MEMORANDUM OF AGREEMENT

KNOWN ALL MEN BY THESE PRESENTS:

This MEMORANDUM OF AGREEMENT entered into, by and between:

SOUTHERN LUZON STATE UNIVERSITY, a state university, organized and existing

under the laws of the Republic of the Philippines, with principal office address at Quezon Ave.,
Brgy. Kulapi, Lucban, Quezon, represented by its OIC PRESIDENT, MARISSA C. ESPERAL,
PH.D., and herein referred to as the “FIRST PARTY”

- and -

______________________________________, a corporation/establishment duly

organized and existing under the laws of the Republic of the Philippines, with principal place of
business at ______________________ represented by its
__________________________________________, and herein referred to as the “SECOND
PARTY”.

WITNESSETH:

WHEREAS, bonafide students of the FIRST PARTY who are currently enrolled in
Practicum/On the Job Training/Internship are required under their curriculum to undergo
practicum training;

WHEREAS, SECOND PARTY has agreed to accept the students of the FIRST PARTY
as trainees, and be accredited as a training center for students under the FIRST PARTY’S
practicum program;

NOW, THEREFORE, for and in consideration of the foregoing premises and stipulations
herein set forth the parties entered into this Agreement under the following terms and
conditions:

Section 1. OBLIGATIONS OF THE FIRST PARTY:

1. Upon signing this Agreement, recognize the students who will undergo the practicum
training at the SECOND PARTY’s premises, as provided in the list. A copy of said list
of students is hereto attached as Annex “A”;

2. Shall be under obligation to conduct the necessary orientation upon its students
relative to office decorum and discipline, and other rules and regulations necessary
for the proper administration of the practicum program; and

3. Shall be under obligation to monitor the individual performance of its students and
undertake measures to ensure faithful compliance with this Agreement.

Section 2. RIGHTS AND OBLIGATIONS OF THE SECOND PARTY:

1. Shall provide the necessary practical training to the students of the FIRST PARTY;

2. Shall provide the students of FIRST PARTY, a defined program of activities and/or
assignments with the necessary facilities based on its regular office workload;

3. Shall not be under obligation to remunerate the students or afford them benefits
usually given to its regular employees other than those voluntarily given, as there
exists no employer-employee relationship between SECOND PARTY and students of
the FIRST PARTY;
 4. Shall ensure that the students of the FIRST PARTY are amply protected from
harassment, exploitation or any incident which shall put under peril their life, health
and honor;

5. Shall allow the authorized representative of the FIRST PARTY to visit/monitor the
students in the actual place of work;

6. Reserves full discretion to screen and evaluate the individual competence of the
student’s performance, attitude or behavior;

7. Shall fill out the necessary evaluation form/s from FIRST PARTY in relation to the
students’ performance both in practical and theoretical aspect of the training;

8. Reserves right on whether to allow or not to reproduce, approved and signed report
of students of FIRST PARTY for verification purposes;

9. Shall provide humane condition of workplace and never assign the students in a
work which will endanger their health and safety;

10. Liable for any loss, damage or injury that the students may suffer during the period of
practicum whether intentional or negligent act on the part of the latter; and

11. Shall not require the students to perform work during weekends and holidays as well
as overtime work unless appropriate compensation shall be given.

Section 3. GENERAL TERMS AND CONDITIONS:

1. Students of the FIRST PARTY who shall successfully complete the practicum or OJT
program shall be entitled to a curricular credit of ___ units;

2. Students of the FIRST PARTY shall be required to report at the office/designated site
of the SECOND PARTY, punctually and regularly, depending on the students’ class
schedule and training program for the required ____ hours;

3. PARTIES shall be under joint obligation to promote the welfare of the students and
assist in the formation of their intellectual, moral and professional competence;

4. PARTIES shall be bound by the following system of grading the students:

(a) Grading period shall be based on the schedule provided by the FIRST PARTY;
and
(b) SECOND PARTY, through its Coordinator/In-Charge of the
practicum/OJT/internship, shall provide Seventy-five percent (75%) of the
weighted average for the practicum period while FIRST PARTY through its
assigned FACULTY/OJT Coordinator shall provide Twenty-five percent (25%) of
the weighted average for the same practicum period;

5. PARTIES shall endeavor to base the grades or rating of the students on the
following:
(a) Attendance/Punctuality;
(b) Competence/Dependability;
(c) Accuracy/Effectiveness;
(d) Interest/Cooperation;
(e) Personality/Interpersonal Relations.

Section 4. EFFECTIVITY.

This Agreement shall commence on __________________ and shall terminate upon

completion of the number of hours required, unless otherwise suspended, revoked or extended
by either party upon serving a seven-day prior written notice.

consisting of three (3) pages, including the page on which this Acknowledgment is written, duly
