MEMORANDUM OF UNDERSTANDING

KNOW ALL MEN BY THESE PRESENTS:

This MEMORANDUM OF UNDERSTANDING is entered this _____ day of

__________________, 2019 by and between:

The LTO National Capital Region East, herein represented by its Regional
Director, BENJAMIN V. SANTIAGO III, with office at 3/F Left Wing Building, LTO
Compound East Avenue, Quezon City, hereafter referred to as the LTO-NCR EAST;
Regional Director, Land Transportation Office

and
BENJAMIN V. SANTIAGO III

The Department of Education (Dep Ed) -National Capital Region (NCR), a

government institution created by Republic Act No. 9155, also knowns as
“Governance of Basic Education Act of 2001.” with principal office at DepEd
Complex, Meralco Ave., Pasig, Metro Manila Misamis St. , Bago Bantay, Quezon
City represented by its Officer In-Charge, Office of the Regional Director
WILFREDO E. CABRAL, Director III hereinafter referred to as “Dep Ed-NCR”.

WITNESSETH:

WHEREAS, LTO is the primary government agency that implements

Republic Act No. 4136 otherwise known as LAND TRANSPORTATION AND
TRAFFIC RULES, and other existing Traffic laws;

WHEREAS, LTO seeks to improve the quality of service it offers and delivers
to the public, as well as, to professionalize the level of training, expertise and
knowledge of its respective employees for the benefit of its stakeholders’ particularly
the drivers, motor vehicle owners and conductors;

WHEREAS, to attain the objective, LTO shall seek the assistance of the Dep

Ed to integrate the basic road safety and comprehensive driver’s education in the
enhanced basic education curriculum (K-12 program);

WHEREAS, Dep Ed, is mandated by law to undertake, among others, the

following:

1. To provide the framework for the governance of basic education setting the
general directions for educational policies and standards; and

2. To integrate Road Safety and Road Courtesy Education, as part of the

curriculum of Students, both in Primary and Secondary Levels in the National
Capital Region (NCR). This should be one of the Whereas for LTO, then connect
his to the DepEd Mandate of providing framework for governance of basic
education

WHEREAS, LTO, is willing, able and ready to conduct series of

seminar/workshops for the Dep Ed teachers encompassing laws that are necessary
and essential in the preparation and formulation of Road Safety Learner’s Materials.
(Please include this in the term of refernce for the LTO)

NOW, THEREFORE, for and in consideration of the foregoing premises and

the covenants and stipulations hereinafter set forth, the parties have agreed as they
do hereby agree as follows:
 1. Purpose. The purpose of this Understanding is to provide the
framework for a partnership arrangement between the parties to
provide Road Safety Learner’s Materials both in Primary and
Regional Director, Land Transportation Office Secondary Levels in the National Capital Region (NCR);

2. Implémentation. The parties shall make the necessary

arrangements to ensure the satisfactory implementation of the
partnership. Dep ED’s participation shall be done through its
integration of the road safety education in the basic education
curriculum. The parties agree to communicate systematically to
exchange views and report on accomplishments and resolve any
policy issues pertaining to this Understanding. Thus, the parties
agree to work out a plan of action in the formulation of the Road
Safety Learner’s Materials;

3. Terms of Reference

1. That every time the project is to be implemented and

introduced to different schools nationwide, one (1)
representative from LTO NCR East shall assist therein; and

2. That Dep Ed shall assist in developing the “M and E”

framework and provide expertise in the review of program
implementation.

4. Expenses and Cost. LTO shall shoulder the cost and related
expenses in the implementation of the Road Safety Learner’s
Manual. LTO shall provide the necessary materials needed in the
formulation of the Road Safety Learner’s Materials;

5. LTO Composition- A Technical Working Group (TWG) shall be

organized to lead in the integration of Road Safety Evaluator to the
Basic Education Curriculum, which is composed of the following:

The Dep Ed shall provide Technical Expertise in the following

activities:

a. Integrating Road Safety Education to the Basic Education

Curriculum through Mapping;
b. Development of Grade Level appropriate Lesson
Exemplars on Road Safety Education;
c. Development of Grade Level appropriate Learning
Resource;
d. Training of Trainor’s for Road Safety Education Teaching
Integration;
e. Pilot test for Road Safety Education

6. OTHER TERMS AND CONDITIONS

1. Except as may be otherwise stated in this Understanding, no

party shall use the other party's name, copyrights, trademarks,
service marks, trade names or logos in any manner whatsoever
without the other party's prior written consent.

2. Except as may be otherwise stated in this Understanding or

required by law, the parties agree that they shall obtain the
written consent of the other party before this Understanding or
the relationship described herein is published in any
publication, media or marketing material.

3. This Understanding shall contain the entire understanding

between the parties and supersedes any prior understanding

and Understanding between them with regard to the subject
matter of this Understanding. The parties agree to perform all

such acts, and to execute and deliver such other documents or

instruments as may be necessary to carry out the intent of this
Understanding. This Understanding constitutes the legal, valid,
and binding obligation of each party, and shall be enforceable
in accordance with its terms. There are no representations,
Understandings, arrangements or understanding, verbal or
written, between the parties relating to the subject matter of this

 Understanding which are not fully expressed herein. Any
amendment or revision of this Understanding shall be in writing,
dated and signed by the parties.

7. Effectivity of the Understanding. This MOU shall take effect

immediately unless sooner terminated by either of the parties.
Either party may terminate this Understanding, without penalty or
liability, at any time for any or no reason, upon thirty (30) days
written notice to the other party.
