REAL ESTATE MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

This Real Estate Mortgage, made by and between:

LESLIE JOY RODRIGUEZ RULE, of legal age, single, and a


resident of Anastacio, Polanco, Zamboanga del (hereinafter known
as the MORTGAGOR);

- and -

LARRY OCAMPO REFUGIO, of legal age, married, and a


resident of 147 Quezon Ave. Dipolog City, Zamboanga del Norte
(hereinafter known as the MORTGAGEE);

WITNESSETH; That:

The MORTGAGOR is indebted unto the MORTGAGEE in the sum of Fifty Thousand
Pesos (P50, 000.00), Philippine Currency, receipt of which is acknowledged by the
MORTGAGOR upon the signing of this instrument, payable to the order of the MORGAGEE
without need of prior demand or notice within a period of three (3) months, lumpsum payment ,
with interest thereon at the rate of 5% percent per month. Interest rate shall be 10 % per month if
paid after three months as penalty.

NOW, THEREFORE, for and consideration of the afore-mentioned indebtedness, and to


assure the performance of said obligation to pay, the MORTGAGOR does hereby CONVEY and
DELIVER by way of MORTGAGE unto the MORTGAGEE, (his/her) heirs, successors and as-
signs, the following parcel of land, together with all the improvements found and standing thereon,
more particularly described as follows:

“A PARCEL OF LAND (Lot 3007-F-3) of the subdivision plan, PSD-097210-021150,


being a portion of Lot 3007-F, LRC Cad. Rec. No. situated in the Barangay Poblacion,
Municipality of Polanco, Province of Zamboanga del Norte, Island of Mindanao. Containign an
area of ONE THOUSAND FIVE HUNDRED EIGHTY SEVEN (1,587) SQUARE METERS
covered under Transfer certificate of Title No. T-79450.”

That it is the condition of this Mortgage that should the MORTGAGOR perform the
obligation to pay the afore-cited indebtedness of Fifty Thousand Pesos (P50, 000.00) together
with accrued interest thereon, within the agreed term, this Real Estate Mortgage shall be discharged
and shall at once become null and void and of no effect whatsoever, otherwise, it shall subsist and
remain in full force and effect and be subject to foreclosure in the manner and form prescribed by
law.

IN WITNESS WHEREOF, we have hereunto set their hands, this 29th day of November
2018 at Dipolog City, Philippines.

ACKNOWLEDGMENT

BEFORE ME, a Notary Public for and in the City of Dipolog, personally appeared Leslie
Joy R. Rodriguez with PhilHealth ID No. 14-025209757-7 and Larry O. Refugio with UMID CRN
No. 006-0121-6699-4, both personally known to me (or whom I have identified through competent
evidence of identity) and who represented to me that their respective signatures on the foregoing
instrument were voluntarily affixed by them for the purposes stated in the instrument and who
declared that they have executed the foregoing instrument as their free and voluntary act and deed.

This Instrument consists of only two (2) page/s, including this page in which this
acknowledgment is written, duly signed by the parties and their instrumental witnesses on each
and every page hereof.
