1.

The SECOND PARTY shall cover the hospitalization bills and other
incidental expenses for medication, with proper doctor’s prescription,
loss of the First Party’s daily income during the period of hospitalization,
and repairs of the damaged motorcycle, in a lump sum amount of One
Hundred Thousand Pesos Only (P100,000.00) one time grant;

2. That VILLARE PAILAGAO SATULOMBON shall allow the release of the

Second Party including the driver’s license, documents, and the vehicle;

3. That upon signing of this instrument, the FIRST PARTY shall execute an
Affidavit of Waiver and/or Affidavit of Desistance stating that she was
no longer interested to file a civil and criminal charge against the
SECOND PARTY nor to act as witness thereof;

4. That by reason of the foregoing, the PARTIES have agreed that this
Memorandum of Agreement is their full and final settlement (criminal,
civil and/or administrative cases) re: the vehicular accident mentioned.

5. The FIRST PARTY reserve the right to file action whenever the SECOND
PARTY cannot comply the agreement.
