RIGHTS OF AN AGRICULTURAL LESSEE:

1. Peaceful possession and enjoyment of the land.


2. Manage and work on the land in a manner and method of cultivation and harvest which confirm to proven farm
practices;
3. Mechanize all or any phase of his farm work;
4. Deal with millers and processors and attend to the issuance of quedans and warehouse receipts for the produce
due him;
5. Be afforded a homelot;
6. Be indemnified for the cost and expenses incurred in the cultivation, planting or harvesting and other expenses
incidental to the improvement of his crop;
7. Buy the agricultural landholding at a reasonable terms and conditions in case the agricultural lessor decides to
sell the same;
8. Redeem the landholding at a reasonable price and consideration in case the agricultural lessor sold the same to
a third person without his knowledge;

OBLIGATIONS OF AN AGRICULTURAL LESSEE:

1. To cultivate and take care of the farm as a good father of a family and perform all the work therein in
accordance with proven farm practices;
2. Inform the agricultural lessor within a reasonable time of any trespass committed by third persons upon the
farm, without prejudice to his direct action against the trespasser;
3. Take reasonable care of the work animals and farm implements delivered to him by the agricultural lessor.
4. Keep his farm and growing crops attended to during the work season;
5. Notify the agricultural lessor at least 3 days before the date of harvesting or, whenever applicable, of threshing
6. Pay the lease rental to the agricultural lessor when it falls due.

Note:

-Land classification in the tax declaration is not conclusive. (Republic vs. CA)

-Lands classified as non-agricultural prior to the effectivity of the CARL are not covered.

-Lands ADE used and found necessary for school sites and campuses are exempted from the coverage of Agrarian
Reform. The School is in the best position to determine whether the land is necessary for use as school site or
campuses. The DAR has no right to substitute its judgement or discretion for that of the school. (CMU vs. DARAB)
