The Construction Industry Payment and Adjudication Act 2012 (CIPAA 2012) has taken the industry by storm. Recent
statistics produced by AIAC show that there have been over 1,500 adjudication cases and 450 court cases concerning
adjudication as at 15 April 2018 and 28 February 2018 respectively. This trend will continue as parties in the industry
are making use of the adjudication process provided under CIPAA 2012 to resolve their payment disputes
expeditiously and inexpensively.

In this seminar, we focus on the basics and mechanics of construction claims and defences, and the adjudication
process under CIPAA 2012 particularly on how to prepare effective adjudication claims, responses and replies in terms
of practice and law.

Sr Dr MUHAMMAD EHSAN CHE MUNAAIM

Sr Dr Muhammad Ehsan Che Munaaim is a Senior Consultant with HKA Global, the world’s
largest construction consulting, expert and advisory firm with 40 offices worldwide including Dubai,
where he is currently based. He has over 13 years of experience in contract management and
administration, claim management, claims preparation and defense, dispute resolution and
commercial management. At HKA, Ehsan has managed construction contracts worth US$4 billion
across various sectors including residential, commercial (including high rise buildings), education,
oil and gas, power generation and railway in the Middle East, Asia and Africa including
Afghanistan, India, Iraq, Kingdom of Saudi Arabia, Malaysia, Qatar, Tanzania. Ehsan has taught
over 1500 undergraduate and postgraduate students at four universities in the UK, UAE and
Malaysia as a teaching fellow, lecturer and assistant Professor including University College
London. Currently, he is (part time) Lecturer in Commercial Management and Quantity Surveying
at Heriot Watt University Dubai Campus. He is on the Advisory Panel of the Adjudication
Research + Reporting Unit at the University of New South Wales, Australia as well as a panel
adjudicator with Kuala Lumpur Regional Centre for Arbitration.
