Contingency Plans

 If my models have to cancel the time that I have designated to start shooting, I will
have back up models to contact just in case and back-up dates that I can book out
the camera.
 If the camera has a low battery or malfunctioning in any way, I will make sure that I
will check the camera equipment before I take them to the shoot and ask for a
replacement camera if I need to.
 If for any reason I cannot film in the locations that I have chosen to shoot in or at, I
will make sure that I have back-up locations where I can shoot.

Relevant legal and ethical issues

Copyright, Designs and Patents Act 1988
The law gives the creators of literary, dramatic, musical, artistic works, sound recordings,
broadcasts, films and typographical arrangement of published editions, rights to control the
ways in which their material may be used.
The rights cover: broadcast and public performance, copying, adapting, issuing, renting and
lending copies to the public. This is a Civil law not a Criminal law which means it is not a
criminal offence to break the law, which could result in a fine or jail sentence.
Instead, the person who owns the copyright has to sue the person they believe has broken
the law. The case is then heard in a civil court and if the person is found guilty of breaking
copyright law then they will have to pay damages to the owner of the copyright. The amount
of damages is set by the court.
This applies to a magazine cover production in general as the people who create front
covers need to avoid breaking this law because it is a civil law and under the circumstances
of it being broken people may sue and it would be taken to court. Producers will make sure
that all of their ideas are original.
Equality Act 2010
This law legally protects people from discrimination in the workplace and in wider society.
It is against the law to discriminate against anyone because of:

 Age
 Being or becoming a transsexual person
 Being married or in a civil partnership
 Being pregnant or on maternity leave
 Disability
 Race including colour, nationality, ethnic or national origin
 Religion/belief or lack of religion/belief
 Sex
 Sexual orientation
This is a Criminal law which means that anyone who is considered to be breaking the law
could be arrested. It would result in a criminal trial which if found guilty could result in a fine
or jail sentence.
This applies to magazine front covers because producers need to make sure that they aren’t
discriminating anybody as it is a criminal law so if they do discriminate against anybody in
their images they may be arrested or sent to jail. I will also need to make sure that there isn’t
any negative representation of anybody. I will avoid breaking this law by including people in
my images who won’t discriminate against anybody and if they do they will be edited out or
just not used.
Intellectual property:
This act means to have the right type of intellectual property protection helps you to stop
people stealing or copying:

 The names of your products or brands

 Your inventions
 The design or look of your products
 Things you write, make or produce.

Copyright, patents, designs and trademarks are all types of intellectual property protection.
You get some types of protection automatically, others you have to apply for.

 You own intellectual property if you:

 Created it (and it meets the requirements for copyright, a patent or a design
 Bought intellectual property rights from the creator or a previous owner
 Have a brand that could be a trade mark e.g. a well-known product name.
If you believe anyone has stolen or copied your property you would sue them in civil court.
Types of protection:
The type of protection you can get depends on what you’ve created. You get some types of
protection automatically, others you have to apply for.
Automatic protection:

Protection you have to apply for:

This applies to my work as I am the creator of this magazine front cover so I will have
automatic protection through having copyright over my magazines image and title. I would
also have to make sure that we do not violate trademarks as we would make sure that no
product names or logos are clearly seen in my main image.
Ethical Constraints
Rather than legal constraints, ethical issues are based on judgement. They are what society
considers as morally acceptable. If something is seen as ethically wrong as it is first
investigated to see if it is breaking any laws. However, if it is not in violation of any of these
laws then it comes under ethical issues. This means that no law has been broken, however
the public may see it as offensive or controversial. Many ethical concerns are raised by
groups of specific people. These groups may find the publication offensive, due to how the
minority are represented.
Representation and Stereotypes:
My magazine front cover must attempt to be inclusive of everyone, regardless of gender,
religious beliefs, sexual orientation, race etc. I also must ensure that we do not generalise
any particular group, race or stereotype. This is due to the fact it can influence peoples
thoughts and feelings towards certain groups of people, which is not what the majority of
media productions are trying to encourage. This includes not giving any across any sorts of
stereotypes, whether it’s racially related or not. Also we must not include any factors or
discrimination that gives across the wrong idea about a particular group of people.
Content: Themes, visuals, audio
I will make sure that anything that could cause offence or harm to a reader is removed from
the final edit and that we do not make a product which offends or insults a reader with any of
its content.
