AM ORDINANCE-INSTITUTION ALIZING THE PROGRAM AHO SERVICES TO


SOLO PARENTS AND THEIR CHILDREN. PROVIDING FUNDS THEREFOR, AND
FOR OTHER PURPOSES.

WHEREAS, the adverse ejects of the economic crises continued to burden the
people, especially the unemployed and under-employed poor people in the City of
Bacolod. but those who suffered most are the solo parents & their children:

WHEREAS solo parents are individuals who due to unfavorable circumstances


are left alone to rear, provide and support the needs of their children, which, among
others, include provision for food, education clothing, shelter & other basic necessities for
their daily survival;

WHEREAS in that situation, solo parents with parenthood responsibility are given
assistance and support by the government pursuant to Republic Act # 8972, otherwise
known as "The Solo Parents Welfare Act of 2000":

WHEREAS premises considered, there is a need for the City of Bacolod to enact
an ordinance which will institutionalise appropriate programs and services for solo parents
& their children in the City of Bacolod:

THEREFORE. BE IT ORDAINED by the Sangguniang Panlungsod of the City of


Bacolod. in session assembled, (hat;

Section 1. Title of the Ordinance - The title of this ordinance shall be called as
"An Ordinance Institutionalizing the programs & services to solo parents and their children,
providing funds therefor, & for other purposes." Its shod title shall be known as "The Solo
Parents Programs/Services Ordinance"

Section ?. Definition of Terms - The following tenns. to mean as follow:

1) Solo Parent - per Republic Act 8972, refers to any individual who fells under
any of the following categories:

a) A woman who gives birth as a result of rape and other crimes against chastity
even without afinalconviction of the offender. Provided that the mother keeps
and raises the child.

b^ Parent left solo or alone with the responsibility of parenthood due to the death
of spouse.

c) Parent left soio nr aione with the responsibility of p a r e n t h o o d while the spouse
is d e l a i u c U ur is serving sentence foi a criminal conviction for at least one (1)
year.

d) Parent left solo or alone with the responsibility of parenthood due to physical
and/or inentttl incapacity of spouse as certified by a pubiic medical practitioner.

e) Parent left solo or alone due to legal separation or de facto separation from
spouse for at least one (1) yeat as long as he or she is entrusted with the
custody of the children

f) Parent left solo or alone due to declaration of nullity or annulment of marriage


as d e c i e e d b y a court or by a church as long as he/she is entrusted with the
custody of the children.

g) Parent left solo or alone w i t h the responsibility of parenthood due to


a b a n d o n m e n t of spouse for at least one (1) year.

h) U n m a n led father/mother w h o has preferred to keep and rear his/her


child/children instead of having others care for them or give them up to the
welfare institution

t) Any other person w h o solely provide parental care and support to a child or
children,

j) Any family m e m b e r w h o a s s u m e s the responsibility of h e a d of the family as a


result of the d e a t h , a b a n d o n m e n t , disappearance or prolonged absence of the
parents or solo parent

A c h a n g e in the status or circumstance of the parent claiming benefits under


this Act, s u c h that he/she is no longer left aione with the responsibility of
parenthood shall terminate his/her eligibility for these benefits.

2) C h i l d r e n - refer to those living with and dependent u p o n the solo parent for
support w h o are unmarried, u n e m p l o y e d and not m o r e i h a n eighteen years (18) of age or
e v e n above 18 years but are incapable of self support b e c a u s e of mental and/or physical
defect or disability.

3 t P a r e n t a l l e a v e - as defined by RA 897? refers to leave benefits granted to a


soio patent to enable hitn/het to pet form parental duties and responsibilities w h e r e
physical presence is required

4 t Flexible w o r k schedule - refers to the right granted to a solo parent employee


or worker to vary his/her arrival and departure time without affecting the core work hours
as defined by the employer fRA 8972)

7) Al.S - refers fo the Alternative l earning System

8) DOLE - refers to the Department of i abor & Employment

9) MSCB P refers fo me National Statistical Coordination Board, which attached to


NED A and responsible for determining the regional poverty threshold.

101 NEDA - refers to National Economic Development Authority

11) Republic Ac! 8972 - refers fo an Act providing for the benefits and privileges
to solo parents and their children, appropriating funds therefore, and for other purposes.

12) TESDA - refers to Technical Education and Skills Development Authority.

Section 3. Requirements to aval! of programs and services:

a Certificate of Residency from the barangay concerned that applicant Is a


barangay resident of such barangay in the City of Bacolod for at least six (6)
months

c Proof and/or documents of being a solo parent.

d Barangay Certification or Affidavit as to the income of the applicant, showing


thai his/her income falls equal or below the poverty threshold as set by
National Statistical Coordination Board fNSCB), per Section ? of the IRR of RA
8972.

