PLEASE TAKE NOTICE that upon all papers filed and proceedings had herein the

United States, will move this Court before the Honorable Lawrence E. Kahn, Judge of the United

States District Court for the Northern District of New York, in the courtroom usually occupied by

him at the James T. Foley - U. S. Courthouse, 445 Broadway, Albany, New York, on July 18,

2008, at 9:30 a.m. for an order to grant the United States’ motion to dismiss in this action.

The United States will move to dismiss this action pursuant to 31 U.S.C. § 3730(c)(2)(A).

The government’s motion also raises other theories of dismissal including the Court’s lack of

jurisdiction to hear the plaintiff’s claims pursuant to Fed. R. Civ. P. 12(b)(1) and the plaintiffs’

failure to state a claim upon which relief may be granted in accordance with Fed. R. Civ. P. 12

(b)(6).
