University of the East vs Jader

Fact:

Respondent Jader is an upcoming law graduate student of the University of the East. On his last
semester he failed to take the regularly scheduled finals exam and was given an incomplete remark.
Respondent applied for removal of incomplete remark given by Professor Ortega and rescheduled for
examination which was later approved by the College Dean. After taking the examination, the professor
gave a failing grade of 5.

Respondent was invited to join commencement exercise of the UE College of Law and later on
settled himself for pre-bar review classes in preparation for the Bar Examinations. However upon recent
discovery of his deficiency, he withdrawn from attending review and wasn’t able to take the Bar Exam.
Respondent filed for moral damages on the due negligence of the University of the East.

Issue:

Should the University of the East be liable for moral damages?

Held:

Yes, Petitioner University is guilty of misinforming Respondent of his deficiency and invitation to
join the Commencement Exercise which upon participation is a good indication of a student’s privilege
to graduate.
