Education Article in Nevada Constitution

There are two articles in the Nevada constitution that have any reference to education. Commented [eL1]:

The 11th article is devoted to education. There are ten different sections in article 11. The 15th

article is on the teachers or professor oath.

Art. 11 Section 1

Section 1 of article 11 is title Legislature to encourage education; appointment, term and

duties of superintendent of public instruction. This section promotes education. It promotes

intellectual, literary, scientific, mining, mechanical, agricultural, and moral improvements to all

the population of Nevada. This section is discussing the role and duties of a superintendent of

public instruction. A superintendent of public instruction overseas education system in Nevada.

Art. 11 Section 2

The terms of school establishment and maintained are written in section 2 of article 11.

Maintained of the school in each school district should be done every six months of a year.

School that practice sectarian will not get any of the funds that the states provides for schools.

Public school may pass a law to insure the attendance of the students in public schools. All

public schools in Nevada should be the same and provide equal education to all.

Art.11 Section 3

This section discusses where the funding for educational purpose comes from. Such as all

penal law fines are to be designated for educational purpose. The money designated for

educational purpose may not be given to any other uses of the fund. The money goes to the

public school’s grades K to 12th. A portion of the interest of the fund may be given to the

university.

Art.11 Section 4 and Section 7

The board of regents will be in control of the state university. The state university will

embrace department for Agriculture, Mechanic Arts, and Mining. The duties of the board of

regents will be given to them by the law . There are different districts and counties a regent can

oversee. Each states board of regents have different powers and duties.(Current Regents) Section

7 discuss how the board of regents are elected and how their duties are determined.

Article 11 Section 5 and Article 15 Section 2

Article 11 section 5 is the power to establish school primary to university. It also states

that all teachers and professors must take and subscribe to the oath prescribe in article 15 of this

constitution. “ I, ................, do solemly [solemnly] swear (or affirm) that I will support,

protect and defend the constitution and government of the United States, and the constitution and

government of the State of Nevada, against all enemies, whether domestic or foreign, and that I

will bear true faith, allegiance and loyalty to the same, any ordinance, resolution or law of any

state notwithstanding, and that I will well and faithfully perform all the duties of the office

of ................, on which I am about to enter; (if an oath) so help me God; (if an affirmation) under

the pains and penalties of perjury” as said in Article 15 section of the Nevada constitution is the

oath teacher and professor must take. If any teacher or professor fail to comply with these laws

will not be able to get any portion that other teachers or professor receives from the state.

Article 11 Section 6

The support university and common schools get from legislative appropriation. The

legislative will provide support and maintenance from general fund until a budget is required by

law. To decide how much money is need for the next ensuing biennium a special session is held.

Biennium means period of two fiscal year. If for any reason it violates subsections 2, 3, or 4 the

money is to be voided.

Article 11 Section 9 and 10

These two section talks about how the education system be held up to and ran. Section 9

prohibits any school or university to instruct by sectarian. No fund shall be used for sectarian

purposes as stated in section 10. These sections want to ensure an equal education for all students

in Nevada. They will have no part of any sectarian practices.

Circuit Court of Appeal

All states are separated into different circuit courts. The regions of the circuit court are

deciding by the location of the states and what borders they fall into. There are 13 different

circuit court of appeal in the federal court system. Nevada is in the 9th circuit court. There are 9

other states in the 9th circuit court of appeals. (Underwood & Webb, 2006).
