17 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

19 SECTION 1. Arkansas Code 19-5-205(e)(1)(B)(i) concerning special
20 revenues for the State Central Services Fund, is amended to read as follows:
21 (i) Those special revenues as specified in § 19-6-301(9), (11), (19), (21),
22 (37), (75), (76), (77), (78), (79), (82), (83), (84), (85), (86), (87), (88),
23 (89), (91), (96), (116), (118), (120), (124), (149), (188), and (231), (243)
24 and eight percent (8%) of those special revenues as set out in § 19-6-301(20)
25 of the Revenue Classification Law, § 19-6-101 et seq.;

27 SECTION 2. Arkansas Code §19-5-307(b)(1) concerning sources of special
28 revenues for the Public Health Fund, is amended to read as follows:
29 (b) The Public Health Fund shall consist of:
30 (1) Those special revenues as set out in § 19-6-301(41), (65), (68),
31 (69), (80), (97), (131), (132), (133), (136), (137), (140), (141), (142),
32 (143), (144), (147), (155), (166), (177), (194), (204), and (205), and that
33 portion of § 19-6-301(58) of the Revenue Classification Law, § 19-6-101 et
34 seq.;

36 SECTION 3. Arkansas Code §19-5-403 is hereby repealed.

1 19-5-403. Allocations for fiscal year 2008-2009 and thereafter.


2 Commencing with the fiscal year beginning July 1, 2008, and each fiscal year
3 thereafter, the Treasurer of State shall transfer all remaining general
4 revenues available for distribution on the last day of business in July 2008,
5 and on the last day of business in each calendar month thereafter during the
6 fiscal year to the various funds and fund accounts participating in general
7 revenues in the proportions of the maximum allocation as the individual
8 allocation to the fund or fund account bears to the total of the maximum
9 allocation as provided in § 19-5-404(a), (a-1), and (b).

11 SECTION 4. Arkansas Code §19-5-404 is hereby repealed.
12 19-5-404. Maximum allocations of revenues for fiscal year 2008 - 2009 and
13 thereafter.
14 (a) The Treasurer of State shall first make monthly allocations in the
15 proportions set out in this subsection to the funds and fund accounts listed
16 below until there has been transferred a total of four billion one hundred
17 seventy million three hundred one thousand two hundred eighty-seven dollars
18 ($4,170,301,287) or so much thereof as may become available; provided, that
19 the Treasurer of State shall make such monthly allocations in accordance with
20 each fund or fund account's proportionate part of the total of all such
21 allocations set forth in this subsection:

9 in this subsection:

2 SECTION 5. Arkansas Code §19-5-405, concerning the authority of
3 Treasurer of State, is amended to read as follows:
4 19-5-405. Authority of Treasurer of State.
5 The Treasurer of State, in calculating the proportionate share of the maximum
6 allocation to determine the monthly distribution of net general revenues
7 available for distribution for each fund or fund account, as authorized in §§
8 19-5-401 — 19-5-406 Title 19, Chapter 5, Subchapter 4, shall compute the
9 calculation of five (5) digits to the right of the decimal point, “rounded
10 off”. In the event the Treasurer of State shall determine that there are
11 errors in any of the totals of the respective funds or fund accounts for
12 which distributions are authorized in §§ 19-5-401 — 19-5-406 Title 19,
13 Chapter 5, Subchapter 4, the maximum allocation authorized for each fund and
14 fund account within each subsection shall govern with respect to the
15 allocation to be made to those funds and fund accounts. The Treasurer of
16 State is authorized to correct errors in totals thereof, as reflected in this
17 subchapter, prior to computing the calculations of the proportionate share of
18 the maximum allocations to be determined in making monthly distributions of
19 net general revenues available for distribution for each fund or fund
20 account, as authorized within the respective priorities set forth in §§ 19-5-
21 401 — 19-5-406 Title 19, Chapter 5, Subchapter 4.

23 SECTION 6. Arkansas Code §19-5-406, concerning transfer of remaining
24 revenues, is amended to read as follows:
25 19-5-406. Transfer of remaining revenues.
26 After making the maximum annual allocation, as provided in §§ 19-5-402 and
27 19-5-404, all remaining general revenues available for distribution during
28 each fiscal year shall be transferred on the last day of business in each
29 calendar month to the General Revenue Allotment Reserve Fund, there to be
30 used for the respective purposes as provided by law.

32 SECTION 7. Arkansas Code § 19-5-941 is hereby repealed.
33 19-5-941. Arkansas Science and Technology Authority Endowment Fund.
34 (a) There is established on the books of the Treasurer of State, the Auditor
35 of State, and the Chief Fiscal Officer of the State a fund to be known as the
36 Arkansas Science and Technology Authority Endowment Fund.

