Tenancy Guide

For the letting of


32 Old Saw Mill Place, Amersham, Buckinghamshire, HP6 6FJ

Tenancy
The rental agreement offered is for 12 Months (subject to contract) and is known as an Assured Shorthold Tenancy if
the rent is £100,000.00 per annum or less. For rents over £100,000.00 per annum a “High Rent” (non-AST) tenancy
agreement will be used. For Company Tenants we will use a Company Tenancy Agreement (non-AST).

Reference
Prior to the tenancy being offered, credit, employer, previous landlord and bank references may be obtained in respect
of all tenants by professional referencing agencies acting on our behalf. Any offer of a Tenancy is strictly subject to
satisfactory references being passed.

Proof of Identity
You MUST supply us with one form of Photo Identification (ideally a Passport; where a passport is not available please
consult with us over an acceptable alternative). If you are a foreign national, we will require proof of residency, e.g. a
residence permit or visa. To comply with Government legislation, we must check the I.D. in the presence of the holder;
this may mean you are required to visit our offices prior to the tenancy with the original documents.

As well as photo ID, we also require a proof of address (i.e. a utility bill or council tax bill in your name at the given
address), which is dated in the last three months. A UK driving license can provide proof of address, provided the
address shown and that given by you are the same. From companies, we require a Proof of Identity of the Director or
Authorised Signatory, as well as proof of directorship or proof of authority to sign.

Initial Payment
If you are interested in renting one of our properties, you will be expected to pay a Reservation Fee of £200.00 per
applicant.

The Reservation Fee is to show you are willing to move into the property on an agreed date, enable us to prepare the
property for your occupation, allow us to proceed with references and enable us to take the property off the market
(once satisfactory references are returned).

In the event of the parties proceeding with the tenancy, your Reservation Fee will be offset against your initial tenancy
payment.

Should the tenancy not commence on the agreed date for any reason, your Reservation Fee will be forfeited in order to
cover costs including, but not limited to the following: re-advertising the property, monies in lieu of rent due to the
property being reserved and unavailable to other potential tenants, preparing documents associated with the tenancy.

Tenancy Agreement Information

An appropriate Tenancy Agreement will be prepared for your signature prior to the start of the tenancy. It is our policy to
execute the Tenancy Agreements and any Renewal Memorandum Agreements by dating the document as soon as it is
signed by the parties. This may be prior to the actual tenancy start date. Once executed by us, both parties are legally
bound to the Tenancy. When you sign this Tenancy Guide you are confirming your authority for us to execute and bind
the Tenancy Agreement and any Renewal Agreement in this manner without further reference to you.

Additional Clauses:

The Landlord has agreed to have the property professionally cleaned, including the carpets, by a third party
company prior to the commencement of the Tenancy at their own cost. It is the Tenant’s responsibility to ensure
the property is cleaned to the same standard prior to vacating at the end of the Tenancy. Therefore the Tenant
has agreed to instruct a third party professional cleaning company to clean the property to the same standard as
upon entry. It is the Tenant’s responsibility to cover the cost of works and provide a receipt(s) as evidence to the
Landlord, the Landlord’s Agent or Inventory Clerk in attendance at the Check-Out for Tenancy end.

The landlord has agreed to fix the broken bathroom tile prior to the start of the tenancy.

We request that you read these details carefully and immediately notify us, in writing, of any amendments.

Statement of costs

Tenancy Application Fee - £240.00 (per tenancy)


Individual Reference - £75.00 (per applicant)
Individual Guarantor Reference - £75.00 (per applicant, where applicable)
TDS registration fee - £20.00 (per tenancy)

Should you wish to make any alterations to the terms and conditions already agreed (subject to the Landlord’s
agreement) which will necessitate amended documentation to be provided, further an administration charge of £240.00
including VAT will apply.

Rent Payments

Your rent is payable in advance and should reach our account on the rent due date as specified in your tenancy
agreement or as previously agreed. Rent should be paid by Standing order.

Tenancy Deposit

Gibbs Gillespie Lettings will hold the Tenant’s deposit as Stakeholder and protect the deposit under the TDS as per the
tenancy agreement.

In circumstances the landlord may choose to hold the deposit and protect it under one of the three regulated Deposit
Protection Schemes, and this will be noted within the Tenancy Agreement.

Deposits under a Company Let Tenancy or License Agreement do not require protection.

The deposit will be released at the end of the tenancy, when mutually agreed by all parties.

Tenancy Renewals and Extensions

Should your tenancy be renewed, there will be a Tenancy Agreement charge of £75.00 including VAT. If rent for the
tenancy is paid in full and in advance, any renewal will be under the same terms unless a further reference fee is paid
and suitable references obtained.

Utilities and Television

You will be responsible for gas, oil (where applicable) electric, water and council tax, unless included in your rent, paying
these accounts for the duration of the tenancy unless otherwise stated in your tenancy agreement.

Gibbs Gillespie work in partnership with OVO Energy Limited. You acknowledge that we will use your name, address
and contact details for the purposes of notifying your council tax, water and energy suppliers at the property and for the
purposes of setting up your accounts with them. We will pass these details to OVO Energy Limited who performs these
services on our behalf.

Please note, as prospective tenants it is your responsibility to check and be aware of how utilities are provided to the
property which may be either by the purchase in advance of utility credits via a ‘key’ or similar system or payment based
on the actual units used. Telecommunications companies will not accept instructions from third parties and therefore
neither the Landlord nor agent can be responsible for ensuring there is a working active line available to you. If you are
moving into a property that has not had a telephone line or television aerial connected previously or it has been vacant
for three months or the property does not have digital television reception, then it will be your responsibility to pay the
provider’s connection fee and arrange for the provision of these services.

Declaration - Subject to Contract & References

This offer is subject to the Landlord’s approval, contract and references. Which means that there is no guarantee of a
tenancy. The tenancy process may lead to possession being granted but is subject to; satisfactory references being
received by all applicants (with, if necessary, a guarantor), the tenancy agreement being signed by both parties, dated
and exchanged.

Payment and acceptance of any payment does not legally bind either the Landlord or the Tenant to the Tenancy prior to
the signing of the Tenancy Agreement by all parties.
