1. Creation of the National Center for Legal Aid or NCLA;
Its Objectives and Responsibilities.
N
C The National Center for Legal Aid or NCLA was cre-
ated pursuant to Section 55, Article VIII of the By-Laws of
L the Integrated Bar of the Philippines (IBP). Its primordial
A objectives and responsibilities include:

P (a) Promote the establishment and efficient maintenance


R of Chapter legal aid organizations suited to provide
free legal service as well as to direct and supervise all
I Chapter legal aid organizations;
M
(b) Maintain maximum levels of coordination and coopera-
E tion with other organizations having similar objectives
R or performing analogous or allied functions – such as,
inter alia, the Department of Social Welfare (DSW), the
Citizens Legal Assistance Office (CLAO), the Depart-
ment of Agrarian Reform (DAR), the Women Lawyers
Association (WLAP), and the U.P. Women Lawyers
Circle (WILOCI) and particularly with courts of justice,
provincial fiscals, city fiscal and/or city attorneys, and
other offices discharging similar duties;

(c) Receive and solicit aid and assistance from any avail-
able and suitable source or sources, provided that the
independent character of the legal aid is not impaired;
and

(d) In general, but subject to the authority of the Board of


Governors, do or cause to be done all things necessary
and proper for the promotion of legal aid activities,
projects and objectives.

1.1. Supervisory Role of NCLA

The NCLA shall direct and supervise all Chapter


Legal Aid Offices scattered nationwide. Its supervisory
role includes:

(a) To monitor the activities of the Chapter Legal Aid P
Offices to see to it that are undertaken within the
directives and guidelines prescribed by the IBP
Board of Governors and are geared towards the N
objectives of the Legal Aid Program of the IBP;

(b) To refer cases to the corresponding Chapter Legal L
Aid Office; A
(c) To require the submission of the required reports;
P
(d) To recommend adjustments in the Chapter funds
allocation; and
R

(e) Approve or disallow disbursements based on the M
guidelines of the COA.

In line with the suprevisory role of the NCLA, all R
Chapter Legal Aid Offices are required to submit an
annual report of their operations, stating the following:

(1) Its composition and administrative set-up;

(2) The number of cases handled and consultation


extended as well as the nature and extent of the
services rendered;

(3) The outcome and status of the cases handled;

(4) The expenses required and those incurred in each


case;

(5) All income derived, if any, in connection with said


cases;

(6) The problems and difficulties encountered; and

(7) Special problems undertaken or to be undertaken.

1.2. Types of Legal Aid

The IBP Legal Aid Program is classified into::

I (a) Traditional Legal Aid - involves the rendering of


B legal assistance to qualified indigent clients by way
of legal advice or opinion, couseling, and legal rep-
P resentation before courts or quasi-judicial bodies;
and
N (b) Developmental Legal Aid - involves lawyering for
C public interest causes. It is not given to an individual
L and his personal interest but to a class or a group of
persons who face a common problem arising out of
A social ills and conflicts.

P 2. Establishment of Chapter Legal Aid Offices; Its Objective


R and Responsibility
I
Legal Aid is not a matter of charity. It is a means for the
M correction of social imbalances that may and often lead to
E injustice, for which reason it is a public responsibility of the
R Bar. The spirit of public service should, therefore, underlie
all legal aid offices. The same should be so administered
as to give maximum possible assistance to indigent and
deserving members of the community in all cases, matters
and situations in which legal aid may be necessary to fore-
stall an injustice. (Section 1, Article I, Guidelines Governing the
Establishment and Operation of Legal Aid In All Chapters of the
Integrated Bar of the Philippines or Guidelines On Legal Aid).

In order to attain the objectives of legal aid, legal aid


offices should be as close as possible to those who are in
need thereof – the masses. Hence, every Chapter of the IBP
must establish and operate an adequate legal aid office.