(The latest, 7006 monthly poverty threshold of the Province of Negros


Occidental which Bacolod City is included, per attached reference, is
Php 13.972.00)

Section 4, Issuance of Solo Parent's ID - In issuing for the solo parent's ID. for
purposes of availment of an appropriate services from agencies concerned, the DSSD or
its authorized personnel shall see to it that the following information shall he reflected at
the back of such ID

a An information, that a solo parent is "An Indigent," if a hearer of such solo


parent iD is an indigent.

b. A n information that the solo parents Income falls or below monthly poverty
Slireslioiu", if a bearer of such soio parent IDs
income falls or below monthly
poverty threshold (The latest 2006 monthly poverty threshold is Php 13,972,00)

c An information that the solo parent's "income is above monthly poverty


itifeshuid"; if *4>earer of such solo parent's ID belongs to such category.

d Solo parent's ID issued by the DSSD which is signed by the DSSD Head
him/herself and ihe City Mayor upon payment of Php 100.00 to the City
Treasurer's Office

On the said ID the names of solo parent's dependents with their


coiresponding age shaii also be slated therein.

Section 5. Programs and Services to Solo Parents - The following are the
services that shall be extended to the solo parent indigents and to those who fail beiow
poverty threshold'

a I ivelihood assistance and skills training or capacity building from the City thru
ihe City Coopeiaiive & Development Office (CCLDO).

b TFSDA I .ivelihood and Skills Development Programs

c DOLE Program on Self Employment and Entrepreneurship Development


(SEED)

d DSSD assistance or thru SEA-K or Self Empowerment Assistance-Kaunlaran

Section 6. Employment Related Benefits to the Solo Parents

a Aside from the benefits he/she enjoyed Solo parent empioyeeAvorker who has
rendered at least one (1) year of service to the city government or private
company/entity (whether continuous or broken) shall be granted seven (7)
days parental leave every yeas. To facilitate the hereto benefit granted, with
•he presentation of Solo Parent's ID issued by the DSSD solo parent shall
notify the employer for such availmenl.

b Flexible work schedule shall be given to the solo parents by the City in the
case of public employees, and by the management in the case of private
business as the case may be

However in the case of the City government, such flexible work schedule,
upon pioper evaluation shali be subject to the disci etion of the department
head

And in the case of private business, the work schedule shaft not effect
company's, productivity. And. any employer may request an exemption of such
requirements from the DOf F en meritorious ground

c. Soto parents shall he protected against work discrimination in their work


station.

Section 7, Housing Benefits - Solo parents who meet the qualification under the
Republic Act 7279 shall be given housing assistance by the Bacoiod Housing Authority
Office (BHA) Furthermore, indigent poor and homeless solo parent must be given
priority in the City's seiocation site.

Section 8, Psycho-Social Services for at! Solo Parents as Intervention, under


Republic Act # 8972, and hereof adopted under this Ordinance, including the following;

a. Individual counseling from appropriate government agency

b Peer group counseling

c Family counseling

d Organization of Solo Parents Club or Associations

e Accessing refetrats from support services: like education, health, medical.,


burial, etc.

Section 9, Education services thru the following agencies (RA 8972):

DEP-EO - Won formal appropriate education program, e g Alternative Learning


System or ALS.

TFSDA - Technical amVor vocational education

- Private Education Student Finance Assistance (PESFA). thru R.A. 8372

CHED - Scholarship program for qualified solo parent and their children In basic
tertiary and technical education

- Study gran!

Applicant procedure:

1, Applicant must secure application form from either DepEd, CHED and TESOA.
depending on their need.

2. Submit the duly accomplished application form, together with the required
documents io She appropriate agency.

The following are the required documents to be attached with the application to
either DepEd, CHED and TESDA;

1) Solo ParenllD Card

2) Barangay Clearance

3) Birth Certificate

4) Notice of Admission from the School

5) Report Card of last year the applicant attended school or Original or certified
true copy of Tianscript of Records

Section 10. Health Services - in addition to the health benefits under RA 8972,
indigent soio patents shall enjoy free iaboiatory fees, free X-ray and free tooth extraction,
upon presentation of Soio Parents ID

Section 1 1 . implementing Rules and Regulations (iRR) - A Committee under


I his Ordinance shall be cseated to come up the implementing Rules & Regulations 'within
Sixty (60) Days upon the passage of this Ordinance which shall be submitted to the
Sangyuniang Paniungsod foi ratification This committee shall compose the following
offices which will be represented by its respective heads.

1 Department of Social Services & Development (DSSD) - Convenor and lead

office.

? City Health Office (CHO)

3 City Cooperative and I ivelihood Office (CGI DO)

4 Department of Interior & I ocal Government (DH 6 ) - Bacolod Office

5 Commission on Higher Education (CHED) - Bacolod

6 Technical Fducahon and Skills Development Authority (TESDA) - Negros

7 Department of Labor & Employment (DOLE) - Bacolod

DOH - Western Visayas Regional Hospital, Lacson St., Bacolod City

Section 12. Funding - For an effective implementation of this Ordinance, a


certain budge! from G A D budget shall be yearly allocated.

Section 13. Separability C l a u s e - If any provision of this Ordinance is held


invalid, other provisions not affected thereby shall conlinue to be in full force and effect.

Section 14, Effeetivfty C l a u s e - This ordinance shall fake effect Fifteen (15)
days after its publication in a newspaper of general circulation in the City of Baco'od,
