Final Examination – N4

1. Does your employer have the right to read the e-mails on your work account?
Should your employer be allowed to monitor your web-browsing history? Can you
be fired because your boss read the disparaging comment you made about your
employer on your Facebook page?

In this case no one can intrude and monitor one’s e-mail accounts or even the
web-browsing history of it because this is or are considered as one of the private
thing that a person, special an employee have. Firing once employee is not also a
good action in knowing or having knowledge in a disparaging comment on
Facebook page or even in other social media.

Each and every person have the right to be respect in their private life, even a
family member or a very close friend of you mine doesn’t have the right to read,
monitor or even intrude to my account in social media apps likewise to my
employer it doesn’t have any right to do such action like firing me in my job just
because i commented a degrading comment in social media about my employer.

In such action as an employer can talk to me privately about what I’ve done my
employer should make me explain why I did such thing, because firing once
employee in not a good solution and a humanitarian act.

2. If you work in a human resources department and were responsible for hiring,
would you ‘Google’ or visit the Facebook page of a potential employee and use the
information you found there in your hiring decision? Do employee rights to privacy
override an employer’s right to hire or fire?

This case is similar to the first case it is also about the privacy, rights and duties
between the employee and its employer. As I said in the first case no one can
intrude your private life by means of browsing and searching you in social media.
Let state that I am the employer, I should know to myself the meaning of private
property. I should not use my position to do such thing because even a president
of the company doesn’t have the right to Google or even visit his or her account in
social media just to make sure the he or she is fit to the job he or she applying of.

Hiring or even firing an employee doesn’t depend on what he or she posted. But
in the other side as a professional or even just a simple person we should be
responsible in what we are posting and commenting in the social media because
nowadays almost all of us have already or engage in social media app.
However no one cans judge anyone just because in what they are seeing in social
media that we are engage in.

3. Holly has been working at a large construction company for three years. Although
an intern, Holly has earned the respect of her peers. Her supervisor (and project
manager), along with her co-workers, constantly support her by teaching her new
materials and encouraging her to tackle new tasks. For one specific project, her
supervisor chose her to visit the jobsite for the construction of flood retaining walls.
Holly is familiar with the protocol required by her company, and her boss trusts her
to always wear protective equipment every time she goes into the field.
However, when she went to the job site for this project, she heard someone yell, “Be
careful not to break a nail!” while she was walking down a particularly steep mud
slope. She dismissed the comment at first, but throughout the remainder of the
project, different construction workers would make condescending remarks and
gestures at her. They would call her ‘Princess’ or hold out their arms as though
expecting her to fall, slip, or hurt herself.
Holly feels she is being treated disrespectfully because of her gender, but never
brings it up to her supervisor as the workers were subcontracted from various
companies by the General Contractor. Holly doesn’t feel right getting other people
in trouble for such little comments, and is worried long term about how her success
might be affected if she makes a complaint.
Should Holly say something?

First no one should disrespect other, not because you are a man you can already
bully or disrespect a woman, all should be treated and respected equally.

If I were Holly and I experienced that kind of action from the construction
workers, if I is the first time I can let just ignore it. If it happens for the second
time and every time I will visit the site they will do such kind of action towards
me, I will already report and make an action about it.

As a woman it will be uncomfortable to me if every time I visit the site the

workers will disrespect me, I might feel unsafe because when time pass it is not
the only thing that they will do to me.

So as an action to that disturbing gesture that the workers are doing to me I will
report it to my supervisor. I will not hesitate to do that because it is the right thing
to do and I know that my supervisor will understand me reporting such action.
And if I think that it will affect my success if I were to complaint, I know that
they don’t have any good reason to do that just because I complaint. I know every
person have the right to that whenever they feel disrespect by others.
