On March 11, 2019, the Board Ethics Committee initiated an inquiry regarding whether Chair Jack
Evans violated the Board Code of Ethics. The Ethics Committee retained outside counsel to
conduct an independent confidential investigation. The Ethics Committee received a briefing from
the outside counsel. Mr. Evans and his counsel made a presentation to the Ethics Committee.
Effective today, pursuant to the Code of Ethics Article XIII.C.1, the Ethics Committee closed the
proceedings because the matter has been resolved.

The Ethics Committee found that Mr. Evans violated Code of Ethics Article II.D by failing to
disclose a conflict of interest. Mr. Evans has agreed to amend his annual disclosure forms from
2016 to the present to list the consulting client relevant to the conflict of interest. Mr. Evans has
also agreed that he will not seek re-election as Chair of the WMATA Board.
