HEREINAFTER called as the “LICENSOR” (which expression unless repugnant


to the context shall mean and include himself, his heirs, executors, Administrators

HEREINAFTER called as the “LICENSEE” (which expression unless repugnant to


the context shall mean and include themselves, their heirs, executors,
Administrators and assigns) … …. Party of the second part.

WHEREAS the licensor is the owner of all the piece and parcel of the
property i.e. flat bearing No.C-904 , on 9th floor, of building known as The Pearl ,
Balewadi , Pune flat admeasuring about 1115 sq. ft. and attached terrace
admeasuring about 108 sq. ft, in the building constructed on Survey No. 1, Hissa
no. 9A/2 having C. T. S. No. ____________, plot No.________, of village
Balewadi Taluka Haveli District Pune , within the limits of P.M.C. and within the
Revenue Jurisdiction of Sub Registrar of Assurance , Taluka Haveli , Dist- Pune,
hereinafter referred as said flat.

AND WHEREAS the Licensee herein approached the Licensor and


requested to grant the property as stated above consisting of one hall, Two
bedrooms, One Kitchen, Baths and w.c. for residence purpose for an initial period
of Eleven months and the licensor herein has also agreed to grant the said property
as mentioned above for the initial period of Eleven months which may be extended
or renewed as per mutual agreement, subject to the terms and conditions mentioned
hereunder.

NOW THIS DEED WITNESSETH AS UNDER

1. This writing shall never be construed as any tenancy agreement or


lease or otherwise creating any right or interest in the said flat in
favour of licensee which is not at all the intention of the parties but
on the contrary merely a temporary agreement or arrangement simply
to allow licensee to use and occupy the said flat for his residence
purpose for the period not exceeding 11 months i.e. from
1/04/2019 to 31/01/2020

2. The Licensee herein has agreed to keep a refundable interest free


security deposit of Rs. 60,000/- (Rupees Sixty Thousands only) cheque

no _________ with the Licensor, which will be refunded, to the


Licensee at the time of surrendering the property to the Licensor. That
the licensee has paid security deposit by cash and the same is
acknowledged by licensor and no need of separate receipt is there.

3. That the Licensee shall pay to the Licensor a sum of Rs.18,500/-


(Rupees Eighteen Thousand Five Hundred only) per month towards the
monthly License fees in advance at begning of the month, payable
before the 10th day of every month, and for any delay in making the
payment beyond 10th day of every month under normal circumstances,
the Licensee will be liable to pay a penalty of Rs. 100/- per day on the
defaulted amount for the defaulted period.

4. It is mutually agreed between both parties that incase of extending the


agreement for next year after expiry of this agreement the rent will
increase min. by 1000 RS.

5. The Licensee shall not make any addition or alteration of permanent or


temporary nature in the property described hereinabove except with the
prior written consent of the Licensor.

6. That the Licensee shall not sub-let, assign, use for commercial or
business purpose or otherwise part with possession of the premises
without the consent of the Licensor in writing.

7. It is agreed by and between both the parties that the LICENSEE/


party of the Second part shall pay the M.S.E.B. Bills as per the
actual Bills and the GAS Bills & any other bill as actual used as per
bills given by the concerned authority. That the licensor shall pay
the Municipal Taxes of the said Flat and Society Maintenance
charges only.

8. The Licensee shall use the property for residence only and the same will
not be used for any other purpose. The Licensee will not carry out any
illegal activity in the. premises. Similarly, he will not do any willful act
by which it will cause nuisance to the neighbors.

9. The Licensee shall not store any hazardous chemicals, materials,


inflammable articles arms & ammunition etc. in the said property, which
may be illegal & can cause damage to the property.

10. The said LICENSEE shall be liable to pay to the said LICENSOR
enhanced charge i.e. double amount of license fees per month, if he
fails to vacate the PERMISES on expiry of the agreement or the expiry
of the notice period as the case may be shall be also liable for
prosecution, at the cost and consequence of the said LICENSEE.

11. At the time of termination of the agreement if any of the bills referred
above are payable then their amount and if the bills are not received by
the concerned authority, then the proportionate amount due for the
previous period will be deducted from the security deposit and the
balance amount will be refunded to the Licensee by the Licensor, within
seven days & if the licensor fails to refund amount within 7 days then
the licensor shall be liable to pay interest @ 24% for delayed period.

12. Failure of payment of the license fee as per terms and condition of this
agreement shall be treated as breach of this agreement.

13. It is further agreed by both the parties that the 11 month period is
the lock-in period of license and the licensee shall compulsory
occupy the flat and pay license fees to the licensor. However if any
party desire to terminate this Agreement, then the either party shall
intimate to the other party regarding his intention to vacate the
same premises, by giving at least one calendar month notice.

