SOFTWARE LICENSE AGREEMENT
This Agreement is a license agreement between you and JUNE FABRICS TECHNOLOGY IN
C. for the use of the enclosed software (PdaNet). PdaNet is protected by both U
nited States and International copyright law. Therefore, you must treat this l
icense and PdaNet just like a book, with the following exceptions: you agree, p
ursuant to the license, not to rent or lease PdaNet in any form. In addition, y
ou may not make any copies of PdaNet, except that you may make one archival copy
of PdaNet for the sole purpose of backing you your Software and protecting your
Investment from loss. This copy must include all copyright notices on PdaNet.
By saying "just like a book" JUNE FABRICS TECHNOLOGY INC. means that PdaNet may
be used under the license by any number of people, and may be freely moved from
one computer location to another so long as there is no possibility of its bein
g used at one location while it is simultaneously used at another. For example,
just as a book cannot be read by two Different people in two different places a
t the same time, neither can PdaNet be used by used (without violating this agre
ement) by two different people in two different places at the same time.
This license is not a sale. Title and copyrights to PdaNet, accompanying Docume
ntation and any copy made by your remain with JUNE FABRICS TECHNOLOGY INC.. Una
uthorized copying of PdaNet or the accompanying Documentation or failure to comp
ly with the above restrictions, will result in automatic termination of this lic
ense and will make available to JUNE FABRICS TECHNOLOGY INC. other legal remedie
s. Upon termination of this license, you must return all copies of PdaNet to JU
NE FABRICS TECHNOLOGY INC. and erase any copies from your hard disk.
Permitted uses
You may operate PdaNet on a single device provided you do not exceed the quantit
y of license purchased. Additional device utilizing PdaNet must be licensed by J
UNE FABRICS TECHNOLOGY INC..
Uses not permitted
You may not:
Make copies of PdaNet, except as permitted in this agreement.
Make copies of Related Materials.
Alter, decompile, disassemble, or reverse engineer PdaNet.
Remove, or alter the JUNE FABRICS TECHNOLOGY INC. copyright, and trademark notic
es.
Remove, or alter the icons within PdaNet
Rent, lease, sub-license or transfer PdaNet, Software copies,
Related Materials or your
rights under this license without the prior written consent of JUNE FABRICS TECH
NOLOGY INC..
JUNE FABRICS TECHNOLOGY INC. is not responsible for any charges you may incur fr
om your cellular provider as a result of using PdaNet.
JUNE FABRICS TECHNOLOGY INC. MAKES, AND YOU RECEIVE, NO WARRANTIES, EXPRESS, IMP
LIED STATUTORY OR IN ANY COMMUNICATION WITH YOU AND JUNE FABRICS TECHNOLOGY INC.
SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE. JUNE FABRICS TECHNOLOGY INC. DOES NOT WARRANT THAT THE OPE
RATION OF PDANET
WILL BE UNINTERRUPTED OR ERROR-FREE.
Some states do not allow the exclusion of implied warranties so the above exclus
ion may not apply to you. This warranty gives you specific legal rights. You ma
y also have other rights which vary from state to state.
LIMITATION OF LIABILITY
IN NO EVENT WILL JUNE FABRICS TECHNOLOGY INC. BE LIABLE FOR ANY DAMAGES, INCLUDI
NG LOSS OF DATA, LOST PROFITS, COST OF COVER OR OTHER SPECIAL INCIDENTAL CONSEQU
ENTIAL OR INDIRECT DAMAGES ARISING FROM THE USE OF PDANET OR ACCOMPANYING DOCUME
NTATION, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY. THIS LIMITATION WILL APP
LY EVEN IF JUNE FABRICS TECHNOLOGY INC. OR ANY AUTHORIZED DEALER HAS BEEN ADVISE
D OF THE POSSIBILITY OF SUCH DAMAGE.YOU ACKNOWLEDGE THAT THE LICENSE FEE REFLECT
S THIS ALLOCATION OF RISK. SOME STATES DO NOT ALLOW LIMITATION OR EXCLUSION OF
LIABILITY FORINCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NO
T APPLY TO YOU.
