JUDICIAL AFFIDAVIT OF PETITIONER

I, BEA ALONZO ANDERSON, of legal age, married, Filipino and a


resident of No. Blk.6 Lot 10 Pine Drive St. The Monford Subdivision,
Camarin, City of Manila petitioner in this case, after having been duly
sworn, hereby attests that:

PRELIMINARY STATEMENT

The person examining me is ATTY.

Abong, Patajo, Quimpo and Associates 8/F High Street South
Corporate Plaza, 9th Ave. Cor. 26th St., Manila City. The examination is
being held at the same address. I am answering her questions fully conscious
that I do so under oath and may face criminal liability for false testimony
and perjury.

PURPOSE: This affidavit/testimony of petitioner BEA ALONZO


ANDERSON is being offered to prove that the respondent GERALD
ANDERSON contracted marriage with her on June 20, 2016 at the Mt.
Carmel Shrine Parish, Broadway Avenue, New Manila, Quezon City and
that be legally separated under Article 55 of the Family Code on the grounds
of repetitive physical violence, contracting a bigamous marriage and
abandonment.

1. Q: Please state your name and other personal circumstances


for the record

A: I am Bea Anderson Alonzo , 27 years of age, married, Filipino


and resident of B6L10 Pine Drive St. The Monford Subd.
Camarin, Manila City;

this case?

A: Yes, Atty.

3. Q: How are you related to Gerald Anderson, the respondent of
this case?

A: He is my husband, Atty.

4. Q: Do you have proof your marriage with Gerald Anderson?

A: Yes ma’am. I have a NSO Certified marriage contract as my


Exhibit "A"

5. Q: When was your marriage with respondent celebrated?

A: Our marriage was solemnized on June 20, 2016 at Mt. Carmel


Shrine Parish, Broadway Ave. New Manila, Quezon City

6. Q: How/ when did you meet your husband?

A: At Dream Boy Bar and Restaurant in Tomas Morato Atty.


when I was working as a waitress in the said bar and restaurant.

7. Q: How did your relationship start?

A: After casual meeting, he asked for my celphone number and


started texting me everyday.

8. Q: After that, what happened?

A: We became sweethearts Atty. He asked me to quit my job and


offered to support me if I will live with him. He even promised

to buy a house and lot for us if I will agree to such
arrangement.

9. Q: What was your response to his offer?

A: I told him that I do not want a live-in relationship. I also told


him that I will only live with him unless he marries me.

10 Q: What happened after that?

A: We tied the knot on June 20, 2016.

11 Q: How would you describe your marriage with the


respondent?

A: At the early stage, it was all good. He showered me love and


care. He bought a house in Corinthian Gardens and it became
our conjugal home.

12 Q: What do you mean by “at early age it was all good”?

A: At first, he was a loving husband until suddenly he became


extremely jealous without justifiable reason and locked me in
our home whenever he leaves for work.

A: He did not allow me to leave the house without his permission.

14. Q: What happened after, if any?

A: He started going home late. I tried to look for him but he was
not there for me during the most difficult time of our marriage.

15 Q: Did you seek any help from your family and friends?

A: Yes Atty. I asked my mother to live with us in our conjugal


home so I can have someone to talk to and help me to cope up
with my situation and resolve my problems.

16 Q: What happened afterwards?

A: I followed my mother’s advice to become patient with my


husband. I hoped and prayed that my husband would change.

17 Q: How many years have you been married?

A: We’ve been married for three years, Atty.

18 Q: Do you have children with the respondent?

A: None, Atty.

19 Q: Can you narrate to this court, how did your marriage


problems become worst?

A: I have learned from friends that my husband was dating other


women and flaunted them in public places. It caused me so

much pain and humiliation.

20 Q: Did you confront your husband about his illicit affairs?

A: Yes Atty. Upon knowing such fact, whenever he arrives at our


home, I tried confronting him about his affairs with other
women which often results to several heated arguments.

21 Q: What happened after that?

A: Every time I confronted him about his womanizing and lack of


affection towards me he verbally abused me and threatened to
throw me out of our conjugal home if I did not stop
complaining.

22 Q: Did he physically hurt you?

A: Yes Atty.

23 Q: When did this happen?

A: On or about the month of October 2016, our argument became


more intense. He slapped me and kicked me hard that I fell on
the floor. While I was lying on the floor and agonizing with
pain, he drew a gun and pointed it to me. He angrily shouted
that: “Pag hindi mo ako tinigilan ng kakadakdak mo, papatayin
kita!” (Copies of Brgy. Blotter and Medical Certificate are in
Exhibits “B” and “C” )

24 Q: What did you do after that incident?

A: I went to the Barangay and reported it. I also had myself


examined at Medical City to seek medical attention for my
bruises and contusions.

But despite the emotional trauma and physical abuse, I decided


to stay in our conjugal home and held on to our marriage.
Unfortunately, my husband avoided any sexual intimacy and
showed no remorse of what he did to me.

25 Q: What made you decide to stay despite the maltreatment


and cruelty of the respondent?

A: Because I was jobless and financially helpless. I am wholly


dependent on my husband.

26 Q: Why are you now filing a petition for Legal Separation?

A: Because I cannot tolerate anymore this kind of humiliation and


blatant disregard of our marital vows and obligations. Based on
his acts towards me, he had totally abandoned me. At this time,
he never bothered to return to our conjugal home. As a
consequence, I decided to leave our conjugal home because I
felt so humiliated and hurt.

27 Q: Can you tell this court what exactly did you mean?

A: I discovered through Wilson Castro, my husband’s personal


driver that my husband was living with a woman named “Julia”
where he bought a brand new house in Paranaque. I also

learned from my mother-in-law that my husband contracted
another marriage with her other woman Julia Baretto on
September 23, 2016. What’s worse, they are now living in our
conjugal home in Corinthians Garden where he introduced her
to the Homeowners’ Association as his new wife.

28 Q: I have no other further any questions, do you have anything

29 Q: Are you willing to sign this judicial affidavit?
