Motion to Withdraw as Co-Counsel

COMES NOW, Mark Herron, co-counsel of record for Respondent in this matter, and

respectfully requests leave to withdraw as co-counsel pursuant to Rule 28-106.105, Florida

Administrative Code, and states as follows:

1. Benedict P. Kuehne was retained to represent the Respondent in this matter

before the Commission on Ethics.

2. During the course of the proceedings before the Commission on Ethics, Mr.

Kuehne requested that Mr. Herron appear in his stead at the probable cause hearing before

the Commission on Ethics on January 25, 2019.

3. Mr. Herron will not participate in the proceedings before the Division of

Administrative Hearings in this matter.

4. There is no prejudice to the Respondent if Mr. Herron is permitted to withdraw

as co-counsel, inasmuch as Mr. Kuehne is and remains counsel for Respondent in this

matter.
