The Successful bidder shall ensure that the safety measures

mentioned in the contract conditions are followed strictly. In case of


any accident / death, the contractor shall be liable to pay minimum
compensation as provided under workmen compensation act-1923. In
case of failure, DJB shall have the right to make the compensation
and recover the amount from the contractor. Further DJB reserves the
right to debar the firm from tendering / black Listing if the above
condition is not adhered to by the firm / contractor.

SECTION – I INSTRUCTION TO BIDDERS

A. General
1. Scope of Bid

DJB (hereinafter be referred to as the “Employer”) has been in process to execute the works detailed
in the table given in NIT, Providing Sewerage facility in Pitam Pura NCT of Delhi, invites Bids from eligible
bidders.

1.1.1 The work includes civil and electrical mechanical works. The Civil works comprises
providing and laying sewer lines, sewage pumping mains and construction of sewage
pumping station. The electrical and mechanical works comprises providing and
installation of E&M equipments and O&M of the SPS and pumping main .
1.2 The successful bidder shall have to complete the Works within the period mentioned in the
NIT/documents.
1.3 Throughout these bidding documents, the terms 'bid' and 'tender' and their derivatives
(bidder/tendered, bid/tender, bidding/tendering, etc) are synonymous. Day means calendar
day. Singular also means plural, where applicable.
2. Source of Funds
The works shall be implemented with N C T Government of Delhi funds or through funds raised by
the Employer.
3. Minimum Eligibility Criteria for Bidders
3.1 The contractor must have satisfactorily completed three similar works each costing 40% or two work each
costing 50% or one work costing 80% of the amount put to tender respectively during the last 7 seven years ending
last day of the month previous to the one in which the tenders are invited duly certified for successful performance
of executed works by concerned EEs The terms, conditions/general conditions and circulars issued by the
department time to time will also be acceptable by the contractor. The contractors are required to submit
following documents along with Part ‘A’:-

a) The registration with works contract cell of Sales Tax Deptt/VAT of concerned states.

b) An undertaking in the form of affidavit to the effect that applicant firm has never been
Black listed by Govt. Department

c) Details of similar works executed by the firm along with the list of its financial status, Turn
over and T&P’s required for works

e) For item No. 3 only, the firms who has executed similar nature of work, may also apply subject

to above conditions .

3.2 This invitation to bid is open only to such bidders who meet the minimum

requirements set below:

a) a bidder shall not have abandoned any Delhi JAL Board work nor should any of his Contract for D
J B work have been rescinded disqualified on account of non-performance during the last 5
years.

b) a bidder shall not have become insolvent.

c) a bidder shall be determined ineligible for corrupt or fraudulent practice by the employer as
described in Sub clause 35.

3.3 Bidders shall provide evidence of their continued eligibility to the satisfaction of the

Employer, as the Employer may reasonably at its sole discretion require from time

to time.

4. Qualification of the Bidder


4.1 To be qualified for award of Contract, bidders shall:

a) Submit a written Power of Attorney authorizing the signatory of the bid to bind the bidder; and

b) Have adequate experience singly or jointly as per NIT stipulation of similar works, financial
capacity and technical capability to undertake the Contract. Confirmation of these matters may
involve the updating, verification and reassessment of information provided by bidder's and
an assessment of bidder's proposals regarding work methods, scheduling and resourcing which
shall be provided in sufficient detail to confirm the bidder's capability to complete the works in
accordance with the specification and the time for completion.

c) Comply with the requirements of clause 3 herein above, and

d) Any other conditions as the employer may prescribe from time to time.

4.2 The bidder shall update any information submitted with his application for

Prequalification, which has changed with particular reference to:

i) evidence of access to lines of credit and availability of other financial

Resources;

ii) Financial projections for three years, including for the current year, and including the
effect of known commitments;

iii) work commitments acquired since prequalification',


iv) Current litigation information;

iv) evidence of availability of critical equipment;


vi) Evidence of availability of required key personnel in site organization proposed for the
administration and execution of the Contract:

vii) Any other information/details furnished at the time of prequalification which (requires
to be updated.

4.4 For the purpose of determining the current capacity of the bidder, a review of on-going Contracts
as furnished by him would be carried out and will form an important criterion for assessing the
capability of, and availability of resources with, the Contractor to carry out the Works
effectively.
4·5 The bidder shall also submit a detailed note outlining the proposed methodology and
programme of construction, backed with equipment planning and deployment, duly supported
with broad calculations and quality control procedures proposed to be adopted, justifying his
capability of execution and completion of the work as per technical specifications within the
stipulated period of completion.

5. One Bid per Bidder

5.1 A bidder is permitted to submit only one bid, which may be submitted either by himself or as a
member in a joint venture. If bidder wants to submit more than one bid, he will have to obtain
permission of DJB.

6. Cost of Bidding

6.1 The bidder shall bear all costs associated with the preparation and submission of his bid and the
Employer will not be responsible or liable for those costs, regardless of the conduct or outcome
of the bidding process.