14. The Licensee shall give vacant and peaceful possession of the said
premises on expiry of this agreement or earlier in case of breach of any
of the terms and condition to this agreement on demand being made for
the possession of the premises by the Licensor. Licensee’s occupation
of the premises after such termination will be deemed to be of a
trespasser.

15. The Licensee shall maintain the licensed premise in good condition and
will not cause any damage thereto. If any damage is caused to the
premise or part thereof by the Licensee or his employees, the same will
be made good by the licensee at his cost by rectifying/replacing the
damage or by paying cash compensation as may be determined by the
Licensor. And upon expiry of the license period or on termination, the
Licensor will refund the deposit amount after inspecting the premises,
furniture & fixtures, electrical fittings & all furnishing provided by
licensor.

16. The original agreement shall always remain with the Licensor and a
copy thereof duly signed by both the parties shall be retained by the
Licensee.

17. This deed does not confirm right of tenancy on the licensee. The
Licensee hereby agrees and undertake to quit & vacate and deliver the
vacant and peaceful possession of the said premises to the licensor as
stated in the earlier para. That the licensee further agree and undertake
to the licensor to indemnify and to keep indemnified against the losses
claims damages arising from breach default of these presents by the
licensee of any obligations covenants conditions thereof.

18. On expiry of this license period or earlier, if this License is terminated


and if the Licensee fails to deliver vacant & exclusive possession of the
said premises along with its fixtures & fittings mentioned herein, to the
Licensor, the Licensor shall be entitled to be at liberty to enter into the
said premises without hindrance, obstruction and without prejudice to
the Licensor’s rights to recover the damages from the licensee.

19. It is agreed that any indulgence shown or any delay on the part of the
licensor to evict the licensee or non-action of the licensor against the
licensee for the non observance of the terms of this deed by licensee,
shall not be construed as waiver of any rights of the licensor.

20. It is agreed between the parties that at all times the judicial possession
of the said premises shall be of the licensor and the licensee has merely
granted License to make use of the said premises for a limited period
only. The Licensee shall handover vacant , exclusive & peaceful

possession of the said premises to the Licensor, after expiry of this


License.

21. The Licensee shall follow and adhere to all the regulation of the society
which are prevalent and are common to all the residents in the society
complex.

22. That the licensor or his representative has & shall have the right of
access to the said residential premises during any reasonable time, by
informing previously to inspect the condition thereof , which the
Licensee shall allow without any objection thereof.

23. The LICENSEE shall not do or suffer to be done anything which may
invalidate the insurance of said Flat.

24. The Licensor shall in no event be liable to the LICENSEE for any loss
or damage to the goods or articles of the LICENSEE for any pilferage in
respect thereof. The Furniture, goods, Machines, equipments, etc. of the
LICENSEE shall remain in the premises solely at the risk and on
account of the LICENSEE.

25. On the determinations of this License either by efflux of time or its


earlier determinations, the LICENSEE shall immediately vacate the
premises, and in the event of LICENSEE failure to do so, the Licensor
shall be entitled to remove the belongs of the LICENSEE and keep them
in safe custody at such other place or places at the risk and account of
the LICENSEE. The Licensor shall in no event be responsible any loss
or damages of any of the articles so removed and keep in safe custody as
aforesaid.

26. All this terms and words or phrases used in these presents shall have
ordinary meaning consistent with the intention of the parties and no
word, or phrases, or term shall have any meaning which appears to be
inconsistent with the present Agreement.

27. That the present Agreement is registered in the Sub-Registrar’s Office,


Haveli, Pimpri, under the amended provisions of the Registration Act.
And the appropriate stamp duty & registrations fees has been paid.

28. The Licensee is not allowed to take any Loan / or any type of financial
transaction from any Bank and Institution or Person against this
property . The licensee should not use the address of this property for
any such pupose.

In case any such event as explained above the Licensor has no liability
and responsibility.

29. The Licensor has provided above flat with following Furnitures and
Fixtures for the use to Licensee during the stay in this flat. The licensee
should return all furnitures and fixtures in good conditions to licensor at
the time of handing over the Flat.

b- TV Cabinet – 1set
c- Glass Dining table with four chairs – 1 set
d- Cup board in Kitchen - 1 no

e- Master bed with Matresses – 1 set


f- Master cup board set in Master bed room – 1 set
g- Inverter - 1
h- Electrical fittings & Fan

IN WITNESS WHEREOF the parties hereto have set and subscribed their
respective hands and signed hereunder on the day, month and year herein above
