AN ORDINANCE ESTABLISHING BARANGAY VIOLENCE AGAINST


WOMEN (VAW) DESK. APPROPRIATING FUNDS AND FOR OTHER
PURPOSES.

EXPLANATORY NOTE

Violence exists in a various cycle and can happen to anyone. Those who
are physically weak and helpless to protect themselves are especially vulnerable
to it. Women can get out of this vicious cycle if they are empowered and
supported by various institutions, especially those at the Barangay level.
Barangay play a very important role in understanding, preventing and
addressing violence committed against women since they are the ones working
directly with people in the community. A Gender-responsive barangay
governance is needed to make VAW mechanisms work for their women
constituents. Violence, and any form of abuse, will not end unless there is a
determined and collaborative effort among stakeholders, particularly barangay
officials and community members. Since there is always a VAW Desk, everyone
should be vigilant and everyone should have the initiative to report incidents of
VAW. Women themselves whose rights are being violated must take courage to
stop the abuse.

A VAW Desk is a physical facility that addresses VAW cases in a manner


that is gender-sensitive. Managed by a person assigned by the Punong Barangay,
it is where the victim-survivor can immediately go to seek help. The VAW Desk
must be furnished with items and equipment necessary to make it fully
functional. Because it is important that the right to privacy and security of the
victim-survivor is respected, the following must be maintained:

1. An assurance of confidentiality throughout the engagement with the


client; and
2. The intake interview, using the prescribed intake form of the
barangay, should be done in a place where the client feels comfortable
and safe so she could relate her story without fear.

R.A. No. 9710 otherwise known as the MAGNA CARTA for WOMEN
mandates the establishment of Violence against Women (VAW) Desk in the
Barangay to respond to gender-based violence cases brought to the Barangay
and DILG Memorandum Circular No. 2017-114 Series of 2017 provide for the
Guidelines for Monitoring the Functionality of Violence against Women (VAW)
Desk in every Barangay.

Hence, a need to pass a Barangay Ordinance establishing a VAW Desk in


the Barangay.

BE IT ORDINANCE BY THE SANGGUNIANG BARANGAY IN SESSION


ASSEMBLED:

SECTION 1. –ESTABLISHMENT OF VAW DESK – There is hereby establish a


VAW Desk in the Barangay.

SECTION 2. - POWERS AND FUNCTIONS OF VAW DESK- The VAW Desk shall
perform the following powers and functions:

1. Respond to gender-based violence cases brought to the barangay;

2. Record the number of gender-based violence handled by the barangay


and submit a quarterly report on all cases of VAW to the DILG City Filed
Office and the City Social Welfare and Development (CSWD);

3. Keep VAW case records confidential and secured, and ensure that only
authorized personnel can access it;

4. Assist victims of VAW in securing Barangay Protection Order (BPO) and


access necessary services;

5. Develop the barangay’s gender-responsive plan in addressing gender-


based violence, including support services, capacity building and referral
system;

6. Coordinate with and refer cases to government agencies, non-


government organizations (NGOs), institutions, and other services
providers as necessary;

7. Address other forms of abuse committed against women, especially


senior citizens, women with disabilities, and other marginalized groups;

8. Lead advocacies on the elimination of VAW in the community; and

9. Perform other related functions as may be assigned.


SECTION 3. – DESIGNATION OF VAW DESK OFFICER – The VAW Desk Officer
shall be designated by the Punong Barangay; He/She plays a very significant role
in giving services to victim-survivors.

SECTION 4. – QUALIFICATION OF VAW DESK OFFICER – No person shall be


designated as VAW Desk Officer unless he/she possesses the following
qualifications:

1. Must be trained in gender-sensitive handling cases;

2. Committed to help victim-survivor;

3. Responsive without being judgmental;

4. Willing to learn and be trained;

5. Honest and efficient in using budget;

6. resourceful in providing the needs of the victim-survivors;

7. Must have knowledge on the basic principles and context in addressing


VAW;

8. Must be willing to undergo training, seminars and workshop to be more


sensitive in handling cases, and change traditional mindset and better
understand the issues related to VAW;

9. Must be acquainted with the following laws:

a.) Anti-Violence Against women and their Children (R.A. 9262);

b.) Magna Carta for Women R. A. 9710;

c.) Anti-Trafficking in Persons Act (R.A. 9208);

d.) Anti-Rape Law (R.A. 8353) and Rape Shelter Act (R.A. 8505);

e.) Anti Child abuse Act (R.A. 7610);

f.) Anti sexual Harassment Law (R.A. 7877);

g.) Gender Related Provisions of the Revised Penal Code, such as


Physical Injuries and Acts of Lasciviousness;
h.) relevant provisions of the Family Code.

The VAW Desk Officer must be preferably a woman Barangay Kagawad, or


a woman barangay tanod.

SECTION 5. – APPROPRIATION – The funds necessary to support the


establishment and operations of the VAW shall be taken from the Annual
Appropriation allocated for Five (5%) of Gender and Development (GAD) Fund.

SECTION 6. – SEPARABILITY CLAUSE – of any provision or part of this


Ordinance is declared invalid other part or parts that are not affected shall
remain in the full force and effect.

SECTION 7. – REPEALING CLAUSE – Any Ordinance that is not consistent with


this Ordinance is hereby repealed or modified accordingly.

SECTION 8. – EFFECTIVITY – This Ordinance shall be effective after compliance


with the requirements of posting pursuant to the local government code of 1991.

The Interest of Public Service requiring, you are hereby designated as the
Violence Against Women (VAW) Desk Officer.

As such you are directed to perform the following functions:

1. Must be trained in gender-sensitive handling cases;

2. Committed to help victim-survivor;

3. Responsive without being judgmental;

4. Willing to learn and be trained;

5. Honest and efficient in using budget;

6. resourceful in providing the needs of the victim-survivors;

This Memorandum is issued pursuant to R.A. 9710, otherwise known as


the Magna Carta for Women, DILG Memorandum Circular No. 2017-114,
Guidelines in Monitoring Functionality of VAW Desk in Every Barangay and
Barangay Ordinance No. 011 Series of 2018. For information and guidance of all
concerned.
