on the Formal Offer of Evidence

Defendants by the undersigned counsel respectfully file this comment to

the Formal Offer of Exhibits of the Plaintiffs.

The said comments on the plaintiffs’ exhibits are as follows:

Exhibit “A”, being offered by the plaintiffs as document to prove that

Plaintiff Rosefina Montera Cusay is the legal wife of the deceased Florentino

Cusay, who is the co-owner of the property described under TCT No. 117616 of

the Register of Deeds of Manila, is admitted as existing material but cannot be

admitted as evidence since this is self-serving.

 Exhibit “B”, being offered by the plaintiffs as document to prove that the

deceased husband of the plaintiff is the co-owner of the property covered by TCT

No. 117616, is admitted as an existing material document but cannot be admitted

as evidence since this is also self-serving.

Exhibit “C” to “C-2”, the decision dated July 23, 1990 of Branch 1 RTC

Manila in Civil Case No. 102764, is admitted as an existing material document

but cannot be admitted as evidence since these are self-serving.

The Prayers

WHEREFORE, it is respectfully prayed that this Honorable Court deny

the admission of the evidences being offered by the Plaintiffs in relation to

comment specified herein. Other just and equitable relief is also prayed for.

Explanation

Copy of this Comment on the Formal Offer of Evidence was served on the

other party by registered mail with return card due to distance and lack of

personnel hence personal delivery is impracticable.
