JOINT AFFIDAVIT

WE, WILLIAM Y. HOW, SR. and CORAZON E. ESCLETO, of legal ages,


Filipino citizens, both married, with residence and postal addresses at 5 Joya St.,
Corinthian Garden, Quezon City and ASC T2 5th Ave., Cor. P. Tuazon Blvd., Brgy.
Socorro, Cubao, Quezon City designated as President and Sales Coordinator
respectively, by UNIVERSAL AQUARIUS, INC. with business address at 158 P. Tuazon
Blvd. cor. 7th and 8th Avenues, Brgy. Socorro, Cubao, Quezon City, after having been
duly sworn in accordance with the law, do hereby depose and say:

That UNIVERSAL AQUARIUS, INC., is a PDEA license holder with PDEA


License Nos. P51/P5C/P5DW1/P5DW2/P5DW3/P5DW4-012640001;

That on June 10, 2009, PDEA Regulatory Compliance Officers conducted an


inspection of Universal Aquarius, Inc. Based on the Notice of Violation dated June 10,
2019, the following discrepancies/violations were noted:

“SOLD HCL TO ENTITY & EXPIRED LICENSE, ZEST-O


CORPORATION MANDAUE:
- ZEST-O CORPORATION LICENSE EXPIRED LAST 10/07/2018.
- ZEST-O CORPORATION IS A HOLDER OF P3-017990005-R084-H
LICENSE
- UNIVERSAL AQUARIUS, INC. TRANSACTED WITH ZEST-O
CORPORATION ON 11/13/2018, 12/29/2018, 2/11/2019, 4/1/2019
and MAY 20, 2019 (DR ATTACHED)”

That in the said Notice of Violation, we were required “to submit a joint affidavit
on the noted discrepancies/violations, its root cause, the corresponding corrective
actions that shall be instituted and assurance of non-recurrence” before/on June 18,
2019;

That in compliance with the directive in the said Notice of Violation, we are
submitting herein Joint Affidavit;

That the sale/transaction to Zest-O Corporation-Mandaue, Cebu, despite its


expired license, was mere inadvertence and purely unintentional;

That Universal Aquarius, Inc. supports the intent of PDEA and agrees to the
rationale behind its Rules on the delivery of precursor and essential chemicals. In fact, it
has an internal rule dated December 23, 2016 (copy attached) on securing PDEA license
from its customers before deliveries can be made, to wit:

“Please be informed that effective immediately, it is the


duty/responsibility of every Sales Coordinator/Personnel to secure
UPDATED PDEA LICENCE from assigned customers or accounts.
Temporary PDEA License cannot be used anymore. NO DELIVERIES BE
MADE FOR NO UPDATED PDEA LICENSE for customers buying PDEA
Controlled Precursor and Essential Chemicals.

This is in conformance with the strict implementation of PDEA’s Ruling


in Precursor and Essential Chemicals.
For your strict compliance.”

That we shall undertake the following corrective actions:

a) Strict implementation of the internal rule dated December 23, 2016;

b) Monitoring of compliance with the said internal rule; and

c) Proper coordination between the Sales Department and Corazon E.


Escleto, PDEA-registered signatory.

That you may rest assured that this incident will not happen again.

That, for and in behalf of our entity and by virtue of this Joint Affidavit, we
hereby bind ourselves to all the provisions of Republic Act 9165 otherwise known as the
“Comprehensive Dangerous Act of 2002,” and its Implementing Rules and Regulations
and assuring that such law and regulations shall be faithfully complied with;

That we are executing this Joint Affidavit to attest to the truth and veracity of the
foregoing facts, and for whatever legal intent and purpose it may serve.
