REPUBLIC OF THE PHILIPPINES SUPREME COURT Baguio City SECOND DIVISION NOTICE

Please take notice that the Court, Second Division, issued a Resolution dated 8 April 2019 which reads as
follows: G.R. No. 230128 (People ofthe Philippines v. Jomer Sr. Abalio y Bugnot) After a careful review of
the records of the case, the Court finds the appeal to be lacking in merit. Both the Regional Trial Court of
Caloocan City, Branch 131 and the Court of Appeals found appellant Jomer Sr. Abafio y Bugnot guilty
beyond reasonable doubt of rape and sentenced him to suffer the penalty of reclusion perpetua. In line
with recent jurisprudence, 1 we increase the award of civil indemnity, moral damages, and exemplary
damages to P75,000, respectively. We sustain the imposition of interest at the rate of six percent ( 6%)
per annum on all damages awarded from the date of finality of this Resolution until fully paid.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the attached Decision
dated 20 July 2016 of the Court of Appeals in CA-G.R. CR-HC No. 07058, finding appellant Jomer Sr . .
Abafio y Bugnot guilty beyond reasonable doubt of rape under Article 266- A, par. 1, in relation to Article
266-B, par. 1, of the Revised Penal Code, as amended by Republic Act No. 8353, in Criminal Case No. C-
80771 and AFFIRMS said Decision with the following MODIFICATIONS: (1) the amount of civil indemnity
is increased from P50,000 to P75,000; (2) the amount of moral damages is increased from
1250,000to1275,000; and (3) the amount of exemplary damages is increased from 1230,000 to
1275,000. Interest at the rate of six percent ( 6%) per annum is imposed on all damages awarded from
the date of finality of this Resolution until fully paid. SO ORDERED. (Perlas-Bernabe, J., on leave)
