We are pleased to inform you that we have decided to award you civil work of above contract
on the basis of ‘Measure and Pay Fixed Rate type of contact’ amounting Rs. ……………………

By this letter of award we request you to commence the above mentioned work subject to the following
conditions and as per the tender and post-tender negotiations. This letter of award and the agreements
reached during the post tender negotiations will supersede the original tender conditions where they
contradict each other.

1. This shall be a Fixed Rate type of contract not subject to fluctuations of prices of materials, labour,
transport, exchange rate, customs rate of exchange duty, and other related costs.

3. The Contractor shall within 7 days of this letter obtain a valid Advance Bond (en-cashable on demand),
Contactors All Risk Insurance Policy and Insurance for Workmen’s Compensation as per the tender
document and submit same for the Architects / Consultant’s scrutiny

4 The Contractor shall not and without having received the written permission of the Owners, interfere
with, interrupt in any way the operation of any Existing Services such as water, sewer drains, electricity
cable etc.,

 5. Payment terms shall be as follows:

a) Advance payment as follows,

( Rs. ……………….) is paid to the Contractor on submission of a valid advance
payment guarantees obtained from a Commercial Bank registered with the Central
Bank of Sri Lanka (en-cashable on demand) along with other pre requisites stated
in the letter of award.

b) The Interim Payments shall be made as per the terms referred in the contract bidding document.

c) Final payment shall be certified within one calendar month along with the Certificate of
Completion issued by the Architects /Cost Consultants and Owner's Representative.

d) Sri Lanka Government Taxes will not be paid

2. ln the event of variations, the rates to be used for pricing such variations shall be the rates agreed in
the Bill of Quantities (Inclusive of all discounts & revisions) wherever applicable and where not
available, the Contractor shall submit rate with breakdowns when requested by the Architects /
Consultants and shall be subject to negotiations and agreement.

3. The Contractor shall upon and subject to these conditions carry out and complete the work shown
in the Drawings, Specifications and as described by or referred to on these conditions in every
respect to the entire satisfaction of the Architects / Consultants

4. The Contractor shall comply with the specifications agreed upon in the tender and in the post tender
negotiations and all letters of correspondence between the Architects / Client and the Contactor as
agreed during post-tender negotiations shall form part of the contract.

5. Until such time, a properly formulated contract incorporating all the terms and conditions in the
tender are signed, this Letter of Award shall constitute a Binding Agreement between us and the
Contactor.

6. Consultants to this Project are D PLUS Architects (Pvt) Ltd and they are authorized to act on behalf
of the Client during the entire construction period. All correspondences / payment claims in this
regard are to be directed to them and copied to the clients representative at all times

7. The Contractor shall, on receipt of this letter sign and return same to us, within two days confirming
his acceptance.
