Occupational Safety and Health Act 1994

Group Discussion

Three people were killed and another 2 injured one of them in serious condition, when a
tank of raw methanol gas at the A (M) Sdn. Bhd factory at the Pelangi Johor exploded in
June 2006.

The explosion occurred when the five victims, working for B (M) Sdn. Bhd, the contractor
hired to do the maintenance work, were working about 11.40 am.

The dead were identified as Mr. X, Mr. Y and Mr. Z from Johor Bahru. Mr. K, from Kulai
suffered serious injuries and was admitted to Hospital Sultanah Aminah Johor Bahru while
Mr. L from Senai suffered minor injuries and was given outpatient treatment.

The exact number of workers from the maintenance company who were working in the area
during the incident was unclear. A (M) Sdn. Bhd produces raw fatty acid from palm oil and
glycerin for cosmetics and detergents, started operations in Johor 15 years ago.

During the incident, the factory had been closed for annual maintenance work from May 18
to June 19.

The factory’s managing director said two explosions were heard when the workers from the
maintenance company were carrying out their work near the tank area.

He said the blasts caused a fire to break out at the factory but the blaze was put out within
20 minutes by a team from the Fire and Rescue Department, Hazardous Material Response
Team and the factory’s auxiliary fire fighting unit.

The three victims who died are believed to have been thrown up into the air by the impact
from the blast and hit the steel roof, according to a witness who did not want to be
identified.

They were said to be welding the gas pipe and are believed to have been unaware of a leak
in the gas pipe and the sparks from the welding set caused the explosion.

Survivor Mr. L said he was in a room next to the site where they were carrying out the
welding work.

CASE STUDY FOR CPL REGULATIONS 1997 AND USECHH REGULATIONS
2000

On 1st June 2005, 11.30 am, SA Supplier approach QA Engineer of F Company and shows
a free sample of chemical which according to SA Supplier, the chemical will solve a lot of
quality problems and hence improve productivity and efficiency. QA Engineer excited
about it and accepts the free sample.

At 2.00 pm, QA Engineer asks Sarah Operator to run tests on the chemical in the
laboratory. Sarah Operator conducts the test as per directed by QA Engineer without
further question.

After carrying out the tests for 3 hours, Sarah Operator feels sick and suspects it must
because of the chemical. Sarah Operator goes to their in-house clinic to seek treatment

OSH LEGISLATION CASE STUDY

QUESTION 1

Clean Water Sdn. Bhd. is a Water Treatment Plant company in Selangor. It has 44
workers; 30 are permanent workers while 14 are workers from it sub-contractor Sure
Clean Sdn. Bhd.

Clean Water Sdn. Bhd. has been in operation since 1998. The activities cover from
filtering process, treatment and supply the clean water to the residential area within
Bandar Api-Api.

The Water Treatment Plant covers an area of 1 hectare. In the plant there are 4 water
pumps, 2 electric gantries crane 5 tones, 1 forklift, 1 generator and 3 air compressor.
There is also a chemical store storing few containers of liquid chlorine, each weight 30
kg. There are also other chemicals stored in the chemical store mainly chemicals for the
purpose of water treatment.

12 Jan 2001, 9.30 pm, 1 of the 3 air compressor burst and causes a serious damage to
the chemical store. DOSH officer who investigate the accident found that the air
compressor is just undergo maintenance work by Renti Sdn. Bhd another sub-contractor
for Clean Water Sdn. Bhd. Records showed that the sub-contractor just placed a piece
of metal and weld it to cover the damage area of the air compressor.

The overall investigation found that a there were few serious accidents and poisoning
cases happened 2 years ago but not being reported as the injured workers were not
their workers.

Inspection also found that all the machines installed in the plant are not approved by
DOSH and some of them which require Certificate of Fitness do not have it.

There is also no complete inventory on the chemicals and the containers are without
label. Interviews have been conducted among the workers and they express that they
are not given any training and information about the health effects of the chemicals
they used in operation.

Case:

A worker who was working on a stepladder to replace a fluorescent lamp fell because he
lost his balance when goods on a hand truck being transported by another worker
dropped and hit the stepladder.

Conditions at the time of the occurrence of the accident

A brief meeting was held from 8.30 am (working start time) and the work started
immediately after the meeting.

Mr. A overslept and did not able to eat breakfast rushed to work by car. On the way, he
was trap in traffic and came to work at 8.50 am. The briefing meeting was over at that
time.

Mr. B, Supervisor, instructed Mr. A to transport goods that were prepared on the
previous day. In order to carry the goods quickly, Mr. A was hastily pushing a hand truck
loaded with more goods than usual (goods were stacked so high that he could not see
ahead very well). Mr. C from maintenance department, was working on the stepladder
(150 cm in height) to replace a fluorescent lamp that had burned out. He was standing
on the top plate of the stepladder as he could not reach the fluorescent lamp. When
Mr. A’s hand truck passing by Mr. C, it got stuck on waste materials (made of metal) left
in the passageway, and the goods on the hand truck fell and hit the stepladder, making
the stepladder swaying. Mr. C lost his balance and fell from the stepladder, striking his
back and head against the floor. When Mr. C fell from the stepladder, he lost his safety
helmet.

Mr. B rushed to Mr. C and asked him about the condition of his injury. He said, I’ll be all
right if I take a rest for a while and apply a compress to my back.” Mr. C engaged in his
office work until closing time. Mr. C than returned home, and he had a severe headache
late at night, and was send to a hospital by ambulance, and was immediately
hospitalized for examinations. He has been hospitalized since then.
