long-term health care facilities.

The State Veterans¶ Homes Program currently operates as a division equivalent within FDVA. The program is
funded by a combination of Medicare, Medicaid, Private Pay, Third Party Insurance, VA Per Diem and General
Revenue. The appropriations are determined by the rules and budget process of the legislature and provided to
the Homes Program in the annual General Appropriations Act. All employees of the Program are state
employees subject to the statutes and rules governing state employment.

Establish a public body corporate and politic designed to provide assisted living and skilled nursing homes for
veterans through amendment of Chapter 296, F.S. as ³Florida Veterans¶ Homes.´ The corporation would be
constituted as a public instrumentality, governed by a Board of Trustees. The employees of the corporation
would not be subject to state employment laws.

In addition to the existing homes, Florida Veterans¶ Homes could expand its regional long-term care services as
authorized by the Board of Trustees if funds are available from the U.S. Department of Veterans Affairs (VA),
State of Florida or other sources.

Florida Veterans¶ Homes would not participate in the budget process of state government. Rather, Florida
Veterans¶ Homes would prepare and submit the annual budget to the Board of Trustees for approval.

Florida Veterans¶ Homes would be the legal successor in all respects to the FDVA State Veterans¶ Homes
Program and obligated to the same extent as FDVA under any agreements existing on the date of
implementation. It would be entitled to any rights and remedies previously afforded FDVA by law or contract.
All assets and liabilities would transfer to the Florida Veterans¶ Homes upon the effective date of this transition
or upon a date specified by the Board of Trustees if a later date were required for an orderly transition.

Sovereign immunity and coverage through the State Risk Management Trust Fund would continue to apply for
Florida Veterans¶ Homes and its employees.

The corporation would continue to be subject to the Florida Public Records Act, Sunshine Law and statutes
regarding the use and maintenance of public property and buildings. Florida Veterans¶ Homes would be
exempt from the Administrative Procedures Act and state procurement laws.