2.1. Notice of Location of a Chapter Legal Aid Office

The specific address or location of Chapter Legal


Aid Office should be announced in a NOTICE, which
shall be published as extensively as possible. (Section
3, Article I, supra)

2.2. Officials to be Notified of the Establishment of a
Chapter Legal Aid Office

The following officials shall also be furnished cop-


ies of the foregoing NOTICE, with the request that the I
same be given the widest or possible publicity, namely: B
(a) The Judges of all courts of justice, including such P
other judicial or quasi-judicial organs, if any, as may
be performing their functions within the Province,
City or area thereof to which the jurisdiction of the

IBP extends; C

(b) The Clerks of Court of said courts, the Deputy
Clerks of Court of the Branches thereof, and the A
offices performing equivalent duties in said courts
or organs, or in the division or branches thereof;

(c) The Provincial Governor and the chief executives R
of the cities, municipalities and other political sub- I
divisions within the province or within said cities
and/or municipalities; M

(d) The Provincial Commander of the Constabulary
(now, the Head of the Philippine National Police),
R
the Provincial Warden, the Chiefs of the City and/
or Municipal Police Forces, as well as the heads of
such other police, army and similar law-enforcing
agencies, if any, as may be stationed in said prov-
ince, cities, municipalities and/or other political
subdivisions; and

(e) Schools, churches and such other institutions, or-


ganizations or persons as the Board of Officers of
the Chapter or the Executive Director of its Legal
Aid Office may deem fit. (Section 4, Article 1, supra)

2.3. Posting of Notice

The officers discharging the functions of Clerks of


Court and/or Deputy Clerks of Court, or performing
similar equivalent functions, shall, moreover, be re-
quested to post the NOTICE in their respective offices.

3. Administration of Chapter Legal Aid Office

The Legal Aid Office of each Chapter shall be adminis-


tered by a LEGAL AID COMMITTEE under the direction
I and control of the Chapter Board of Officers. (Section 9,
B Article V, supra)

3.1. Composition; Appointment and Term of Office

N The Legal Aid Committee of each Chapter shall


have, at least, a Chairman and two (2) other Members,
C who shall be appointed by the President of the Chap-
L ter, with the consent of the majority of the Chapter
A Officers, upon the election and assumption of office of
the Chapter Officers, and shall serve for a term of one
(1) year and until the appointment and qualification of
P their successors. (Section 10, Article V, supra)

I 4. Powers and Duties of Chapter Legal Aid Committees
M
4.1. Main Powers and Duties
E
R Every Chapter Legal Aid Committee shall have the
following main powers and duties:

(a) Appoint an Executive Director of Legal Aid when-


ever necessary or expedient by reason of the volume
of work to be performed or for some other cause,
with such compensation as may be fixed by the
Chapter Board of Officers; provided, however, that
where no such necessity exists or said appointment
is not demanded by considerations of expediency,
or in the event of absence, illness or incapacity of
the Executive Director or of vacancy in said office,
its function shall be discharged, without compen-
sation, by the Chairman of the Chapter Legal Aid
Committee or the Committee Member designated
therefore by said Chairman;

(b) Appoint additional Legal Aid personnel with such


compensation as may be fixed by the Chapter Board
of Officers, whenever the needs for such addition-

al personnel arises and the funds available to the
Chapter Legal Aid Committee permit it, provided,
however, that the Chapter Legal Aid Committee
shall make use, to the fullest possible extent, of the
services of the headquarters staff and such office

space, equipment and supplies of the Chapter as B
may be available, or of such office space and other P
facilities, if any, as may be made available to the
Committee by a local court or a branch of any oth-
er court or a branch or office of the Department of N
Social Welfare, the Red Cross, the Citizens Legal
Assistance Office, the Election Registrar, or any
C
other similar organization or by a law school or L
educational institution; A
(c) Authorize law students to work in the Chapter Legal
Aid Office, with the previous approval of the Chap- P
ter Board of Officers and under such conditions as
it may prescribe; R

