CONTRACT/AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement made and entered into this ____ day of ____________
in __________, Philippines, by and between:

NESTOR A. MANIBOG JR., of legal age, Filipino, married and a


residence of B22 L17 PH-1 Dolmar Golden Hills Subdivision, Barangay Loma
De Gato, Marilao, Bulacan hereinafter referred to as the OWNER;

- AND -

RENATO T. AMURAO, of legal age, Filipino and with residence and


postal address at Phase 2 Dolmar Golden Hills Subdivision, Barangay Loma De
Gato, Marilao, Bulacan hereinafter referred to as the CONTRACTOR;

WHEREAS, the Owner and the Contractor orally entered into a


Contract of Service for the construction of Fence/Wall located at B38 L23
PH-2 Golden Hills Panorama, Barangay Loma De Gato, Marilao,
Bulacan on November 20, 2019.

WHEREAS, the subject lot where the Fence/Wall is to be constructed is


owned by the herein Owner.

WHEREAS, the Contractor agreed to construct the Fence/Wall for a


period of (3) three weeks or more specifically will be completed on
December 15, 2019.

WHEREAS, the contract price for the construction of the subject


Fence/Wall is EIGHTY-NINE THOUSAND FIVE HUNDRED TWO PESOS
(PHP 89,502.00).

WHEREAS, the subject construction was never completed due to the


fault of the Contractor.

NOW THEREFORE, in consideration of the foregoing and the further


covenants hereinafter set forth, the parties agreed as follows:

1. That the Owner will complete the construction of the subject Fence/Wall
at his own expense.

2. That the Contractor already received the amount of SEVENTY-NINE


THOUSAND PESOS (PHP 79,000.00) from the Owner.

3. That the Contractor already expressed his intention of terminating the


said Contract of Services despite failing to complete the subject lot on
the agreed period.
4. This Compromise Agreement shall not affect nor prejudice any case or
cases between the parties not specifically referred to herein.

5. The signatories to this Agreement hereby represent and warrant that


they are duly authorized to execute this Agreement.

6. The parties or their assigns hereby WAIVE, RENOUNCE and


FOREVER QUITCLAIM all their respective claims and counterclaims
subject of the instant action as well as those that may arise therefrom,
in connection therewith or in relation thereto.

7. The foregoing covenants are not contrary to law, morals, or public


policy and the parties bind themselves to comply strictly with their
undertakings.

IN WITNESS WHEREOF, parties herein affixed their signatures on the


date and place above written.
