etc.).

31. Provide secured storage facilitiesand other similar structures as may be appropriate
for the type of livelihood/microenterprise project being implemented.

32. Provide assistance to eligible CLAAP beneficiaries in the operations, maintenance


and management of approved livelihood/microenterprise projects.

Sec. 3. Prohibition

The ARBO shall not lease-out, encumber, transfer, sell or otherwise dispose of any part of
the approved livelihood/microenterprise project without the written consent of DAR or its
successor agency.
Sec. 4. Reporting
The CLAAP Project Development Officer, in coordination with the ARBO, shall prepare and
submit quarterly reports to the DARPO for onward submission to the DARRO, DARCO and
DSWD on the implementation of CLAAP interventions. The report shall contain the
following:
m. Type of skills training conducted
n. List of CLAAP beneficiaries that underwent the training (gender-disaggregated)
o. Financial Statement12 of the livelihood/microenterprise project
p. Volume of Production (if applicable)

In addition, a monthly Financial Statement shall be submitted by the ARBO-Beneficiary to
the DAR for Monitoring purposes.
Sec. 7. Audit
The ARBO CLAAP Cluster shall give DAR, its employees, agents and third party monitors
complete and unrestricted access to its financial and business records to facilitate the audit
of CLAAP implementation.
Sec. 8. Reservation
In the event of the ARBO CLAAP Cluster’s FAILURE to comply with any of its undertaking or
obligations under this Agreement, or in case of misuse of the components of the
livelihood/microenterprise project or misappropriation of funds derived from its operation,
the DAR shall rescind the in-kind support and the ARBO CLAAP Cluster shall reimburse the
DAR the acquisition cost of the Farm Machineries and equipment without prejudice to the
right of DAR to pursue appropriate criminal and / or civil actions against the ARBO-
Beneficiary and its officers. Such officers shall be deemed solidarily liable under this
Agreement.
Sec. 9. Effectivity
This contract shall be effective immediately upon signing of the parties.
Sec. 10. Modification and amendment.
No amendment or modification of this Agreement shall be valid or binding upon the parties
unless made in writing and mutually agreed by the parties hereto, which shall thereafter
form part of this Agreement.

This Memorandum of Agreement is entered into by and between:
The DEPARTMENT OF AGRARIAN REFORM, a government agency organized and existing
under the laws of the Philippines, implementer of the Convergence on Livelihood Assistance
for ARBs Project (CLAAP), with office address at DAR Building, Elliptical Road, Diliman,
Quezon City represented herein by Atty. Sheila B. Enciso , in his capacity as Regional
Director, herein referred to as the “DAR”;
-and-
Siha ARB Association (SIARBA), a duly registered organization with the Department of
Labor and Employment (DOLE) with business address at Brgy. Siha, Borongan City, Eastern
Samar, represented in this Agreement by Josefina B. Aquino in his capacity as Chairperson,
hereinafter referred to as the “ARBO”.

WITNESSETH:
WHEREAS, Section 5 of Article XIII of the 1987 Constitution provides that the State shall
recognize that the right of farmers, farm workers, and landowners, as well as cooperatives
and other independent farmers’ organizations to participate in the planning, organization
and management of the agrarian reform program and shall provide support to agriculture
through appropriate technology and research and adequate financial, production,
marketing and other support services;
WHEREAS, Section 36 Chapter IX of RA 6657 as amended by Republic Act No. 9700, provides
that the DAR shall pursue integrated land acquisition and distribution with support services
to ensure that the farmer-beneficiaries are provided extension services by way of planting,
cropping, production and postharvest technology transfer, as well as marketing and
management assistance and support;
WHEREAS, the DAR is implementing the Convergence on Livelihood Assistance for ARBs
Project (CLAAP) to facilitate an increase in the income of Agrarian Reform Beneficiaries
(ARBs)through technical capacity development and the provision of seed capital assistance;
WHEREAS, selected ARBOs has agreed to participate in the implementation of the Project to
serve as conduit in the provision of CLAAP interventions to ARBO members that were
identified as eligible beneficiaries of the Project;
NOW THEREFORE, in consideration of the foregoing premises, DAR and the ARBO have
mutually agreed to engage in the implementation of CLAAP particularly in the provision of
skills training and provision of seed capital assistance for livelihood/microenterprise projects
to eligible13 CLAAP beneficiaries in accordance with the following terms and conditions,
THUS:
Sec.1. Obligations of the DAR
The DAR shall:
21. Provide technical capacity development in the maximum amount of
PhP10,000.00 per eligible CLAAP beneficiary, and seed capital assistance14 in the
maximum amount of PhP15,000.00 per eligible CLAAP beneficiary, that are
members of ARBOs duly recognized by the DAR.

22. Assist the ARBOs in the identification of training needs and


livelihood/microenterprise projects that may facilitate an increase in the income
of eligible CLAAP beneficiaries.

23. Assist the ARBOs in the preparation of livelihood/microenterprise proposals to


enable eligible CLAAP beneficiaries to access technical capacity development and
seed capital interventions being provided under CLAAP.

24. Procure the components of the approved livelihood/microenterprise project and


facilitate its delivery to the selected site of the said project.

25. Monitor and evaluate periodically the operation/performance and management