(d) Adopt its own budget, with the approval of the
Chapter Board of Officers; M

(e) Solicit and receive aid and assistance from any
legitimate source or sources, provided that the in- R
dependent character of the Legal Aid Office is not
impaired; that, in the case of conditional donations,
the conditions are approved by the Chapter Board
of Officers; and that such aid and assistance are duly
received for by the Executive Director or the person
designated by him therefore, with the approval of
the Chapter Board of Officers;

(f) Establish and maintain a Chapter Legal Aid Fund;

(g) Make appropriations and disbursements;

(h) Keep proper books of account and submit, properly


audited, annual financial statements, to the Chapter
Board of Officers and the President of the IBP;

(i) Classify the Chapter members, preferably after


consulting them, on the basis of the field of law in
which they have specialized or are they are more
inclined to render free legal aid;

(j) Prepare a list of Chapter members who volunteer to
work in the Chapter Legal Aid Office or to render free
legal aid;

I (k) With the approval of the Chapter Board of Officers,


B assign or designate members of the Chapter to render
services in the Chapter Legal Aid Office, on a fair and
P equitable rotation system, for counseling and consulta-
tion, as often and for such periods as may be necessary
N or expedient;

C (l) With the approval of the Chapter Board of Officers,


L assign specific legal aid cases or matters to carefully
selected members of the Chapter. Provided that these
A assignments shall be made in such a way that the bur-
den of the work is spread out as fairly and equitably
P as possible among the members of the Chapter;

R (m) Pass upon every request for legal aid, in accordance


I with the Procedures and Tests provided for under
Articles VII and VIII of the Guidelines on Legal Aid;
M
E (n) When the interest of justice and expediency demands it
R and the main part of the work involved in a given case
or matter is to be done within the territorial jurisdiction
of another Chapter, endorse and refer thereto said case
or matter;

(o) Keep itself informed on significant incidents and de-


velopments in every case of legal aid, and take such
steps as may be necessary and proper to expedite the
final disposition thereof; and

(p) Submit to the Chapter Board of Officers and the Nation-


al Center for Legal Aid (NCLA) an annual report of its
operations, stating its composition and administrative
set-up, the number of cases handled and of consulta-
tions attended to as well as the nature and extent of the
services rendered, the outcome and status of the cases
handled, the expenses required and those incurred in
each case, all income derived, if any, in connection with
said cases, the problems and difficulties encountered,
special projects undertaken or to be undertaken, and
particulars regarding the financial condition of the

Chapter Legal Aid Committee, with such recommenda-
tions or suggestions as may be deemed fit and proper.
(Section 11, Article VI, supra)

4.2. Other Powers and Duties I

Every Chapter Legal Aid Committee shall have, also,
such other powers and duties as are or may be necessary P
or proper for the attainment of its objectives, subject to
such limitations or conditions as may, from time to time,
be imposed by the Chapter Board of Officers, by the Board

of Governors and/or the President of the IBP. (Section 12, C
Article VI, supra) L

5. Procedure

5.1. Requests for Legal Aid; Where Filed


P

Requests for legal aid may be filed directly with the I
IBP National or the NCLA or with any Chapter Legal Aid
Office. (Section 13, Article VII, supra) M
E
Where a request is filed directly with the IBP National
Office or NCLA, the NCLA may refer the same to the cor-
R
responding Chapter Legal Aid Committee of the locality
where the case will have to be filed or where it is pending,
with appropriate advise to the Chapter President and the
Chairman of the Chapter Legal Aid Committee. The NCLA
shall, as much as possible, concentrate on cases of para-
mount importance or national impact. (Section 14, Article
VII, supra)

5.2. Application for Legal Aid

Every request for legal aid shall be set forth in an AP-


PLICATION - which shall adhere substantially to the form
shown in Schedule I hereof, and subscribed by the party
requesting legal aid or his duly authorized representative.
(Sections 16 and 17, Article VII, supra)

The Executive Director or whoever discharges his


duties, shall see to it that the said application is duly ac-
complished, at least in duplicate. A carbon copy of the

said application shall be forwarded to the NCLA, on
a monthly basis. (Ibid.)

