Subject: Recalling back to India as 1,047,842 live animals exported for profit: Restore their five freedoms.

Greetings,

Kindly refer to grievances bearing No. DOCOM/E/2018/01174:

Live animals export begins from Kandla Port in Gujarat without assessing surplus census of Sheep and
Goats, spoiling biodiversity, violating the Biological Diversity Act, 2002 because:
1. As per attached AWBI Advisory, all legal provisions were not followed, ignored for personal gain and
profit, concealed facts before the High Court of Gujarat, besides it these animals were badly abused while
shifting in non ISI specified goods transport vehicles, breaching section 51 A (g) of Indian Constitution and
five freedoms of animals, which were upheld by the Court of law, specified the responsibilities of
custodians of animals as per section 3 of the Prevention of Cruelty to Animals Act, 1950.
2. No pre transport permits were obtained being mandatory provisions.
3. India is rich in biological diversity and associated traditional and contemporary knowledge system
relating thereto. India is a party to the United Nations Convention on Biological Diversity signed at Rio de
Janeiro on the 5th day of June, 1992, the said Convention came into force on the 29th December, 1993, the
said Convention reaffirms the sovereign rights of the States over their biological resources but No
permission was granted under this law by the National Authority along with the Biodiversity Management
Committee, whereas violations of these legal provisions are cognizable and non bailable offenses, besides
it evidences were also destroyed being live animals were allowed to export outside India.
Hence, Ban live animal export at once, cancelling all permits and permissions to safeguard the biodiversity
of the state of Gujarat and Rajasthan, recalling back the live animals already exported from India to Gulf
Countries.

Transferred to the Ministry of Environment, Forest vide OM No. 9/4/2019-EP (Agri-II) dt. 16.1.2019 as attached.
Kindly refer to the National Biodiversity Authority explanation vide their letter No. NBA/Law/RTI/31/1/14/19-
20/2917 dated 12-12-2019, as reproduced below:
As per the Biological Diversity Act, 2002 any entity or organization registered abroad or registered
in India with non - Indian participation in its share capital or management, if involving in export of
livestock for research or for commercial utilization or bio - survey and bio - utilization, then such
entity or person shall obtain the prior permission of National Biodiversity Authority.
Office of the Commissioner of Customs confirmed vides their Order No. S/20-08/AA/RTI/19-20/4078 dated 27-11-
2019 that:
Details of Livestock exported from Old Tuna Port during last three years:

Goats - 643564, Sheep – 401278, Total 1,047,842 animals


Livestock have been exported from Old Tuna port to the following Countries:
U.A.E / Oman
No such information is available as per record:
1. Bureau of Indian Standards approval of vessels to carry livestock by sea, confirm their present status.
2. Define the role of Animal Welfare Board of India with National Biodiversity Authority in livestock export.
3. Confirmation - certificate as livestock shifted up to yard for export in a specified vehicle approved by Bureau of
Indian Standards.
4. Copies of Pre-transport permit as per section 96 of Cattle Transport Rules 1978 obtained for all species of
livestock exported.
5. Copies of No objection issued by NBA & AWBI for livestock exported from India.
Whereas Guidelines on Access to Biological Resources and Associated Knowledge and Benefits Sharing
Regulations, 2014 needs immediate attention for recovery from the exporters of biological resources,
amending essential conditions including as stated by NBA.
Hence, Recalling back to India as live animals Goats - 643564, Sheep - 401278, Total 1,047,842 animals
exported for profit, spoiling biodiversity, needs immediate attention, restoring their five freedoms, Ban
on
live animals export outside India: Interstate transportation needs scanner, establishing Animal
Welfare Authority of India with judicial powers & fast track courts.
