AN ORDINANCE PROHIBITING SINGLE USE-PLASTICS IN CARINDERIA AND SARI-SARI STORES

WHEREAS; Article II, Section 16 of the Constitution provides, the state shall protect and
advance the right of the people to a balanced and healthful ecology in accord with the rhythm
and harmony of nature.

WHEREAS; Article II, Section 15 of the Constitution provides, the state shall protect and
promote the right to health of the people and instill health consciousness among them.

WHEREAS, Section 16 of RA 7160; the Local Government Unit may prescribe reasonable
regulations to protect the lives, health and property of their constituents and maintain peace
and order within their respective territorial jurisdictions

WHEREAS; one of the priority project of the Municipal Council is to strengthen policy on waste
management is to reduce, reuse and recycle plastic wastes.

WHEREAS; during random visit and inspection by the Municipal Council in selected carinderias
and sari-sari stores, it was found out that mostly of the sellers and owners used single use-
plastics.

WHEREAS; this use of single-use plastics thoughtlessly thrown away is damaging the
community and further contribute to plastic waste pollution.

SECTION I: TITLE
This ordinance shall be known as “AN ORDINANCE PROHIBITING SINGLE USE-PLASTICS
IN CARINDERIA AND RETAIL STORES”.

SECTION II: DECLARATION OF POLICY

It is hereby declared the policy of ………..to protect the welfare of its inhabitants by
promoting health and sanitation, peace and order and provide appropriate program and
services.

SECTION III: COVERAGE

This ordinance is enforceable and applicable within the territorial jurisdiction of…..

SECTION IV: DEFINITION OF TERMS

Person – a human being regarded as individual.

Seller – a person who sells something.
Buyer – a person who makes a purchase.
Single – Use Plastics – are used only once before they are thrown away or recycled,
otherwise known as disposable plastics.
Carinderia – a food stall with a small seating area, typically in a market or at a roadside.
 Sari- sari store – a convenience store, otherwise known as the neighborhood sundry or
variety store.

SECTION V: PROHIBITIVE ACTS

SECTION VII

Any ordinance, resolutions inconsistent with any provision of this ordinance is hereby
repealed or commended accordingly.

This Ordinance shall take effect Fifteen (15 days) after its approval, public dissemination,
public hearing and presentation on the general assembly.

Good day!

I am a Third Year Law Student of the College of Law of the University of San Agustin. I am
submitting a proposed barangay ordinance in substantial compliance with our subject in
Natural and Environmental Law. My proposed ordinance pertains to the prohibition against
single-use plastics.

As a resident of Barangay Calumpang, I have observed the practice of using single-use plastics
in carinderias and sari-sari stores. In connection with this, I have come up with this proposal to
make an ordinance entitled: AN ORDINANCE PROHIBITING SINGLE USE PLASTICS IN
CARINDERIA AND SARI-SARI STORES.

The aim of this ordinance is to reduce plastic waste management. This use of single-use plastics
thoughtlessly thrown away is damaging the community and further contribute to plastic waste
pollution.

I am looking forward for a positive response of this proposed ordinance.