I 5.3. Action on Requests


B The Chapter Legal Aid Committee shall pass upon
P every request for legal aid applying the combined merit
and means tests, subject to review by the Chapter Board
of Officers; provided, however, that, in urgent matters,
N requiring prompt or immediate action, the Executive
C Director or whoever performs his functions, may pro-
visionally act on the request, subject to review by the
L Chapter Legal Aid Committee and, thereafter, by the
A Chapter Board of Officers. (Section 15, Article VII, supra)

5.4. Combined Tests


P
R The NCLA or the Chapter Legal Aid Committee, as
the case may be, shall pass upon requests for legal aid
I by the combined application of the means and merit
M tests, and the consideration of other factors adverted to
E in Sections 20 through 23, inclusive, of the Guidelines
on Legal Aid.

5.4.1. Means Test

The means test is aimed at determining whether


the applicant has no visible means of support or
his income is otherwise insufficient to provide the
financial resources necessary to engage competent
private counsel owing to the demands for subsis-
tence of his family, considering the number of his
dependents and the conditions prevailing in the
locality.

The means test shall not be applicable to ap-


plicants who fall under the Developmental Legal
Aid Program such as Overseas Filipino Workers,
fishermen, farmers, women and children and other
disadvantaged groups.

5.4.2. Merit Test

The merit test seeks to ascertain whether or


not the applicant’s cause of action or his defenses I
is valid and the chances of establishing the same
appear reasonable. B

5.4.3. Other Factors

The effect of the Legal Aid service or the fail- N


ure to render the same upon the Rule of Law, the C
proper administration of justice, the public interest
involved in given cases and the practice of law in L
the locality shall, likewise, be considered. A
Moreover, care shall be taken that the Legal
Aid is not availed of to the detriment of the private P
practice of law, or taken advantage of by anyone R
for personal ends.

Any request for legal aid may be denied to an M
applicant already receiving adequate legal assis-
tance from any source other than the IBP.

6. Prohibition

NO LAWYER OR MEMBER OF THE STAFF OF


THE NCLA OR CHAPTER LEGAL AID OFFICE SHALL
DIRECTLY OR INDIRECTLY DEMAND OR RECEIVE
FROM THE RECIPIENT OF LEGAL AID ANY COM-
PENSATION, GIFT OR PRESENT FOR SERVICES
RENDERED IN CONNECTION THEREWITH. (Section
27, Article IX, supra)

7. Contributions of Successful Litigants

In the event of successful litigation, whatever attorney’s


fees may have been awarded to the recipient of legal aid
shall belong to the NCLA or the Chapter Legal Aid Office
that rendered such legal aid, as the case may be. (Section 25,
Article IX, supra)

Regardless of whether or not attorney’s fees have been
awarded, the NCLA or the Chapter Legal Aid Committee,
as the case may be, shall have the discretion to require the
I recipient of legal aid, in whose favor decision has been ren-
dered, to turn over a nominal or reasonable portion of his
B actual recovery, not exceeding ten percent (10%) thereof, to
P the National Director for Legal Aid, as contribution to the
Legal Aid Fund thereof, for the operation and maintenance
of the Legal Aid Program of the IBP. A portion thereof may
N be given to the lawyer who handled the case.

In cases falling under the Developmental Legal Pro-
L gram, the handling lawyer shall receive ten percent (10%)
A of the actual recovery by the client-applicant. The client-ap-
plicant shall also contribute fifteen percent (15%) of the said
award to the Legal Aid Fund of the Chapter or to the NCLA,
P as the case may be.

