Gephardt Inquiry: Iceberg Lot

On or about March 28th, Legacy Towing was contacted by the owner of CJ’s, a building located
894 East 3900 South Salt Lake City, UT 84107. The owner of CJ’s presented the problem
relating to unauthorized (not having permission or authorization) parking on his property. The
neighboring business was using a significant amount of his parking lot without his permission.
He informed us that he had made many attempts to come to an agreement with Iceberg
regarding the use of his property. We reviewed our services to assist in his efforts to address
the challenges he was facing with Iceberg customers parking on his property. Iceberg
customers were not only parking on his property but were leaving trash and melted ice cream
behind when they left. The owner of CJ’s even provided trash cans at his own expense to
control the mess. He continued to seek a resolution with Iceberg for over a month with no
engagement or effort to mitigate the problem. As a last result, our services were retained to take
action enforcing with notice illegally parked vehicles on his property beginning May10th.

We obtained the necessary authorization and installed signs at the entrances that comply with
state and local requirements. The entrances to the lot are shared and Iceberg did not have
some of the stalls they have access to marked “Iceberg parking”, so for a sign to state “CJ’s
Parking Only” or “Iceberg Parking Only” it would have been misleading and incorrect. Iceberg
has since ordered and installed some signs designating the stalls that can be used by their
customers. We installed on July 9th additional verbiage to our signs that state “Parking for
Iceberg in Designated Stalls Only”. Had Iceberg previously installed signs directing their
patrons, and had they clearly marked the stalls they are allowed access to, much of this
confusion could have been avoided.

The enclosed (image) notice is taped to a window at Iceberg. Not only is it confusing, but it
represents the totality of this problem. Rather than engage the property owner at CJ’s and work
to resolve the problem, they create confusion for their customers. This notice directs Iceberg
customers to park on the West side of CJ’s parking lot in an area where parking has been
leased to the medical staffing company next door.

A continued effort promoting awareness and responsible parking enforcement is something our
company takes very seriously and is actively engaged in with local representatives. Should you
