Task 2: Case Study

 In small groups, discuss the questions that follow which relate to the case study.

Case Study

At the school entrance there is a small step that often trips up visitors because it is difficult
to see. Ideally, this risk would be eliminated by removing the step altogether, but that would
mean lowering the floor of the building, which is neither practical nor cost efficient.

We could reduce/isolate the risk by getting students to come through via the fire stairs at the
rear of the building, but that contravenes the Code of Practice. Our next option would be to
modify the step by painting it with bright yellow paint and putting a sign on the door: “Be
careful of the small step.” The last resort would be providing every person entering the door
with a walking stick and kneepads so that if they were to fall, the protective clothing would
cushion their landing.

After reviewing the above strategies, it was decided that making the step more visible to
visitors with signage and bright paint is most suited to current financial constraints and
practicalities.

1. Identify all the control processes considered in the case study.

There are Four control process have been considered in this study:

1. The risk can be eliminated by removing step.

2. Use of fire stairs to enter building instead of front entrance.

3. Paint step with bright yellow colour and put safety sign near it.

4. Use of protective clothing to cushion their fall.

2. Why was lowering the floor rejected?

Lowering floor was rejected because it was neither practical nor cost effective solution.

3. What Code of Practice was considered to be contravened?


Fire stairs or fire exits only meant to use in emergency. Using them for temporary or other access
is a violation of code of practice.

1. Discuss Equal Employment Opportunities in Australia in a group of 2-3 and write


down your findings

Equal Employment opportunities (EEO) is shows the standard that all people, regardless of
gender, race, age, disability etc. have a right to be fairly considered for a job and job benefits.
EEO standards are important to implement in small businesses to avoid poor workplace culture
and negative consequences for non-compliance with EEO standards.

There are several laws which is aiming to protect anyone from discrimination and human right
breaches at the workplace. They are following:

1. The Age Discrimination Act 2004


2. The Disability Discrimination Act 1992
3. The Racial Discrimination Act 1975
4. The Sex Discrimination Act 1984

Importantly the Australian Human Rights Commission (AHRC) bears the responsibility under the
above key legislations. Under the key legislations the AHRC has the power to investigate any
complaints of alleged discrimination and breaches of human rights under these laws. Despite
the implementation of all the above laws and the power of the AHRC to investigate claims, EEO
practitioner Dr Sev Ozdowski has said that evidence of EEO in the workplace is not all that great.
He says that people living with a disability for example, are still having ten times the
unemployment rate.
2. Discuss and describe in your own words the Fair Work Act 2009 and Fair Work
Regulations 2009 in Australia.

The Fair Work Regulation 2009 set out that how we can apply or how certain words can be
defined of The Fair Work Act 2009.

The main objective of the Fair Work Act 2009 is to provide a balanced framework for
cooperative and productive workplace relations that promotes national economic prosperity
and social inclusion for all Australians.

The Fair Work Act 2009 provids workplace relations laws that are fair to working Australians,
are flexible for businesses, promote productivity and economic growth for Australia’s future
economic prosperity and consider Australia’s international labour obligations. It ensures a
guaranteed safety net of fair, relevant and enforceable minimum terms and conditions through
the National Employment Standards, modern awards and national minimum wage orders. It is
assisting employees to balance their work and family responsibilities by providing for flexible
working arrangements. It acknowledges the special circumstances of small and medium‑sized
businesses.
