UNITED STATES COURT OF APPEALS FOR THE DISTRICT OF COLUMBIA WARTIN ©. ARMSTRONG Appellant mv No: 09 ~ 1260 SECURITIES & EXCHANGE COMMISSION Appellee DECLARATION OF MARTIN A. ARMSTRONG I, Martin A. Armstrong, hereby declare under penalty of perjury pursuant to 28 USC §1746, that I believe T was infected with a MERCA-like bacteria from the shower or I was poisoned by food, but this has been going on since at least April and every effort I have made to obtain medical attention has been denied. My many complaints finally produced an outside doctor Patel to see me on Nov. 17, 2010. He had the equipment to test the pressure in my eye and confirmed there is a serious infection or glaucoma. My legs are now numb, I doubt I will be able to walk more than another week or two, and my pleas to be taken to a hospital have been ignored. This I believe is retaliation for my petitioning the courts and I do not believe I will eurvive even until March when I was to be released. This is convienently taking place now when I am about to be released and I cannot obtain bail nor medical attention which is illogical in such an emergency condition, The Bureau of Prison's own Lab report confirmed there was a staph infection (Exhibit A) and I sent a copy to my family doctor part of the local hospital who confirmed the seriousness of this condition (Exhibit B). Now that-an outside doctor Patel has confirmed that the BOP Doctor Abigail Lopez de LaSalle is completely wrong, Armstrong is at a loss as to why he is being denied medical attention unless this is a deliberate effort to now prevent any defense whatsoever in this case of an outrageous abuse of process when government attorneys place personal career prospects above their constitutional duty to refuse to admit error that would effect their. employment prospects. I can only ask this court under equity to order medical attention or to order a change in custody or bail in the pending petition in the parallel gppeal 0975370 in the interest of justice. Norton, DO Mary-Elizabeth Gaskill, MSN, APN, C : Martin, Itis nice to hear from you, Iam aware of the ordeal that has befallen you over the lest many years, Iam concetried by the cultures results obtained from your eye. Tam not fully sure if there isa tie in with the issue of your eye and the other skeletal inusele symptoms you are experiencing, Even though the species of Staphylococeus is Coagulase negative (a common skin organism) it can cause a severe burden to organ structures in individuals who are immuno-compromised. Based on what I know of your health status 1am concerned that your health is in a weakened state, This infection should be treated aggressively with oral antibiotics along with topical eye drops, I would request that special care would be considered by the Correctional Institutional Physician ‘that an Ophthalmologist be consulted urgently. Surgery may need to be considered if the scope of the infection is deeper within the eye. Because of your history of head trauma, disruption of orbital tissue can be a source of localized abscess that can invade the eye. (ACT scan of the orbits would be a good first radiological test to define regions of involvement). If not treated aggressively you will lose complete function of your eye. This should not be dismissed as a commensal (normal inhabitant) organism. Tcannot comment about the weakness you're experiencing with your muscles. Additional laboratory studies would be of help, Specifically, CPK, Aldolase, sedimentation rate, CRP, TSH, RPR would be a good starting point. ‘Your lipid profile is fairly good and requires no immediate intervention, ‘Your mother and Lhave prayed for ‘God's mercy on your life, She longs for your homecoming, Sincerely, Dr. Mike 19 West Main Street, Suite C, Meple Shacle, NJ 08052 | Phone: (856) 778-7386 | Fex: (856) 779-7563) www.virtua.org p09 219 AM FRO: LABCORP LCLS BLK To: 26097; 238712 Lancome Page 2 of 2 stt44 9 = Susceptible; I = Intermediate; R = Resistant +« P= Positive; ¥ = Negative MICS are expressed Antibiotic Ciprofloxacin Clindanyein Erythromycin Gentaniein Levofloxacin Oxaci lin Penicillin Rifanpin Tetracycline rinethopr in/Sulfa Vancomycin RSLTEI in micrograms per xb RSLTE2 —-RSLT#S s Her 33 ovennnaeme TO; Federal Correctional Inst West. teen LabCorp ial aseee ate _ ete aeitGeteis-0 | azsie 08d soorraéives | 2sto0es | Sas" Soy | ARNSTRONG, Boece Federal Correctional tnat West mange ‘Packet Mie Kae CORE SERVICES LDING # 5756 a eect eat Sa rae FORT pix wy da64o Boe =a See See ee ee 7 = 7 sorte | otyees20 0809 oe Asrobte.sucteésal curture; Sensitivity oceania E pas = aS a penicillifs ‘such as cloxacillin and dicloxaciliin, (2) combinations fe) ‘anti-stapkylecoccal cephalosporins.