I 8. Autonomy and Uniformity
M
E In the discharge of their responsibilities, all Chapters
shall enjoy maximum local autonomy with the framework
R of uniform guidelines, under the direction and supervision
of the NCLA and subject to the authority of the IBP Board
of Governors. (Section 6, Article II, supra)

The Chapter Board of Officers may adopt rules and


regulations, not inconsistent with the Guidelines on Legal
Aid and such directive as may be issued by the IBP National
President or the IBP Board of Governors, to govern the es-
tablishment and operation of the Chapter Legal Aid Office.
(Section 28, Article X, supra)

9. Funding

The funds allocated to a Chapter for Legal Aid come


from the IBP Legal Aid Subsidy of the Supreme Court. It
partakes of the character of public funds and is, therefore,
subject to the rules and regulations of the Commission on
Audit (COA) on disbursement and liquidation.

The Chapter funds allocation are categorized into:

(1) For the salary of the Chapter Legal Aid Clerk, and

(2) For the operations of the Chapter Legal Aid Committee.

9.2. Quarterly Allocation for Legal Aid

Disbursements of the Chapter quarterly allocation
must be within its budget allocation for any of the fol-
lowing expenses, viz:

(a) Honoraria of Legal Aid Lawyers (subject to


Withholding Tax);

(b) Up to 70% of bills for Light and Water, Tele-


phone and office rental;

(c) Actual expenses for postage, telegram, supplies,


repairs and maintenance of office typewriter,
computer and other office equipment;

(d) Transportation (actual fare only but does not


include gasoline); and

(e) Repairs and maintenance of office equipment.

10. Liquidation

All Liquidation Reports must be approved and signed


by the Chapter President and/or the Chairman of the Chap-
I ter Committee on Legal Aid together with the supporting
B documents thereto.

10.1. For Legal Aid Clerk Salary

N (a) Daily Time Record (DTR) duly signed by the Legal


Aid Clerk and approved by the Chairman of the
C Chapter Legal Aid Committee or the Chapter Pres-

(b) Monthly Accomplishment Report of the Legal Aid
Clerk approved and duly signed by the Chairman
P of the Chapter Legal Aid Committee or Chapter
President;

I (c) Original Proofs of Payment of SSS Premium, Phil.
M Health Contribution, Pag-ibig and BIR; and

E (d) Acknowledgment receipt of salary by the Legal Aid


R Clerk.

10.2. Quarterly Chapter Allocation

(a) Monthly Certificate of Service of Legal Aid Lawyers


duly approved by the Chairman of the Chapter
Legal Aid Committee or Chapter President;

(b) Monthly Report of Legal Aid cases duly signed


by the Legal Aid Lawyer and approved by the
Chairman of the Chapter Legal Aid Committee or
Chapter President;

(c) Original copy of Proof Payment of Withholding Tax


(BIR);

(d) Acknowledgment Receipt of Honorarium; and

(e) Summary of Liquidation Report approved and


signed by the Chairman of the Chapter Legal Aid
Committee or Chapter President.

For the other allowable expenses, the same must be ac-
companied by the following documents, to wit:

For purchases exceeding the amount of R
P1,000.00, the purchase must be approved
by the Chairman of the Chapter Legal Aid
Committee and Chapter President and must
be accompanied by a Purchase Order and
Price Quotation from at least three (3) bona-
fide and reputable suppliers and Inspection
Report.

Transportation The amount of the transportation allowable


shall be actual fare at the prevailing rates of
authorized transportation from the perma-
nent official station to designation and back.
No reimbursement for the cost of gasoline
or fuel shall be allowed where a private
vehicle is used, however, he is entitled to
the equivalent cost of the customary mode
of transportation. The required submission
of the certificate of appearance and used
transportation ticket shall be complied with.

receipts with indication that it was duly received by the clerk and
payment was approved by the Officer of the Chapter (supplies
like bond paper are limited up to 3 reams per purchase). Receipts
are limited to P1,000.00 only otherwise you are required to submit
three (3) canvasses for the items
6. Receipts for payment of light and water and telephone bills (except
personal and long distance calls) to the extent of 70% of allocation
7. Transportation expenses should be described as to the distance
from one place to another
8. Liquidation of expenses for the quarter should be supported by
original receipts attached countersigned by the President or Chair-
man of the legal aid committee.
