CONTRACT OF EMLOYMENT FOR SECURITY GUARDS

KNOW ALL PERSONS BY THESE PRESENTS:

This Contract of Employment executed this _____ day of ________________ 20____ in


the City of Caloocan, by and between:

M S S E C U R I T Y F O R C E & S E R V I C E S , I N C . a corporation organized and


under and by virtue of Philippine laws, with employer’s clients office at #66 P.
Sevilla St. 3rd Avenue, Caloocan City, represented herein by its Executive
President, Marc Merville T. Orozco and referred to as EMPLOYER;

and with residential address at
__________________________________________________________________

referred to as SECURITY GUARD;

-WITNESSETH THAT-

WHEREAS THE SECURITY GUARD applied for work with the EMPLOYER;

WHEREAS, the EMPLOYER has accepted such application subject to certain terms
and conditions;

NOW THEREFORE, for and in consideration of the foregoing premises and terms
nd conditions set forth hereunder, the parties have agreed as follows:

1. JOB TITLE AND DESCRIPTION – The Employee shall be designated as


SECURITY GUARD.

2. PLACE OF WORK - The SECURITY GUARD shall be assigned to the


EMPLOYER’S project at __________________________________ at
____________________________________________________________
and his tour of duty shall be for a period of _______ hours per day on the
following days of week ______ to ________ subject to overtime work as may
be required by the employer.

3. SALARY – The EMPLOYEE shall receive a salary of


_______________________________ (P______________) as his daily basic
pay.

4. STANDARDS OF PERFROMANCE – The SECURITY GUARD is expected to meet


the following standards of performance in the course of his employment:
a. Very good work performance – as shown by his ability to
perform the nature of the work with the quality required and
within the time specified;
b. Very good attendance record;
c. Compliance with the EMPLOYER’S and EMPLOYER’S CLIENT’S
policies, rules and regulations;
d. Compliance with the terms and conditions of this contract;
e. Integrity, honesty, responsibility, diligence in carrying out
tasks;
f. Loyalty to the EMPLOYER and EMPLOYER’S CLIENTS, as shown
by the SECURITY GUARD’S observance of the rules of
confidentiality, devotion of full time to the EMPLOYER, and
other similar indicators;
g. Ability to work harmoniously with the other employees of the
EMPLOYER and employees of the EMPLOYER’S CLIENTS.

5. REPRESENTATIONS ON QUALIFICATIONS – The Security Guard hereby


represents that he has all the qualifications set forth Rules and Regulations
implementing Republic Act 5487, as amended, as follows”
a. Filipino Citizen;
b. High School Graduate, but preferably with units in college
education;
c. Physical and mentally fit;
d. At least 5’6” in height and waist line not more than 34”
e. Not less than eighteen (18) years of age nor more than thirty-
six (36) years of age; and
f. He has undergone a pre-licensing training course or its
equivalent.

6. NO DISQUALIFICATION – The Security Guard furthermore represents that he


is not suffering from any of the disqualifications set forth in, which include
the following:
a. Having previous record of any conviction of any crime;
b. Having previous record of any conviction of any offense
involving moral turpitude;
c. Having been dishonorably discharged or separated from
employment or service;
d. Being mentally incompetent;
e. Being a user/addicted to the use of prohibited drugs or
narcotics;
f. Being habitual drunkard;
g. Being a habitual violator of company policies;

7. LINCENSE – The SECURITY GUARD warrants that the license to serve as a


SECURITY GUARD, which he represented to the EMPLOYER during the
application period was validity secured from the Philippine National Police-
Security Agencies and Guards Supervision Division (SAGSD).

8. RELIEF - It is the prerogative of the EMPLOYER to transfer its SECURITY


GUARDS from one post to another in the interest of its operations. The
SECURITY GUARD agrees to be assigned or reassigned to any geographical
areas where the EMPLOYER is operating. It is also understood that the
reassignment to another post of the SECUIRTY GUARD in any of the
geographical areas shall not be considered as a termination of his
employment.

9. COMPUTATION AND FREQUENCY OF PAYMENT OF WAGES - For purposes


of computing the SECURITY GUARD’S wages, the cut-off periods shall be on
the 15th and 30th of the month. Wages shall be paid on the 10th and 25th of
the month.

