VESSEL AUCTION PROCEDURES

PROVISIONS

1. Bidders only will register by signing the “ATTENDANCE SHEET”.

2. Bidders will be assigned a number and given a “BIDDER’S NUMBER CARD” with the assigned number.

3. During the bidding process, a bid will be recognized by the auctioneer and the bid recorded, only by the
Bidder raising his/her hand, showing the “BIDDER’S NUMBER CARD”.

4. The successful Bidder of a vessel will receive from the Auction Recorder a “BILL OF SALE” with details
of the vessel purchased and the transaction, completed and signed, by the successful Bidder except for the
Division’s authorized signature.

5. The “BILL OF SALE” shall be authorized at the time of settlement in full. A successful bidder that pays
at the time of auction will be issued a receipt and “BILL OF SALE” from the cashier from the Oahu
District office upon satisfactory payment in full. Settlement in full must be paid by cash, VISA,
Mastercard or certified check.

6. The successful Bidder will return to the Auction Recorder and present the receipt and “BILL OF SALE”
signed by an authorized Division signatory.

7. The successful Bidder that desires to register the vessel with the State of Hawaii will have to present the
bill of sale to the Vessel Registration office located at 4 Sand Island Access Road, Honolulu, Hawaii
96819. Please note that the vessel registration is required for those successful Bidders desiring a mooring
permit for their newly purchased vessel for mooring in a State harbor or offshore mooring area.

8. Successful bidders that do not pay in full at the time they are announced as the successful bidder shall
immediately remit a non-refundable deposit in an amount no less than ten percent of the full amount due
in cash, VISA, Mastercard, or certified check. The successful bidder shall have until 4:00 p.m. on the day
of the auction to pay the full balance due at the Oahu District office or forfeit the deposit in its entirety

9. If a successful Bidder does not make payment by cash, VISA, Mastercard or certified check in full by
4:00 p.m. on June 28, 2019 at the Oahu District office, the Division shall retain the non-refundable
deposit and may then contact the next lowest Bidder.

VESSEL AUCTION PROCEDURES

If a person wishes to inspect a vessel prior to the auction, they will need to contact the harbor where
the vessel is located and make an appointment. The person inspecting the vessel will have to sign a
Release of Liability Waiver prior to inspecting the vessel and a harbor agent will be present at the time
of inspection. Access to all vessels that are located offshore may be limited.

All of the vessels are not being auctioned with a trailer.

These vessels are being sold “AS IS, WHERE IS”. There are no guarantees or warranties. No vessel will be
sold for less than the upset price listed in the Auction Catalog. The sale of a vessel does not include a berth or
storage area. Buyers must make separate arrangements for a berth.

Under “PROVISION” in the Auction Catalog where stated that “removal of the vessel within 3 days of sale”
means that the vessel will have to be moved from the present site to an offshore location, private property or
a site permitted by the Division within the stated number of days.

We are not responsible for any purchased vessels once a bill of sale has been issued to the successful bidder.

Relocation of the purchased vessels to another area within any State Harbor facility without a permit, except
private facilities, shall subject the vessel to enforcement action. Authorization is required from any private
facility prior to relocating a vessel onto private property.

No dry land storage or work area permits will be issued for any vessels. Failure to remove the vessel within
the specified time period, as stated in the auction catalog, shall result in enforcement action that may include
the issuance of citation (s), fine (s), or impoundment of the vessel.

Remarks: Over-all condition is fair. This is a Japanese Marine Debris panga that was found on the shoreline on the Windward side
of Oahu. There is a small hole in the bow of the vessel as seen in the photo. This vessel does not come with a trailer.