1 (b) This fund shall consist of any state appropriations specifically so


2 designated, unrestricted appropriations, gifts, grants, and donations.
3 (c) Only the income from this fund may be used to support the activities of
4 the Arkansas Science and Technology Authority.

6 SECTION 8. Arkansas Code § 19-5-998(a)(2) is amended to read as
7 follows:
8 (2) The fund shall be used by the Arkansas Agriculture Department -
9 State Plant Board of Environmental Quality to defray the costs of developing
10 and implementing a plan for the disposal of abandoned agricultural pesticides
11 and plant regulators.

13 SECTION 9. Arkansas Code § 19-5-1085(b) concerning sources of revenue
14 for the Judicial Fine Collection Enhancement Fund, is amended to read as
15 follows:
16 (b) This fund shall consist of the time-payment fees established by § 16-13-
17 704, electronic payment access fees established by § 16-92-118, court
18 technology fees established by § 21-6-416, federal court certified question
19 fees and fees for Court of Appeals or Supreme Court decision petitions for
20 rehearing established by § 21-6-401(a)(2) and (a)(3) respectively, and fees
21 for electronic filing and public online access to court decisions and other
22 court records established by § 21-6-401(d), there to be used by the
23 Administrative Office of the Courts for the purchase of computer hardware and
24 software as set out in § 16-13-712.

26 SECTION 10. Arkansas Code § 19-5-1203 is hereby repealed.
27 19-5-1203. Motorcoach Carrier Incentive Program Fund.
28 (a) There is established on the books of the Treasurer of State, the Auditor
29 of State, and the Chief Fiscal Officer of the State a fund to be known as the
30 Motorcoach Carrier Incentive Program Fund.
31 (b) (1) This fund shall consist of those funds provided by law.
32 (2) The fund shall be used for making incentive payments to eligible
33 applicants as administered by the Director of the Department of Parks and
34 Tourism, as set out in the Motorcoach Incentive Act of 1999, § 23-13-501 et
35 seq.

1 SECTION 11. Arkansas Code Title 19, Chapter 5, Subchapter 12 is amended


2 to add an additional section to read as follows:
3 19-5-1242. Fire Protection Licensing Fund.
4 (a) There is created on the books of the Treasurer of State, the Auditor of
5 State, and the Chief Fiscal Officer of the State a miscellaneous fund to be
6 known as the "Fire Protection Licensing Fund".
7 (b)(1) The fund shall consist of:
8 (A) All funds provided by law for the fund; and
9 (B) Examination and renewal fees charged pursuant to § 20-22-610.
10 (c) The fund shall be used for the maintenance, operation, and improvement as
11 required by the Fire Protection Licensing Board in carrying out the powers,
12 functions, and duties as set out in § 20-22-601 et seq.

14 SECTION 12. Arkansas Code 19-5-401 is amended to read as follows:
15 19-5-401. Allocations for fiscal year 2010-2011 and thereafter.
16 Commencing with the fiscal year beginning July 1, 2010, and each fiscal year
17 thereafter, the Treasurer of State shall transfer all remaining general
18 revenues available for distribution on the last day of business in July 2010,
19 and on the last day of business in each calendar month thereafter during the
20 fiscal year to the various funds and fund accounts participating in general
21 revenues in the proportions of the maximum allocation as the individual
22 allocation to the fund or fund account bears to the total of the maximum
23 allocation as provided in § 19-5-402 (a) and (b).

25 SECTION 13. Arkansas Code 19-5-402 is amended to read as follows:
26 19-5-402. Maximum allocations of revenues for fiscal year 2010-2011 and
27 thereafter.
28 (a) The Treasurer of State shall first make monthly allocations in the
29 proportions set out in this subsection to the funds and fund accounts listed
30 below until there has been transferred a total of four billion four hundred
31 forty-four million three hundred eighty-six thousand eight hundred eighty-six
32 dollars ($4,444,386,886) or so much thereof as may become available;
33 provided, that the Treasurer of State shall make such monthly allocations in
34 accordance with each fund or fund account's proportionate part of the total
35 of all such allocations set forth in this subsection:

31 SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. UNCLAIMED PROPERTY PROCEEDS
32 TRUST FUND TRANSFER. On the effective date of this Act and notwithstanding
33 the provisions of A.C.A. § 18-28-213 (c)(2) regarding the transfer of funds
34 from the Unclaimed Property Proceeds Trust Fund to the general revenues of
35 the state, the Auditor of State shall transfer on his books and those of the
36 State Treasurer and the Chief Fiscal Officer of the State, the sum of twenty-

1 one million dollars ($21,000,000) from the Unclaimed Property Proceeds Trust
2 Fund to the Educational Adequacy Fund established in A.C.A. §19-5-1227.