10. MANNER OF PAYMENT OF WAGES - The SECURITY GUARD agrees to receive


his/her salary manually in the office.
11. DEDUCTIONS FROM WAGES – The SECURITY GUARD shall be subject to
deductions for withholding taxes, SSS contributions, Philhealth contributions
and Pag-ibig (HDMF) contributions, Mutual Benefits, cash advances,
paraphernalia, uniforms, shoes, insurance and other deductions authorized
by the SECURITY GUARD.

12. ATTENDANCE RECORD - The SECURITY GUARD shall comply with the
regulations and policies of the EMPLOYER on the recording of his attendance.
This includes reporting to duty 30 minutes prior to actual posting for pre-
posting briefing/orientation on a daily manner.

13. LIMITATIONS IN CARRYING OF FIREARM – The SECURITY GUARD shall carry


the firearm issued to him only during his tour of duty while in proper
uniforms, and within the compound of the establishment which he is
assigned to guard except when he is escorting big amounts of cash or
valuables and upon prior coordination with the nearest PNP units / stations
pursuant to Rule V, Section 3 of the implementing Rules. The SECURITY
GUARD furthermore undertakes to carry only such firearm as is assigned to
him under a duly-issued Duly Detail Order by the EMPLOYER. He shall follow
and comply strictly to the policies of the Company in the carriage of firearm
while in the performance of duty which is “no insertion of magazine” into the
firearm unless in extreme danger to his life.

14. UNIFORMS – The SECURITY GUARD shall wear the uniforms prescribed by
the EMPLOYER, including duly-approved ornaments, patches, equipment and
paraphernalia at all times while in the performance of duty.

15. SECURITY GUARD CREED, CODE OF ETHICS AND CODE OF CONDUCT – The
SECURITY GUARD shall memorize and comply strictly with the Security Guard
Creed, Code of Ethics and Code of Conduct and other security knowledge(s)
of relevance to the performance of his duties and responsibilities as deemed
required by the company and client(s).

16. COMPLIANCE WITH OFFICE POLICIES, RULES AND REGULATIONS – The


SECURITY GUARD agrees to comply strictly with office policies, rules and
regulations. Failure to observe the same shall be a just cause for termination
or other appropriate disciplinary action. The SECURITY GUARD is duty-bound
to know, study and familiarize himself with all the policies, rules and
regulations of the EMPLOYER and employer’s client as soon as possible upon
hiring.
17. CONFIDENTIALITY OF INFORMATION AND RECORDS – The SECURITY GUARD
acknowledges that working with the EMPLOYEE entails the highest degree of
confidentiality, and he therefore commits not to disclose any confidential
information about the EMPLOYER or any of its clients. All records of the
EMPLOYER are confidential and the SECUIRTY GUARD shall not make any
unauthorized disclosure or reproduction thereof at any time during and after
his employment.

18. SURRENDER OF RECORDS, DOCUMENTS, SUPPLIES AND PROPERTY OF THE


EMPLOYER - The SECURITY GUARD shall surrender any and all records,
documents, supplies and property of the EMPLOYER and the CLIENT which
are in his possession or under his control at any time these are requested or
demanded by the EMPLOYER’S CLIENT’S duly-authorized representative. The
same shall all be surrendered immediately to the EMPLOYER’S authorized
representative at the termination of employment, even though no demand
or request was made therefore.
19. LOYALTY TO THE EMPLOYER; PROHIBITION AGAINST MOONLIGHTING – The
SECURITY GUARD shall devote all his working hours to the EMPLOYER. He
shall not engage in any other form of employment or business. If the
SECURITY GUARD worked with another company while he/she is still
employed with the EMPLOYER shall be a ground for his/her outright
dismissal.

20. TERMINATION FOR CAUSE – The SECURITY GUARD may be terminated for
any just and valid cause as provided by law. In such case, he shall be entitled
to receive his last salary up to the end of working hours of the last day of
actual service. However, the same shall be released to him only after he has
secured a written clearance of accountabilities for funds, property and
documents from the EMPLOYER.

21. RESIGNATION - The SECURITY GUARD agrees that in the event that he
decides to resign, he must submit his resignation letter at least one month
before the intended date of resignation. If he shall fail to observe the one
month notice requirement he shall forfeit all his remaining benefits and
privileges including his last salary, thirteenth month pay and others. The
EMPLOYER may likewise hold him liable for damages under the law. If he
complies with the one-month requirement he shall receive his last salary and
other benefits. If any, only at most one month after he has secured a written
clearance of his accountabilities for funds, property and documents for the
EMPLOYER.