4 SECTION 15. NOT TO BE INCORPORATED INTO THE ARKANSAS CODE NOR PUBLISHED
5 SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. BUDGET STABILIZATION TRUST
6 FUND TRANSFER. After June 1 of fiscal year 2010, if the Chief Fiscal Officer
7 of the State determines that individual income tax refunds or corporate
8 income tax refunds will exceed the amount for refunds in the official
9 forecast for the 2010 fiscal year, and the amount over forecast will decrease
10 general revenue necessary to provide essential government services, he will
11 certify that amount to the Governor. During the fiscal year 2010, as directed
12 by the Governor, upon review by the Arkansas Legislative Council, the Chief
13 Fiscal Officer of the State may transfer, up to a total of twenty-five
14 million dollars ($25,000,000) for the 2010 fiscal year, from the Budget
15 Stabilization Trust Fund established in A.C.A. §19-5-501 to the General
16 Revenue Fund Account established in A.C.A. §19-5-202 to prevent general
17 revenue reductions that would result from income tax refunds as certified
18 pursuant to this section.
19 In no event shall the Chief Fiscal Officer of the State utilize funds
20 provided in this Section to supplement those fund or fund accounts allocated
21 in the Revenue Stabilization Law that would result in exceeding the January
22 11, 2010 Official Forecast.

24 SECTION 16. NOT TO BE INCORPORATED INTO THE ARKANSAS CODE NOR PUBLISHED
25 SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. YEAR-END FUND BALANCE
26 TRANSFERS. Notwithstanding any other provision of law to the contrary
27 pertaining to the transfer of year-end fund balances, the year-end fund
28 balances remaining on June 30, 2010 to be credited to the General Revenue
29 Allotment Reserve Fund by August 15, 2010, shall instead be transferred as
30 follows:
31 (a) First, in the event the 87th General Assembly meeting in Fiscal
32 Session enacts legislation authorizing the transfer of monies from the funds
33 set aside in the Legislative Division of the 87th Session Projects Account of
34 the General Improvement Fund for distribution during the fiscal year ending
35 June 30, 2011, an amount up to the actual amount authorized for transfer from
36 the Legislative Division, or so much thereof as is available shall be

1 transferred from the year-end fund balances to the Legislative Division of


2 the 87th Session Projects Account of the General Improvement Fund for
3 allocation to the various Legislative Division projects;
4 (b) Second, in the event the 87th General Assembly meeting in Fiscal
5 Session enacts legislation authorizing the transfer of monies from the
6 Executive Division of the 87th Session Projects Account of the General
7 Improvement Fund, an amount up to the actual amount authorized for transfer,
8 or so much thereof as is available shall be transferred from the year-end
9 fund balances to the Executive Division of the 87th Session Projects Account
10 of the General Improvement Fund and made available for allocation to the
11 various Executive Division projects at the discretion of the Governor;
12 (c) The Chief Fiscal Officer of the State shall initiate the transfers
13 authorized from the available year-end fund balances to the Legislative
14 Division and the Executive Division as authorized in (a) and (b) herein on
15 August 15, 2010 or as soon thereafter as is practical; and
16 (d) The remainder of any year-end fund balances on June 30, 2010 to be
17 credited to the General Revenue Allotment Reserve Fund by August 15, 2010, or
18 thereafter after fully funding the provisions of subsections (a) and (b) of
19 this section shall then be credited to the General Revenue Allotment Reserve
20 Fund.

22 SECTION 17. EMERGENCY CLAUSE. It is hereby found and determined by the
23 General Assembly of the State of Arkansas that changes in the state's fiscal
24 laws must take effect at the beginning of the fiscal year, that the
25 effectiveness of this act on July 1, 2010, with the exception that Section 15
26 in this Act shall be in full force and effect from and after the date of its
27 passage and approval, is essential to the operation of the agencies for which
28 allocations in this act are provided, and the delay in the effective date of
29 this act beyond July 1, 2010, with the exception that Section 15 in this Act
30 shall be in full force and effect from and after the date of its passage and
31 approval, could work irreparable harm upon the proper administration and
32 provision of essential government programs. Therefore, an emergency is
33 declared to exist and this act being necessary for the preservation of the
34 public peace, health, and safety shall become effective on July 1, 2010, with
35 the exception that Section 15 in this Act shall be in full force and effect
36 from and after the date of its passage and approval.
